Incident: Death of Inmate Samuel See Location: Union Avenue Detention Center, 1 Union Avenue, New Haven, CT Date(s) of Incident: 11/23/13 - 11/24/13

BACKGROUND
On November 23, 2013 at approximately 9:10 p.m., Samuel See (See) arrived at the Union Avenue Detention Center (UADC) after being arrested by the New Haven Police Department (NHPD) and after being treated at Yale New Haven Hospital (YNHH) for injuries sustained during his arrest. See was processed by UADC Judicial Marshals and NHPD staff and placed into cell B-31 in the BBlock at 9:56:32 p.m. See remained in his cell until he was discovered, unresponsive on the top bunk, at 6:00:00 a.m. by Judicial Marshals. Despite resuscitation efforts by Judicial Marshals and emergency medical services, See was pronounced dead at UADC.

INTERVIEWS
Anthony Rilley, Supervising Judicial Marshal This investigator met with SJM Anthony Rilley (SJM Rilley) on December 13, 2013 at Judicial Marshal Services in Hartford. Ricardo Taddei, CSEA, Local 2001, was present as SJM Rilley's union representative. SJM Rilley expounded upon his incident report, # 32766, dated 11/24/13 (exhibit 1). SJM Rilley stated that on the date in question, he was the supervisor of 3' d shift and arrived for duty at 11:00 p.m. on 11/23/13. SJM Rilley stated that See had already been processed and was housed in cell B-31 upon his arrival. 1

SJM Rilley stated that See never spoke to him when he conducted his block tours and added that See never made any complaints, or asked for medical attention at any'point. SJM Rilley added that See acted "normally" while he was in his cell. SJM Rilley stated that See alternated between sitting and lying down, and from the bottom bunk to the top bunk throughout the evening. SJM Rilley stated that at no point in the evening did he hear See making any odd noises which would indicate that he was in distress. SJM Rilley stated that he was in his office "logging his tour" at 6:00 a.m. when JM Rivas came to inform him that there was a problem with See. SJM Rilley went to See's cell and found marshals removing See from the top bunk and placing him on the floor. SJM Rilley stated that See's skin appeared "pale" when the marshals checked See's vital signs, and began CPR. SJM Rilley stated that at some point, the Automated External Defibrillator (AED) was attached to See by JM Rivas. SJM Rilley added that American Medical Response EMS (AMR EMS) arrived a few minutes later, "after only a few cycles of CPR [performed by the marshals]." They were followed minutes later by the New Haven Fire Department Paramedic (NHFD Paramedic). SJM Rilley stated that while EMS was doing compressions, he was providing respirations to See using a bag valve mask device (BVM). SJM Rilley stated that the NHFD Paramedic advised them to stop CPR, "hooked up his monitor" and told them that there was nothing they could do for See. SJM Rilley added that he heard the NHFD Paramedic say that See was "asystole." 1 SJM Rilley stated that at this point, he went to the office to notify the Chief (Chief Judicial Marshal Jaime Lettieri) and Deputy Chief (Deputy Chief Judicial Marshal Jeannie Valente) of this incident. Shortly after, he was summoned to B-block because See's husband was distraught and did not want to leave the block. SJM Rilley advised him that as per procedure, he and the other inmates had to be relocated. Timothy Reilly, Lead Judicial Marshal This investigator met with Lead Judicial Marshal Timothy Reilly (LJM Reilly) on December 12, 2013 at Court Operations Adthinistration in Hartford. Maritsa St. Jacques, IBPO, Local 731, was present as LJM Reilly's union representative.

