Protection of Marriage (“Coalition”) notes that:

On January 21, 2014 (the day the appellees filed their Answering Briefs in this case), a panel of this court issued an opinion in
SmithKline Beecham Corp. v. Abbott Laboratories
, --- F.3d ---, 2014 WL 211807 (9th Cir. 2014)
(“Opinion”), saying that claims of sexual orientation disc
rimination were
subject to “heightened scrutiny” rather than to rational basis review, as
 previously held in
 High Tech Gays v. Defense Industrial Security Clearance Office
, 895 F.2d 563, 574 (9th Cir.1990), and
 Philips v. Perry
, 106 F.3d 1420, 1425 (9th Cir.1997). 2.
 
The Opinion does not affect the central demonstration
of the Coalition’s
Answering Brief 
 — 
that the man-woman meaning of marriage now protected  by Nevada law can withstand any constitutional challenge, regardless of the level of judicial scrutiny applied. 3.
 
The Opinion remains open to both en banc review by this Court and review  by the United States Supreme Court. 4.
 
The Opinion’s “heightened scrutiny” in its source, nature, and application is
clearly different from any of the three levels of scrutiny identified, articulated, and applied by the United States Supreme Court: rational basis
