OrdinanceodeSection9.l2.1203theOrdinance")nfringesntheirfree speechights nviolationof the UnitedStates ndCaliforniaConstitutions.a hegroupof Plaintifß consists fRussell ndSallie Nordyke,whohavebeenpromotinggunshowsattheAlameda County Fairgrounds("Fairgrounds")ince1991,aswell as welvegunshowvendors,xhibitors,ndpatrons.Theexhibitorsatthe show nclude sellersof antiquepre-1898)trearms,modem firearms,ammunition,OldWestmemorabilia,and outdoorclothing.Thegunshowsalso hostseducationalworkshops,issuegroups,andpoliticalorganizations.Plaintiffs'gunshowsbringlargenumbersoffirearmsoone ocation. Theapproximateattendancetone of Plaintifß'gunshowsattheFairgroundss 4,000people.Thesegunshowsinvolve the exhibition, display,and saleoffirearms.rWhenagunissoldat Plaintifß'gunshows,both theseller andhebuyerphysicallynspectheguno insurecorrectdocumentationf the serialnumber,make,model, and caliberofthegun;and alsoo veriff thatthefirearm may be egally sold.Plaintiffs allege hatthey"havehistoricallybrought irearmsonto . . .theAlamedaCountyFairgroundsor various symbolicand expressiveurposes."Theyallege hat, byprohibitingpossessionf firearmsatthe Fairgrounds,he Ordinancereventshemfromengagingnthisexpressiveonduct,ndmakesgunshowsirtually mpossible.OnJuly4, 1998,a shootingoccurredat the AlamedaCountyFairgroundsduringhe annualCountyFairresultingngunshotwounds oeightpeople.The shootingwas not associatedith anyofthePlaintiffsor theirgunshowactivitiesatheFairgrounds.OnAugust1.7,l999,theCountyadopted heOrdinanceprohibitingthepossessionf firearrnsonCountyProperty,ncludingheFairgrounds.The Ordinance ecitedheepidemicofgunshotatalitiesor injuries n thecountyasjustification.Inpaficular,between990and 1995,879homicideswerecommittedsing irearmsand 1,647additionalvictimswerehospitalizedwithgunshotnjuries in the County.The Ordinancealso ecited he July 4, 1998shooting ncidentonthe Fairgrounds.
rSection9.12.120(b)rovides,Everypersonwhobringsontoorpossessesn Countypropertya firearm, oadedor unloaded,rammunition or a firearm sguiltyofamisdemeanor,"AlamedaCountyGen. The Ordinancewassubject o certainimitations and exceptions.Countypropertydid notincludeanylocalpublicbuilding"asdefined n CaliforniaPenalCodesection17lb,subdivision(c). (AlamedaCountyGen.Ord. Code,ch.912,$9. 2.120,suM.C.) Pursuanto anamendment nSeptember8,1999, he Ordinancexemptedromtheprohibitionvariousclasses fpersons,includingpeaceofficers, variousypesof securityguards,personsolding validfirearmsicensespursuanto PenalCodesection12050, ndauthorizedarticipantsina motionpicture,elevision,video, dance,or theatricalproductionoreventwhen heparticipant awfullyuseshe firearmaspartofthatproductionor event,providedhat whensuchirearms notinthe actualpossessionftheauthorizedparticipant,t is secured opreventunauthorizedse."(AlamedaCountyGen.Ord. Code,ch.9.I2,$9.12.120, ubd.F.) The Ordinance ouldhave,asone of itschief consequences,heeffectof forbidding theunsecuredresenceffirearmsatgunshows.AfterpassingheOrdinance,the County soughta writtenplanfrom Plaintiffs onhowPlaintiffs wouldconduct heirgunshows ncompliancewith theOrdinance.Plaintiffssubsequentlynformedhe CountyhatPlaintiffs couldnotpracticallyorprofitablyconductagunshowwithoutguns.As aresultofthe Ordinance,Plaintiffscancelledagunshowscheduledor November6 and 7, 1999.Shortly hereafter,heCountyreleasedll Plaintiffs'reserveddatesor theyear2000 andreturnedPlaintiffs'deposits.Asjustification,DefendantsitedPlaintiffs'inabilitytoproduceaplanto holdgunshowswithoutfirearmshat would complywith theOrdinance.PlaintiffshaveheldapproximatelywentywogunshowsnCaliforniasince2005.Othergroups,besidesPlaintiffs havebeenaffectedbytheOrdinance. Specifically,duringthemonthsofAugustandSeptember 999,heScottishCaledonianGames"ScottishGames")contactedheCountyregardinghe Ordinance's mpacton theirculturalevents.TheScottishGamesinvolve thepossessionfrifleswithblank cartridgesnconnectionwith historicalre-enactments fgunbattles.