LJM Reilly expounded upon his incident report, # 32766, dated 11/24/13 (exhibit 2). LJM Reilly stated that on the date in question, he was the "Lead" on 3 rd shift and would have "been in at 2300 hours (11 p.m.)" on 11/23/13. LJM Reilly stated that See was already housed in cell B-31 upon his arrival for duty. UM Reilly stated that sometime between 11:00 p.m. and 12:00 a.m. he handed out food to the inmates and remembered giving See a sandwich and drink. LJM Reilly added that See may have said "thank you" to him. LJM Reilly stated that See acted "no different" than any other inmate, "was quiet," and at no time during LJM Reilly's shift, did See appear to be in distress, nor did he ask for medical assistance. LJM Reilly stated that See may have had an argument while in his cell, with his husband, identified by LJM Reilly as Sunder Ganglani (Ganglani), who was housed in cell B-46. LJM Reilly could not recall with any degree of certainty if one actually occurred. This investigator asked LJM Reilly if it was common for individuals who had been involved in domestic disputes, to be housed in the same cell block. LJM Reilly stated that efforts are made to keep inmates separate by placing them in cells so that they do not "have to pass each other" once they are processed. In See's case, he was placed in a cell at the end of B-block so that he would not have to walk in front of Ganglani's cell at any point. LJM Reilly stated that he conducted his block tour at 5:45 a.m. and had a "straight shot" view into See's cell as he entered B-block. LJM Reilly stated that See was on the top bunk with his feet facing toward the door. LJM Reilly did not notice anything out of the ordinary with See at that point. LJM Reilly stated that at approximately 6:00 a.m. he and Judicial Marshal Alberto Rivas (JM Rivas) were handing out meals to the inmates and LJM Reilly was conducting his bock tour. LJM Reilly stated that JM Rivas was standing in front of See's cell and called for him to come to the cell because See "didn't look right." At this point LJM Reilly stated that he noticed that See's right arm was hanging over the side of the top bunk at an odd angle. LJM Reilly said to JM Rivas "no, his arm doesn't look right at all." LJM Reilly described See's arm as being bent backward and it "almost looked contorted," "it wasn't normal." This investigator asked LJM Reilly if he recalled seeing See's arm as he described during his tour at 5:45 a.m. LJM Reilly stated "if I had seen that [See's arm], it would have triggered [concern]." He could not definitively recall if See's arm was in that position during his 5:45 a.m. tour.

LJM Reilly stated that JM Rivas moved See's foot in an effort to rouse him and received no response. LJM Reilly stated that at this point he reached through the cell bars and tapped his key on the underside of the top bunk because this "sometimes wakes people." There was still no response from See. LJM Reilly stated that he then observed See to see if his chest was rising and falling and seeing that it was not, he entered the cell. LJM Reilly stated that See's mouth and eyes were open. LJM Reilly added that his eyes were "glazed and glassy." LJM Reilly did not recall if See was discolored and stated that to the best of his recollection, there were "no signs of suicide" (i.e., strings on neck, choking, etc.). LJM Reilly told JM Rivas to call 911, get the AED, and the other marshals to assist with removing See from the cell. LJM Reilly stated that Judicial Marshal Christopher Dadio (JM Dadio) and Judicial Marshal Donald Abdul-Lateef (JM Abdul-Lateef) arrived and assisted him with removing See from the top bunk. LJM Reilly stated that See was "warm to the touch, and "limp" with "no rigor mortis." See was placed on the floor, his sweatshirt and shirt were removed and JM Dadio "immediately" began chest compressions. LJM Reilly could not recall if See's body was discolored once his clothing was removed. JM Abdul-Lateef set up his CPR mask and began administering respirations to See. LJM Reilly stated that JM Rivas arrived with the AED and attached the pads to See. The AED analyzed and advised "no shock." LJM Reilly stated that CPR resumed and continued until the AMR EMS crew arrived and took over CPR. LJM Reilly stated that shortly after AMR EMS arrival, the NHFD Paramedic arrived and advised AMR EMS to stop CPR so that he could "hook up his monitor" to See. LJM Reilly stated that the NHFD Paramedic connected his monitor and advised he and the other marshals that See was "asystole" and told them "there is nothing you guys can do for him." LJM Reilly stated that a marshal remained with See's body until its removal from UADC. Donald Abdul-Lateef, Judicial Marshal This investigator met with JM Abdul-Lateef on December 16, 2013 at Court Operations Administration in Hartford. Maritsa St. Jacques, IBPO, Local 731, was present as JM Abdul-Lateef s union representative. JM Abdul-Lateef expounded upon his incident report, # 32766, dated 11/24/13 (exhibit 3). JM Abdul-Lateef stated that on the date in question he was working an overtime shift and arrived at UADC on 11/23/13 at 11:00 p.m. JM Abdul-Lateef added that See was already housed in cell B-31 upon his arrival for duty.

