Staff’s Revised Version 9-3-08ORDINANCE NO. __________ An ordinance amending Chapter 51A, “Dallas Development Code: Ordinance No. 19455, asamended,” of the Dallas City Code by amending Section 51A-4.501; allowing demolition of historic structures pursuant to a court order; allowing the fire marshal to summarily abatehazards; renumbering certain subsections of Section 51A-4.501; providing a penalty not toexceed $2,000; providing a saving clause; providing a severability clause; and providing aneffective date.WHEREAS, the city plan commission and the city council, in accordance with theCharter of the City of Dallas, the state law, and the ordinances of the City of Dallas, have giventhe required notices and have held the required public hearings regarding this amendment to theDallas City Code; Now, Therefore,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DALLAS:SECTION 1. That Section 27-16.11, “Miscellaneous Notice Provisions,” of Article IV-a,“Municipal Court Jurisdiction over Urban Nuisances,” of Chapter 27, “Minimum UrbanRehabilitation Standards,” of the Dallas City Code is amended by adding a new Subsection (d),to read as follows:“(d) If the city attorney requests a court to issue an order requiring demolition of a
structure on a property subject to a predesignation moratorium or a structure in a historic overlay
district, the city attorney shall comply with the notice and other requirements in Section 51A-
4.501(i).”SECTION 2. That Section 51A-4.501, “Historic Overlay District,” of Division 51A-4.500, “Overlay and Conservation Districts,” of Article VI, “Zoning Regulations,” of Chapter 51A, “Dallas Development Code: Ordinance No. 19455, as amended,” of the Dallas City Code is
