) NOTICE OF SUPPLEMENTAL AUTHORITY
The Attorney General of Virginia, on behalf of Defendant Janet M. Rainey, State Registrar of Vital Records, in her official capacity, hereby notifies the Court of a significant legal development relevant to this Court’s consideration of the pending motion for summary judgment (Doc. 44). Judge Arenda L. Wright Allen issued a decision on cross-motions for summary judgment in
 Bostic v. Rainey
, No. 2:13-cv-00395 (E.D. Va. Feb. 14, 2014)—a case that, like this one, involves the constitutionality of Virginia’s laws denying the right to marry to same-sex couples. For many of the same reasons submitted in the notice of change in legal position by the Attorney General (Doc. 110), Judge Wright Allen concluded that Virginia’s same-sex-marriage ban violates the Due Process and Equal Protection Clauses of the Fourteenth Amendment to the United States Constitution. A copy of the Memorandum Opinion and Order is attached. Among other things, Judge Wright Allen ruled that