SJM Abdul-Lateef was assigned to block tours and was "sharing" them with JM Dadio." He stated that he observed nothing out of the ordinary with See. JM Abdul-Lateef stated that at one point in the evening, See was sitting "Indian style" on the bottom bunk of his cell. See never indicated to JM Abdul-Lateef that he was in pain, needed medical attention, or wanted to make any telephone calls. JM Abdul-Lateef stated that he never heard any sounds of distress from See at all during the evening. JM Abdul-Lateef added that See remained "relatively quiet." JM Abdul-Lateef stated that he was sitting in the room behind intake when JM Rivas entered and said they needed help because an inmate was unresponsive. JM Abdul-Lateef ran to the cell (B-31), saw LJM Reilly in the cell, and entered with JM Dadio. JM Abdul-Lateef stated that See was on the top bunk, lying flat on his back and had "glossy, red, bloodshot eyes." JM Abdul-Lateef added that See's skin appeared pale and his right arm was hanging off the side of the bunk. JM Abdul-Lateef stated that he checked See for a pulse and shook him and got no response. JM Abdul-Lateef assisted LJM Reilly and JM Dadio in removing See from the top bunk, to the floor. JM Abdul-Lateef re-checked See's vitals, removed his shirt and he and the other marshals immediately began CPR. JM Abdul-Lateef stated that JM Rivas arrived with the AED and hooked the pads to See. He added that EMS arrived "maybe 15 to 20 minutes after" and took over CPR. JM Abdul-Lateef stated that the NHFD Paramedic arrived on scene, "hooked up [his] machine," and shortly after, declared See deceased. JM Abdul-Lateef stated that he spoke with See's husband in an attempt to calm him until all inmates could be relocated to another area. See's body was covered with a blanket and later removed by representatives from the Chief Medical Examiner's office. Christopher Dadio, Judicial Marshal This investigator met with. JM Dadio on December 12, 2013 at UADC in New Haven. Maritsa St. Jacques, IBPQ, Local 731, was present as JM Dadio's union representative. JM Dadio expounded upon his incident report, # 32766, dated 11/24/13 (exhibit 4). JM Dadio stated that on the date in question he was working an overtime shift and arrived at UADC on 11/23/13 at 11:00 p.m. JM Dadio stated that See was already housed in cell B-31 upon his arrival for duty. JM Dadio stated that See "seemed fine," "had no complaints," "did not seem altered at all," "was calm," and did not ask for medical attention at any point during his incarceration. JM Dadio stated that See asked him for a juice during

