controversialStateSupremeCourtchiefjustice.Neilsontooktheextraordinarystepsofsealing
thecasefileandorderingShulertoremoveallcontentabouttheallegedaffairfromhisblog.
WhenthestorieswerenottakendownandShulerfailedtoappearatcourthearings,Neilson
heldhimincontempt,orderedhisarrestandjailedhimwithoutbail.
TheAlabamaACLUandtheReportersCommitteeforFreedomofthePresshaveprotestedthe
judge'sscruborderasunlawfulpriorrestraintunderwell-establishedFirstAmendmentcaselaw.
Thejudgehasn'tmadeasinglelawfulorderinthiscase,ShulertoldWhoWhatWhy.

whenthejudgemadepermanenthisinjunctionorderingShulertoremovetheblogcontent.
AccordingtoShuler,whenheexplainedthathewasunabletoremovethepostswhilein
custody,thejudgecurtlyreplied,"That'syourproblem.
Tocallitakangaroocourtisaninsulttokangaroos,Shulersaid."t'sworsethanajoke.
Thedayaftermakingthatcomment,hegotameasureofaffirmationfromanunexpected

OnNov.18,theU.S.SupremeCourtannouncedthatitwoulddeclinetohearthecaseofa
convictedcop-killerfromMontgomerywhowassparedthedeathpenaltybyanAlabamajury
onlytobesubsequentlysentencedtodeathanywaybythetrialjudge.Onlythreestatesallow
thepracticeof"judicialoverrides,and26ofthe27overridesrecordedsince2000have
occurredinAlabama.
nanunusualdissent,JusticeSoniaSotomayorwrotethat"Alabamastandsaloneinthehighly
politicizedpractice,wherejudgesaremotivatedbyre-election,notjustice.Shewrote:
WhatcouldexplainAlabamajudges'distinctiveproclivityforimposingdeathsentencesincases
whereajuryhasalreadyrejectedthatpenalty?Thereisnoevidencethatcriminalactivityis
moreheinousinAlabamathaninotherstates,orthatAlabamajuriesareparticularlylenientin
weighingaggravatingandmitigatingcircumstances.Theonlyanswerthatissupportedby
empiricalevidenceisonethat,inmyview,castsacloudofillegitimacyoverthecriminaljustice
system:Alabamajudges,whoareelectedinpartisanproceedings,appeartohavesuccumbed
toelectoralpressures.

thefeelingonsomeofthem,Neilsonsaid."t'sjustsomethingthatifyou'vedoneitforaslong
ashave,youkindasizeuppeopleandkindahaveagutfeelingthatmaybetheymaynotbe
tellingthetruth.

usedtothinkthatprobablywouldneverbeinvolvedinacourtcase.Andifwassomehow
involved,figuredthejudge(orjudges)surelywouldruleaccordingtothelaw.Afterall,they
wearrobes,wecallthem"yourhonor,werisewhentheycomeintothecourtroom.Ofall
people,surelyajudgewouldbehonest.
Thisblogwillshowyouhowwrongwas.twillshowyouhowjudgesandattorneysconspireto
cheatsomepeopleandfavorothers.twillshowyouhowpoliticsraisesitsuglyheadinour

Southpoliticalelite.
