In this unpublished decision, the Board of Immigration Appeals (BIA) remanded for further consideration of the respondent’s request for a continuance because the immigration judge committed clear error in finding that a visa petition filed by a prior spouse was denied based on marriage fraud. The Board stated that while the Notice Of lntent to Deny ("NOID") questioned the validity of the underlying marriage, neither it nor the subsequent Field Office Director's decision denying the visa included a marriage fraud determination. The decision was written by Member Charles Adkins-Blanch and joined by Member Sharon Hoffman and by Member Elise Manuel.