his first tour (approximately 11:30 p.m.) and that the juice was given to See by LJM Reilly. JM Dadio stated that during his 4:30 a.m. tour or 5:30 a.m. tour2 that See was seated "Indian style" on his top bunk and asked him for a drink. JM Dadio stated that the drink was not delivered until 6:00 a.m. when food was being distributed to all inmates. JM Dadio added "every time I did my tours he [See] was sitting on the bottom bunk," at "4:30 or 5:30 he was on the top bunk." JM Dadio stated that he was in the break room when he heard JM Rivas trying to rouse See. JM Dadio added that he looked at JM Abdul-Lateef and said "it doesn't sound good" and both proceeded to the cell block. JM Dadio stated that en route to the cell they passed JM Rivas who was heading toward the intake room. JM Dadio stated that when he arrived at See's cell, LJM Reilly was inside of the cell and he and JM Abdul-Lateef entered to help remove See from the top bunk. JM Dadio stated "I could already tell he was dead." JM Dadio described See as "still warm, very warm," and that he had "defecated himself." He added that See's face was "red," his eyes were open and "glazed" and his mouth was open. JM Dadio stated that See was lying on his back with his feet to the outside of the cell with his arms at his sides. JM Dadio stated that he began chest compressions as soon as See was placed on the floor. Once the AED arrived, the pads were attached to See; it analyzed and advised them to continue CPR. JM Dadio did one more cycle of compressions and was relieved by Judicial Marshal Michael Harrington (JM Harrington). JM Dadio stated that AMR EMS arrived and took over patient care. JM Dadio stated that shortly after, the NHFD Paramedic arrived, hooked his monitor up to See, and advised them to stop CPR as there was "nothing more that could be done." JM Dadio stated that at no time during his shift did See ask for medical attention. JM Dadio added that he never heard See moaning, or making noises as if he were in distress. Michael Harrington, Judicial Marshal This investigator met with Judicial Marshal Michael Harrington (JM Harrington) on December 16, 2013 at Court Operations Administration in Hartford. representative. JM Harrington expounded upon his incident report, # 32766, dated 11/24/13 (exhibit 5). JM Harrington stated that on the date in question he was working 3 rd shift and arrived at 11 p.m. on 11/23/13 and worked until 7:30 a.m. on 11/24/12. JM Harrington stated that See was already housed in cell B-31 upon his arrival for duty. In reviewing the surveillance video from UADC, B-block and M-block (exhibits 8 & 9) on 11/24/13, this investigator observed JM Harrington stopping outside of See's cell at 4:13:39 a.m. and having a conversation with him. JM Harrington proceeded to depart the area at 4:14:00 a.m. He returned to See's cell at 4:15:51 a.m. and appeared to have another conversation with See until 4:16:37 a.m. This investigator asked JM Harrington what these conversations with See pertained to. JM Harrington stated that See had called him over to his cell and asked him if his (See's) sister had called. JM Harrington stated that he told See he would "look into it." JM Harrington stated that he left See to ask SJM Rilley if See's sister had called UADC. JM Harrington stated that SJM Rilley told him that See's mother had called and said "something about his medication" and that she was going to bring it to See. JM Harrington stated that he returned to See's cell to give him this information. JM Harrington stated that after telling See that his mother was bringing his medication, See responded by saying "what, is she going to perform a miracle?" JM Harrington did not know what See meant by this comment at the time and did not ask See what it meant until later when he learned that See's mother and father lived on the West Coast. JM Harrington added that when he was speaking with See "he didn't look well." He had a shaved head, and sunken cheeks, he looked like a "concentration camp person." JM Harrington stated that See "never gave the indication that he was sick other than the way he looked," he never asked JM Harrington for medical attention and he never elaborated as to what the medications were for. JM Harrington stated that he "heard that See was asking 2nd shift for his medication." JM Harrington added that during this conversation with See, "he was very polite, unlike anyone else" and because of this, JM Harrington would have "gone out of his way" to help him. While reviewing the surveillance video from UADC, B-block (exhibit 8), this investigator observed JM Harrington, while conducting a block tour at 5:09:44 a.m., look into See's cell, proceed past, and then turn back to See's cell. JM Harrington looked into See's cell again then returned to his tour. This investigator asked JM Harrington why he returned to See's cell to look into it again after his initial pass. JM Harrington stated "maybe I didn't look and went back to check." This investigator asked JM Harrington what he had observed. He

