NEW DELHI: A spurt in false cases has earned Delhi notoriety as the country's 'rape capital', a court here observed while acquitting a 75-year-old man of the charge of sexually assaulting his maid. The court said things have come to such a pass after the Nirbhaya gang rape in December that the mere statement of a woman about rape is taken as gospel truth, the accused arrested and chargesheeted. "This led to an unprecedented surge in filing of false rape cases... It is these false cases which play havoc with the crime statistics, leading to the labeling of Delhi as a rape capital," additional sessions judge Virender Bhat said while acquitting Bhopal Sharma. The court observed that as acquittals in such cases are hardly ever reported, the falsely implicated persons lose their honour, dignity and status in society, and while these cannot be restored, "these victims" can be compensated so that they can start life afresh.

It also noted that "it is a matter of intense regret that even the frail, sick and aged persons are not spared the false allegation of rape". The prosecution claimed Sharma and his neighbour Anita became friends when they met in a hospital where his ailing wife was admitted. After Sharma's wife died, Anita arranged a maid for him. The woman, who is in her 30s, alleged that a few days after she started working for Sharma in July 2012, he raped her and then bought her silence with the promise of marriage. They remained in a sexual relationship, she claimed, till the time Sharma reneged on his promise. She lodged a police complaint on October 11, 2012. However, during the trial, the woman turned hostile and said she had leveled false allegations at the behest of Anita and another person, Kuldeep, to usurp Sharma's property. Expressing the need for courts to be empowered to award compensation to false rape case victims, the judge also lamented that the media turn a blind eye to acquittals in such cases. "Nobody bothers to see in how many cases the accused are convicted. The acquittal of an accused is not noticed at all and he continues to be labeled a 'rapist' even after his honorable acquittal." The judge also said that right from the day the accused was first produced before him, he had wondered, "How such a frail old man, who cannot even stand straight, would rape a young lady in her mid-30s, jhaving lot more strength than the accused".

False r@pe is not the same as 'unfounded'- I think you are confusing the twobut they are very different. I think what you are trying to say is that many of these cases do not have sufficient evidence for a charge to be prosecuted, but many times the police decide that a claim is false before investigating. David Lisak, PhD. is very informative about 'unfounded' claims. In addition, trauma may cause victims to forget certain things that lead to inconsistencies in the statement, but law enforcement must be aware of this, and not intimidate the victim, because being called a liar is unfair and most often inaccurate. In the U.S. reliable research suggests that only 2-6% of reported sexual assaults are 'unfounded', but this does not mean that they are false. If the victim has no bruises or did not fight back, it can be classified as 'unfounded', which does not mean that a r@pe did not take place. This article is not well-researched, coming from police reports that suppressed the victims' stories, not actual false claims. I hope that India can deal with the avalanche of women coming forward without the same suppression and labeling of victims as liars as in the U.S. R@pe victims are courageous to report these crimes and it is unjust to silence them when police have not investigated.

This shows justice still prevails in India. The judge is correct in stating that the media tends to keep quite on this acquittal. By the time this judgement comes, the reputation of the person is already tarnished. For this, the Court should announced details of the case to all the medias and make it a mandatory that these news should be published and make it known the to society at large. Not only that, the court should levy fine and asked the other party to came compensation to the person facing false charges and they should published apologies in the National Newspaper for the benefit of the that person. To certain extent , this will help improving that person;s reputation in the society

This may be a one off case but everyone knows that Delhi still deserves the crown that its men have earned for itself. The way men in Delhi stare at women and even try to grope them in public is shocking indeed. And many of these guys are well dressed and educated folks. Parents in Delhi need to teach their boys how to respect their women folk unless they want to become another Haryana with terribly skewed gender ratios and ill treatment of women

Unless it is forced r@pe where the r@pist uses force to do the heinous crime, arresting the accused just on the word of a woman is not right. It should be done only after a medical examination confirms the r@ and there is sufficient circumstantial evidence that the accused could be the perpetrator of crime. Also in case it is proved that it is a false charge the person who files false complaint intentionally to trap someone should be punished also.

Media has been trying desperately to convince us there is a r@pe epidemic when in reality, there is a false accusation epidemic like 498a. No media of no country is so desperate to call its citizens r@pists without evidence, unless enemies of that country are paying them well to do so There have been lots of false cases since Nirbhaya. Accidental touching in crowded buses is m@lestation, refusal to marry after s@x is r@pe, harsh words exchanged is m@lestation, looking at a woman in a mini skirt is voyeurism, staring at a woman is r@pe bid, multiple phone calls is harassment, sending multiple sms is stalking, consensual s@x between 17 year olds is r@pe. Everything is r@pe. Lucrative feminist industry received thousands of crores (of our tax payer money) in budget for anti male propaganda, is artificially hiking statistics and creating massive r@pe hysteria with help of well paid feminist media. This article should be main article of the day for full day if media has to still have any credibility.
