SUMMARY OF THE SPECIAL AND GENERAL PROVISIONS I.

SPECIAL PROVISIONS 1) Congress of the Philippines, Judiciary, Ombudsman, Commission on Election, Commission on Audit, and Civil Service Commission a) Deleted the Special Provisions of Offices with Fiscal Autonomy, specifically on the Funding Requirements for the Filling of Unfilled Positions since it is against the Constitution. 2) Department of Education, Department of Public Works and Highways, Department of National Defense, Department of Social Welfare and Development a) Addition of a phrase under the Quick Response Fund specifying that the department shall submit quarterly reports on the status of utilization of the QRF, not only to the DBM but also to the House Committee on Appropriations and the Senate Committee on Finance. 3) Department of Health and Department of Transportation and Communication a) New Special Provision providing for a Quick Response Fund for the DOH and the DOTC amounting to P500 million and P1 billion, respectively and requiring all agencies (DSWD, DND-OCD, DND-OSEC, DPWH, DepEd, DA, DOH and DOTC) with QRF to submit a utilization report to the Committee on Finance and Committee on Appropriations. 4) Department of Education, Department of Health, and Department of Public Works and Highways a) Specification that the realignment of appropriations released for projects may be undertaken not later than the third quarter of the current year. 5) Department of Agriculture Office of the Secretary a) Deleted the phrase requiring COCAFAMs issuance of revised implementation guidelines on the utilization of the ACEF before any releases are made under the Loan Assistance Program of the ACEF. This is due to the recent Supreme Court Ruling on the participation of the legislators after the approval of the GAB. DA - Bureau of Fisheries and Aquatic Resources a) Deleting the proviso requiring the submission by the BFAR to the DBM of a master plan for post-harvest development services and facilities prepared by the DA before any releases for the National Fisheries Program are made. 6) Department of Education Office of the Secretary a) Inclusion of the Special Hardship Allowance among the Regionwide Lump Sum Appropriations which are allocated to the various DepEd implementing units.

7) State Universities and Colleges a) New provision on the Scholarship Program for Poor and Deserving Students, specifying its exclusive use for Tertiary Education and not for any other purpose, and that courses to be offered shall be allied with the priorities of the government in key growth areas; 8) Department of Environment and Natural Resources Office of the Secretary a) Additional proviso under the special provision on the Integrated Protected Areas Fund allowing the Protected Area Management Board (PAMB) of each protected area to retain 75% of all their income, and authorizing them to use P30 million sourced from the remaining fund deposited in the trust account to finance the projects of the system; 9) Finance Securities and Exchange Commission a) New Special Provision allowing the SEC to use its excess income for the acquisition of land for its official site and purchase of equipment and furniture and fixtures. 10) Department of Health Office of the Secretary a) Deleting the proviso under the Health Facilities Enhancement Program allowing the DPWH and DOH to deduct not more than 1.5% and 1%, respectively, of the project cost for infrastructure projects as administrative overhead expenses; deleting the proviso under the same special provision stating that administrative overhead expense shall not be authorized for infrastructure projects costing P5 million and below. The special provision on the DPWH on EAO will govern. 11) Department of National Defense Office of Civil Defense a) A new provision requiring the OCD to develop a Disaster Response Manual to serve as the basis of the response expected from the different agencies and sectors on every disaster. 12) Department of Public Works and Highways - Office of the Secretary a) Amendment specifying that an Engineering and Administrative Overhead Expense of one-half percent (0.5%) of the project cost shall be imposed for school buildings and other infrastructure projects of other departments/agencies being implemented by the DPWH; b) A new special provision allowing the Use of Income derived from laboratory and testing fees and sub-soil exploration activities to be constituted as a trust fund for the repair, maintenance and procurement of research, materials and sub-soil explorations equipment; 13) Department of Social Welfare and Development Office of the Secretary

