McAleerwasassignedtothenumbertwoflightattendantposition,whichrequiredhimtogreetpassengersastheyenteredtheaircraft.TheaircraftwasaBoeing737-300(737)thathadaseatingcapacityof126passengersincoachandeightpassengersinfirstclass.
Mr.
McAleerrelatedthatearlyintheboardingprocessaMiddleEasternmale(unknownmale)walkeddownthejet-way,orpassagewaytotheaircraftanddisplayedtoMr.McAleera"jumpseat"pass.Ajumpseatpassisprintedonregularticketstock.Thisdocument,whichisissuedbyagateagentforUA,impliesthatthepassengerisalicensedpilotofaUnitedStatesdomesticairline,andallowstheholdertositinthejumpseatinthecockpitoftheaircraft.TheU

gateagentshouldhavebeenshownvalididentificationfromadomesticairline,alongwithaFederalAviationAdministration(FAA)pilot'slicense,bytheunknownmale.Theunknownmalewasnotdressedinapilot'suniform,butdressedincasualclothes.Mr.McAleerrecallsthatthe.unknownmalewasdressedinaplumcoloredshirtandamatchingtie.TheunknownmalewascarryingalargeSamsonitebrandsuitcase,whichheleftoutonthejet-wayasheenteredtheaircraft.TheunknownmalewalkedbyMr.McAleerandenteredthecockpitofthe737,andwasobservedbyMr.McAleertalkingtothecaptain(pilot)andthefirstofficer(co-pilot).Afterafewmoments,theunknownmalesteppedoutofthecockpitandwalkedbackoutthedoorofthe737andstoodonthejet-wayontherightsideofthepassengerdoor.TheunknownmalesaidnothingtoMr.McAleer,butpickeduphissuitcaseandre-enteredthe737andtookaseatinrow14ontheaisleofthecoachcabinofthe737.Mr.McAleerthenspoketothenumberoneflightattendant.
2Thislady,whosenameMr.McAleerisunabletorecall,wasstandinginthegalleyofthefirstclasscabin.Mr.McAleersaidtoher,"isthisguyaterroristorsomething?"Mr.McAleerthenwenttothecockpitandaskedthecaptainwhatwasthestatus
of
theunknownmale.ThecaptaintoldMr.McAleerthat,"he'snot'jumpseating,'hedoesn'thavetheproper'ID.'Hetoldmethathehasacompanionpass.Hewillbeflying
as
aregularcustomer
in
coach."Mr.McAleerthenreturnedtothefirstclasscabinandtoldthenumberoneflightattendantwhathadbeenrelatedtohimbythecaptain.Mr.McAleerexplainedthatacompanionpassisabenefitforemployeesthatallowthemtopurchaseaticketfor10%ofthefacevalueforafriend,ora"companion."Theemployeedoesnothavetoaccompanythepassengerontheflight.Mr.McAleer'sassignedpositionduringtheflightwasthecoachclassgalleyintherearofthe737.Afteraperiodoftimetheunknownmalewalkedtotherearofthe737towaittousethelavatory.Whilewaiting,hespokewithMr.McAleer.

McAleeraskedtheunknownmalebywhichairlinehewasemployed.TheunknownmalerepliedthathewasemployedbyCOMAIR,aregionalairlinethatoperatestheDeltaAirlineexpressflights.Theunknownmalestated

clear,butaccentedEnglish,thathe,"hadjustquittoday'tostart'abusinesscharterairlineinBoston."Mr.
McAleer
remarkedthattheunknownmaleshouldhaveknownthathewasnoteligibletoflyinthejumpseatonadomesticairline,asapilot,ifhewasnotemployedbyanairline.Mr.McAleerthenaskedtheunknownmalehowlonghehadbeenemployedbyCOMAIR.TheunknownmalerepliedthathehadbeenwithCOMAIRfortwoandonehalfyears.Mr.McAleerstatedtotheunknownmalethatafriendofhis,MarkPajak,wasapilotforCOMAIR,andaskediftheunknownmaleknewPajak.TheunknownmalestatedthathedidnotknowPajak,statingthatheflewapropaircraftknowna"BeechBarron."Mr.McAleerfoundhardtobelievethatthisindividualdidnotknowPajak,becauseofthesizeofCOMAIR.Mr.McAleerthenaskedtheunknownmalewhattypeofaircrafthewouldbeflyingforthechartercompany.TheunknownmalestatedthathewouldbeflyingaGulfstreamjetandaFalconjet.Mr.McAleernotedthattheunknownmaledidnotseemtoknowenoughaboutflightoperationstohavebeenaregularlyemployedpilot.Mr.McAleerhasaprivatepilot'slicense.TheunknownmalethenaskedMr.McAleerabouttheoperationofthe737'sintercomsystem.Theunknownmalethenreturnedtohisseatwithoutusingthelavatory.Whenthe737landedinBoston,MA,Mr.McAleer
attemptedtotalktothecaptainand

officerabouttheunknownmale,buttheyhad
alreadylefttheaircraft.Mr.McAleerdoesnotknowtheirnames,andneverflewwitheitherpilotagain.Mr.McAleerwasinLondon,UnitedKingdomononaflight.HereturnedtotheUnitedStateson09113/2001.WhenhearrivedinChicago,ILheheard'fromotherflightattendantsaboutaMiddleEasternmalewhoattemptedtoenteracockpitonanotherflightdressedinapilot'suniform,withFAAidentification.Mr.McAleerthenrealizedthattheunknownmaleonFlight514neverwentbacktothegateagenttoobtainacompanionpass,butwasmostprobablyastowawayandnotapilot.
