Theevent'sFacebookpagereads: Weareastatewidenetworkof50+familiesaffectedbypolicebrutality,joiningwithlabor, educators,lawyers,studentsandcommunityorganizationstouniteCalifornianstoaddress theepidemicofpolicebrutality&killercops. Thepagealsolistsdozensofattendingcoalitionsformedbythefamilies,eachonebearing thenameoftheirslainlovedone. Therallywasstagedonthestepsofthecapitolbuildingwithfamiliesandorganizations lininguponeithersideofthemall.Mostdisplayedbannersandpicturesoftheirlovesone andtableswerefilledwithbuttonsandliterature.Inonecornerofthemallstoodascale replicaofPelicanBaystateprisonsinfamoussecurityhousingunitorSHU(pronounced shoe).CurrentlythousandsofCaliforniaprisonersspend22.5hoursisolatedinan8by 10footwindowlesscellwithaconcreteslabforabed,atoilet,aconcretestoolandasmall shelf. MycousinErnestDuenezJr.wasmurderedonJune8,2011,byJohnMoodyofthe MantecaPoliceDepartment.Andsincethatdaymyfamilyhasfoughteverysingledaytotry togetjustice,eventorganizerandcochairChristinaArechigatoldthecrowdinher openingremarks.Shetalkedabouttheneedtodemandrandomdrugtestingwhenan officerisinvolvedinanincidentsuchascaraccidents,shootingsorkillings. ManywhospokeattheeventdemandedachangetothepoliceofficerBillofRights,saying

officersaccusedofcrimesinvoketheBillofRightstoescapepublicaccountability.The policeofficers'BillofRightshasgottogo!saidCephusUncleBobbyJohnson,uncleof OscarGrant,whowaskilledbyBayAreaRapidTransitpoliceofficerJohannesMehserle inOaklandin2009. RonThomas,fatherofKellyThomas,whowasbeatentodeathbysixFullertonpolice officersonJuly5,2011,talkedaboutcontinuinghisfightforjusticeforhisson.Hisson's killingwasrecordedbydigitalaudiorecorderstheofficersworeaswellasnearbycity surveillancevideocameras.SoforthefirsttimeinOrangeCountyshistoryonduty policeofficershavenotonlybeenchargedwithmurder,theyrenowgoingtotrialandit startsnextmonth. HeattributedtheremarkablefeattothetenacityofKellysArmy,agroupofactivistsand organizerswhoralliedinthestreetsofFullertononbehalfofKelly.Twochiefsofpolice,a mayor,twocitycouncilmembers,acaptainallgone.Heconcluded,Noneofitcouldhave beendonewithoutthepeople. Themorningrallyincludedmorefamilymemberstellingtheirstories,speakersand entertainers,someofwhosang,rappedorrecitedpoetryaboutpolicebrutalityandthe needtofightback. JeralynnBlueford,motherofAlanBlueford,killedbyOaklandpoliceofficerMiguelMasso onMay6oflastyear,riledthecrowdupandpreparedthemtomarchthroughthestreetsof thestatecapital.Youcameheretomarch.Youcameheretohearusspeak.Nobody wantstomarcharoundallsadanddraggingaround.Youbettergetsomepepinyour step!Thecrowdroareditsapproval.Theydontcareaboutmykids,theydontcareabout yourkids.Buttheydocarewhenweallcometogetherandtakeastand.Allpowertothe people! Andwiththat,hundredsofpeoplesteppedintothestreetsofSacramentochantingNo justice,nopeace!andThewholesystemisguilty!Thespiritedmarchersstoppedand ralliedinfrontoftheofficeofstateAttorneyGeneralKamalaHarris.Theycarriedasmall blackcoffintothedoorsofthebuilding,andeachfamilywasinvitedupandgivenaroseto placeinthecoffinasasymboloftheirfallenlovedones.Whenarosewasplacedandthe nameofapolicebrutalityvictimwasread,marchersrespondedwithJustice!eachtime. Marchersthencontinuedbacktothecapitalwheremorefamiliescontinuedtotelltheir stories.Thedayconcludedwithorganizersurgingpeopletocontinuethefightforjusticein theirowncities.