a) Providing for an amount of P336 million under the Conditional Cash Transfer Program to fund cash grants for 20,000 families affected by Typhoon Yolanda who are not covered under the existing CCT program of the DSWD and allowing the relaxation of disbursements schedules and/or compliance requirements for such calamity-stricken beneficiaries; 14) Department of Trade and Industry Office of the Secretary a) A new special provision on Implementation of Shared Service Facilities that aims to improve the quality and productivity of micro-small and medium enterprises through the provision of machinery, equipment, IT systems, tools and related accessories; 15) Other Executive Offices Commission on Higher Education a) Additional proviso under its Scholarship Program requiring that the CHED shall ensure that existing scholars whose funding are charged from other sources shall continue to receive scholarship assistance; 16) Other Executive Offices Governance Commission for Government-Owned and Controlled Corporation (GCG) a) A new special provision requiring the GCG to submit to the House Committee on Appropriations and the Senate Committee on Finance an anuual report containing GOCCsperformance,vis--vis targets, financial condition, dividends remitted to the national government, and the salaries, allowances, bonuses, per diems and other such emolument and remunerations of the officers and members of the Board of Directors; 17) Other Executive Offices Philippine Sports Commission a) A new special provision on Maintenance and other Operating Expenses (MOOE) for the Promotion of Amateur Sports which shall be used only for the benefit of athletes and shall not be realigned to any other purpose; b) A new special provision requiring the Governance Commission for GOCC to submit an annual report on the financial position and performance of all GOCCs. 18) Budgetary Support to Government Corporations Cagayan Economic Zone a) A new special provision entitled Equity to the Cagayan Economic Zone appropriating P882 million as equity for CEZA to be used exclusively for the development of the navigational channel of the Port Irene Navigational Channel Project; National Housing Authority a) Appropriating P100 million for NHAs Housing Assistance Program for Calamity Victims and P200 million for the Resettlement Program;

19) Allocations to Local Government Units Local Government Support Fund a) Earmarking of P100 million under the Local Government Support Fund for the City of Manila 20) Calamity Fund a) Earmarking 30% under the NDRRM Fund as Quick Response Fund (QRF) or stand-by fund for relief and recovery programs in order that situation and living conditions of people in communities or areas stricken by disasters, calamities, epidemics, or complex emergencies may be normalized as quickly as possible; 21) Unprogrammed Fund a) Additional proviso specifying that the release of Unprogrammed Fund shall be subject to Section 62 of the General Provisions of the GAA; b) A new special provision providing that the amount of P80 billion for the Repair and Rehabilitation fund shall be released in accordance with Sec. 62 of the General Provisions of the GAA. Collections arising from sources that are not in the original revenue targets, proceeds from grants, concessional loans for the repair and rehabilitation of calamity-stricken areas and savings generated from the programmed appropriations may be released to cover the appropriations provided herein; c) A new special provision allowing for Augmentation within the Unprogrammed Fund except for Purpose 1 (Budgetary Support to GOCCs) and Purpose 2 (Support to Foreign-Assisted Projects), subject to the approval by the President. II. GENERAL PROVISIONS 1. Providing that the utilization of the appropriations for new research and development should be in accordance with the Philippine Development Plan (2011-2016) and the Harmonized Priority Research Agenda. 2. Providing that no major infrastructure projects be undertaken in protected areas and other areas identified as danger zone, unless for protection and mitigation purposes. 3. Providing that the appropriations for MOOE and Capital Outlays be extended to one fiscal year after the end of the year in which they were appropriated. 4. Providing that the release of lump-sum appropriations be subject to Sec. 35, Chapter 5, Book VI of E.O. No. 292 and that a copy of the reportorial requirements be also submitted to the House Committee on Appropriations and the Senate Committee on Finance. 5. Providing that the appropriations for bottom-up budgeting specifically identified in Annex A (Volume 1) should be implemented by the LGUs and in no case should

the project cost exceed the cost of a similar project being implemented by the National Government in the same locality. 6. Providing that all transfer of funds to CSOs should comply with the Procurement Code and its Implementing Rules and Regulations. The Government agency that has transferred funds to CSOs shall remain accountable to the funds transferred. The guidelines in the accreditation of the CSOs are issued jointly by the DSWD, COA and DBM. The DSWD shall ensure that the list of accredited CSOs and any modification thereof are posted immediately in the DSWD website. Any government official, employee, and person who shall misuse the fund under their accountability will be held criminally liable. 7. Providing that the realignment of savings from capital outlays be undertaken not later than the third quarter of the current year. 8. Providing that the DBM will provide the COA a list of all items that were considered released upon the effectivity of the General Appropriations Act and a copy of all release documents. 9. Providing that agencies will submit to the House Committee on Appropriations and the Senate Committee on Finance a report on all income collections and utilizations. 10. Constituting the Expenditures. Joint Congressional Oversight Committee on Public
