EVIDENCEATTHEHEARING:
TheappellantwaspresentalongwithhislegalcounselMr.StephenMoreau.Thehearingwasrecorded.TherewasnewwrittenevidencemarkedasExhibits14and15asweilasalengthylegalsubmission.Theclaimantstatedasfollows:-theinfanttwinchildrenLucieandAthenawerebornprematureandunderweight,requiringconstantcareattention,thatwouldoverwhelmoneparentalone.-duetoserioushealthcomplicationsofthemotherduringthepregnancy,therewasspecialmedicalmeasurestakentoassistthemother,butinanyevent,themotherandtheclairnantwereexhaustedbythepregnancycomplications.-TheclaimantwouldnotbereturningtoworkbeforeJanuary2010,duetotheparentalcarerequiredathome.

FINDINGSOFFACT,APPLICATIONOFLAW:
TheBoardfindstherelevantfactsasfollows:-Duringthepregnancy,themotherhadserioushealthproblems,andthechildrenwerebornprematurely.-Bothparentssufferedsleepdeprivation,fatigue,andoneroushouseholdobligationsdirectlyrelatedtothebirthoftwochildren.-claimantfoundthecaringoftwoinfants"incrediblydifficult",andoverwhelmingwithouttheassistanceoftheotherparent.Duetothedelicatenatureofthehealthofthechildrenafterbirth,outsidehelpwasnotpossible.-TheclaimantdoesnotcontemplatereturningtoworkbeforeJanuary2010,becauseoftheonerousoverwhelmingobligationsassociatedwiththeneedsofcaringfortwoinfants.-BecausethemotherofLuciehasobtainedparentalbenefitsforthecareoftheotherchildAthenatheCommissiondeniedtheclaimantparentalbenefitsbythefatherforthecareoftheirchild,Lucie.
