This is a reprint of an legal article by New York University Professor Alexander S. Birkhold, in which he makes the case that the recently passed Measure B/"Safe Sex In The Adult Industry Act" ordinance in Los Angeles County, requiring the use of condoms and other means of "barrier protection" in pornography production, violates basic First Amendment rights of free expression through supression of the unique artistic and political expression of bareback sex. Although his article focuses more on bareback gay sex, the arguments could be very much as worthy in defending "straight" heterosexual bareback sex as well.