RobertBobbyHenning,accordingtohismotherElizabethHenningAdam,waslikethe goldenchildgrowingup,justthemostperfectkid.Veryactiveinsportshewasa skateboarder.HelivedupinTahoeandhewasacompetitivesnowboarder.Hereallyhad apassionforthat. OnTuesday,February21st2012,BobbywastravelingfromhisparentshomeinAuburn throughtheLosAngelesareaonhiswaytoseehis2yearolddaughterinOklahomawhen hiscarbrokedown.Bobbydevelopedmentalhealthissuesinhisyouthandmayhavehad apsychoticbreakwhenhiscarbrokedownaccordingtoElizabeth.Somehowhewound upmilesawayfromhiscarinthecityofParamount,justeastofCompton. AnolderLatinomansawBobbylyinginthestreetnearachurchwithwithoutashirt,one shoemissingandtalkingtohimself.ThemanbecameconcernedforBobbyandcalled 911.Whenanofficerarrivedheradioedforbackupandinmoments3or4morepolice carsshowedup.TheofficersformedahalfcirclearoundBobbyandtwoofthemwentover toBobbyandpickedhimupbyhisarms.Andthen,inaninstantthewitnesssawathird officerapproachandthenheheardshots,buthisvisionwasblockedbytheotherofficers standinginthesemicircle.LateritwasrevealedthatofficershadshotBobbyinthechest. OfficerslaterclaimedthatBobbygrabbedanofficersgun,thoughnoneofBobbysDNA wasfoundonthegun.TheeyewitnesssaysthoughBobbywasactingstrange,hewasnot actingaggressivelytowardstheofficers.AftershootingBobby,officersdraghimovernear thegutterthenhandcuffandsearchhim.Officersdonotadministeranymedicalaidto Bobbyandhebleedstodeathinthestreet. 1. Wheninpublicspaceswhereyouarelawfullypresentyouhavetherightto photographanythingthatisinplainview. 2. Whenyouareonprivateproperty,thepropertyownermaysetrulesabout thetakingofphotographs. 3. Policeofficersmaynotgenerallyconfiscateordemandtoviewyour photographsorvideowithoutawarrant. 4. Policemaynotdeleteyourphotographsorvideounderanycircumstances. 5. Policeofficersmaylegitimatelyordercitizenstoceaseactivitiesthatare trulyinterferingwithlegitimatelawenforcement. 6. Notethattherighttophotographdoesnotgiveyouarighttobreakany otherlaws. Ifyouarestoppedordetainedfortakingphotographs: Alwaysremainpoliteandneverphysicallyresistapoliceofficer. KillercopBozarthhasalongtrailofdeadbodiesbehindhim.Mostcopsrarelydrawtheir gunsintheirentirecareers,howevertodateBozarthhaskillednolessthanfivepeople. Earlyinhiscareer,heshotasuspectwhoallegedlyhadaknife.Accordingtothepolice, theallegedsuspectlungedatBozarth,acommonruseusedbylawenforcement.Forhis troubles,theunnamedmanreceived8bulletsfromBozarthandanotherofficer. BozarthsnextvictimwasRobertJennings,age35killedonJuly10th1993.Bozarthagain saidJenningslungedathim. Killno.3happenedonJan.17,1998whenBozarthkilled17yearoldMartinSantosCastro Jr.byshootinghim4times,twiceintheback.HeclaimedCastrotriedtoshoothim. Victimno.4isReneLopezVizzuettkilledonFeb.12th2001.BozarthagainclaimedRene hadagunthatturnedouttobeatoy.However,witnessestotheshootingtoldreportersthat Renehadnoguninhishandwhenhewaskilled. BozarthsfifthknownvictimisRicardoMoralesCarbajal,24,onJune25th2005.Bozarth killedRicardoclaiminghewasholdingsomethinginhishandasheexitedhiscar.They claimedagunwasfoundontheseatstillinsidethecar. AllofBozarthskillingshavebeendeemedjustified. BozarthismemberofareligiouslawenforcementgroupnamedtheChristianLaw EnforcementFellowshipHeuseshisbeliefinreligiontojustifyhisviolentbehaviortowards thecitizensofSanDiego.Inparticular,heusesRoman13:verses1,3and4whichread: Everyonemustsubmithimselftogoverningauthorities,forthereisnoauthorityexceptthat whichGodhasestablished.Forrulersholdnoterrorforthosewhodoright,butforthose whodowrong.Butifyoudowrong,beafraid,forhedoesnotbeartheswordfornothing. HeisGodsservant,anagentofwrathtobringpunishmentonthewrongdoer.Bozarth saysthesewordsofscripturegivehimgreatcomfort.Accordingtohim,thesewords unambiguouslymeantheChristian(sic)cophasbeengiventherightfromGodtouse deadlyforce. Tofurtherrationalizehisbrutalityandassuagehisguilt,Bozarthalsodecidedtoalterthe commandmentThoushallnotkilltoThoushallnotmurder.

