request to change the zoningfrom “R-1B” Single Family Residential District to “R-2” Two-FamilyResidential District on Lots 1A and 1B of Block 457, two lots totaling0.62± acres located at the southeast corner of Spring Avenue and EastNutbush Street, fronting 180.63± feet along the south side of EastNutbush Street and fronting 147.6± feet along the east side of SpringAvenue (1811 & 1813 Spring Avenue and 209 & 203 East NutbushStreet).Page: 1 of 2
The applicant is requesting a zoning change to bring an existing duplex into compliance for loan purposes.Section 10-212, "R-2" Two-Family Residential District allows as a permitted use two-familyresidential units (duplexes). The "R-2" Two-Family Residential District requires a minimum lot sizeof 7,000 square feet. The maximum height of buildings within the "R-2" District is two and one-half (2 1/2) stories or forty-two (42) feet in height and all setback lines are consistent with other residential districts.The Planning Department has reviewed this application and states the adjacent properties to thenorth, south, and west are zoned “R-1B” Single Family Residential District. Properties to the eastare zoned “R-2” Two-Family Residential District. The future land use map designates this area aslow density residential. The applicant is rezoning these lots to allow two existing structures to beremodeled into duplexes. The applicant is attempting to secure a loan for remodeling purposes andthe bank will only loan money if the zoning is conforming. In 1980 and 1993, the applicant securedduplex zoning on Lot 5A located east of the subject properties, which was replatted from two lots toone. Staff feels that this request would be an extension of the “R-2” zoning line to the east. Staff also feels the duplexes have revitalized the area and the new duplexes will continue that trend.On June 3, 2003, the Planning and Zoning Commission held a public hearing on this request. Nowritten letters of protest were filed and no one spoke in opposition to the request. No one spokeon behalf of the application.All other departments have reviewed this request and anticipate no significant impact on services or facilities by the proposed change.
 
 
RECOMMENDATION:
The Planning and Zoning Commission, by a vote of 5-0, recommends the approval of this request tochange the zoning from “R-1B” Single Family Residential District to“R-2” Two-Family District.