GANGINJUNCTIONS
Whatisa"GangInjunction?"
Ganginjunctionsarecivilcourtordersthatattempttoaddresscrimebyusingalowerlegal

standardthanrequiredbythecriminaljusticesystem,resultinginseriouscivilliberties violations.Lawenforcementusethemasatooltolabelpeoplegangmembersandrestrict theiractivitiesinadefinedarea.Ganginjunctionsmakeotherwiselegal,everyday activitiessuchasridingthebuswithafriendorpickingaspouseupfromworklateat nightillegalforpeopletheytarget.AganginjunctionisobtainedbytheCityattorneyor Districtattorneywhoasksajudgetodeclarethataparticulargangisa"publicnuisance" andimposepermanentrestrictionsonthetargetedindividuals'dailylives.TheACLUof NorthernCaliforniahaslongopposedganginjunctionsasanineffectiveandinappropriate methodofaddressingsafetyconcerns.

What'satStake?
Ganginjunctionsraiseanumberofcivillibertiesconcerns,bothforspecific,targeted individuals,aswellasanycommunitymemberwholivesinorvisitsthedesignatedarea. Oneofthemosttroublingaspectsisthattheyoftengivepoliceoverlybroaddiscretionto labelpeoplegangmemberswithouthavingtopresentanyevidenceorevencharge someonewithacrime.Policearelefttorelyonthingslikewhatsomeonelookslike,where theylive,andwhotheyknow.Asaresult,thereisagreatpotentialforracialprofiling,witha particularimpactonyoungpeopleofcolor.Despitethedocumentedexistenceofwhite gangs,noCaliforniaganginjunctionhastargetedawhitegang.Peopletargetedbygang injunctionsarenotguaranteedtheirlegalrighttobenotifiedorgiventheopportunityto defendthemselvesincourtpriortobeingboundbyrestrictionsoftheinjunction,norare theyprovidedwithanattorney.Additionally,manyganginjunctionsdonotprovideaclear wayoutforpeoplewhoareeithermistakenlyidentifiedasgangmembersorforthosewho haveturnedtheirlivesaround.Thismeansthattheinjunctioncouldfollowthemtherestof theirlife,whichcanmakeitmoredifficulttoavoidgangactivity.

AretheyEffective?
Ganginjunctionsareanineffectivelawenforcementtoolthatdoesnotaddresstheroot problemsofcrimeandviolence.LosAngeleshasnumerousganginjunctionsmorethan anyothercity,yetlostmorethan10,000youthtogangviolenceinthelast20years.New Yorkisamajorcitywiththepotentialforseriousgangproblems,yetin2005LosAngeles hadmorethan11,000gangrelatedcrimes,whileNewYorkfaced520.Whathasbeen showntoworkatreducingviolenceandgangactivityisfundingsocialservices,suchas ganginterventionandpreventionprograms,providingjobsandjobtraining,andproviding bettereducationalopportunitiesforyoungpeople.

WhatCanYouDo?
Inmanyinstances,organizedoppositiontoganginjunctionsonlybeginsonceaproposed ganginjunctionhasbeenfiledincourt.However,theCaliforniaSupremeCourthasheld thatganginjunctionsareconstitutionaldespitewellfoundedconcernsabouttheviolation ofindividualrights.Accordingly,opposingaganginjunctionincourtatbestresultsin limitingthetermsandscopeoftheganginjunctionandhistoricallyhasnotpreventeda ganginjunctionfrombeingissued.Communitieshaveanessentialroleinorganizingin advanceofaproposedganginjunctionbeingfiledincourt.Activitiesopposinggang injunctionsmayinclude:Publiceducationregardingganginjunctions,includingwhatthey are,theproblemstheypose,andtheneedforrealsolutions.Politicaloppositiontargeting cityofficials,includingtheCityAttorney,theChiefofPolice,membersofCityCouncil,and theMayor.Politicalpressuretoadoptpreventionandinterventionsolutionsforacommunity tostopthecriminalizationofindividuals,whileprovidingrealservicesandsolutionsthat addresstherootcausesofcrimeandviolence.