stated that See was "just laying on the top bunk like he was sleeping." He added that his right arm was "possibly hanging" off the bunk or "on the edge" of the bunk, "nothing seemed odd." JM Harrington stated that See was not making any odd noises, nor was he coughing or vomiting. JM Harrington stated that he was in the break room at 6:00 a.m. and "heard raised voices but not exact words" and "got up to head there." He stated that JM Rivas came back to get them. JM Harrington stated that when he arrived at See's cell LJM Reilly was inside and said "we gotta get this guy out of here." JM Harrington stated that See was still on the top bunk and LJM Reilly, JM Rivas, and one other marshal put him on the floor and started CPR. JM Harrington remembered asking if anyone had checked See's vitals and JM Rivas arriving with the AED. JM Harrington stated that they had a difficult time removing See's shirt because "there were no scissors." JM Harrington stated that EMS arrived about "4 to 5 minutes after" the marshals had started CPR. He added that "the male EMT" took over compressions. Shortly after that, JM Harrington stated that the NHFD Paramedic arrived, cleared everyone from around See "to monitor" and then told them something to the effect of "he's gone." JM Harrington stated that they covered See's body with a sheet because See's husband was "freaking out." JM Harrington stated that he remained in the area until LJM Reilly told him "there's nothing else we can do for him." Alberto Rivas, Judicial Marshal This investigator met with Judicial Marshal Alberto Rivas (JM Rivas) on December 12, 2013 at UADC in New Haven. Maritsa St. Jacques, IBPO, Local 731, was present as JM Rivas' union representative. JM Rivas expounded upon his incident report, # 32766, dated 11/24/13 (exhibit 6). JM Rivas stated that on the date in question, he was working an overtime shift and arrived at UADC on 11/23/13 at 11:00 p.m. JM Rivas stated that See was already housed in cell B-31 upon his arrival for duty. JM Rivas was assigned to intake as well as conducting block tours every "quarter or (e.g., 11:45, 12:45, 1:45). JM Rivas stated that the times he saw See, he "looked and acted normal," and he "had some bruises on his face." JM Rivas added that See never told him he wasn't feeling well, nor did he request medical attention. JM Rivas did not recall See's location within his cell (i.e., top bunk, bottom bunk) when he conducted his tour at 4:42 a.m., his last before finding See unresponsive

at 6:00 a.m. JM Rivas stated that the block "was quiet" and he did not see anything out of the ordinary. JM Rivas stated that he looks at inmates to "make sure their chest is moving." JM Rivas stated that at 6:00 a.m., he assisted LJM Reilly with the distribution of prisoner meals. When he arrived at See's cell and announced that food was available, See did not respond. JM Rivas stated that he shook See's foot through the cell and got no response. JM Rivas shook See's foot a second time, and when he still received no response he said to LJM Reilly that something was wrong and they needed to enter the cell. JM Rivas stated that he and LJM Reilly entered See's cell, LJM Reilly shook See, who remained unresponsive. JM Rivas stated that See "looked to be sleeping" when they entered the cell. JM Rivas added that See's right arm was hanging over the side of the top bunk but "not in any odd way." JM Rivas stated that he ran "to the front [intake]" and told SJM Rilley that "B-31 was unresponsive," and retrieved the AED. JM Rivas stated that upon his return, he attached the AED to See's chest, and allowed it to analyze See. The AED advised staff to continue CPR which they did. JM Rivas had no further information.

Gerald Williams, Judicial Marshal This investigator met with Judicial Marshal Gerald Williams (JM Williams) on December 12, 2013 at UADC in New Haven. Maritsa St. Jacques, IBPO, Local 731, was present as JM Williams' union representative. JM Williams expounded upon his incident report, # 32766, dated 11/24/13 (exhibit 7). JM Williams stated that on the date in question he arrived at UADC at 11:00 p.m. on 11/23/13 and was assigned to the control desk. JM Williams stated that he believed See was already . in his cell when he arrived for duty and that he had been brought in around 9:00 p.m. that evening. JM Williams stated that he did not perform any block tours prior to See's death but remembered doing a tour after See was covered with a blanket and EMS had left the scene. JM Williams stated that when See was discovered unresponsive, he was told to stay "at control" and handle those duties. JM Williams stated that he never saw See and did not assist with his removal from the cell or with CPR. JM Williams stated that he "was recording everyone coming into the block." JM Williams stated that he was at the control desk when See's body was removed by the Medical Examiner. JM Williams stated that he did not recall hearing anything from See that was "out of the ordinary for the environment."

The following interviews were necessitated by JM Harrington's statements regarding the conversation he had with See at 4:13 a.m. in which See asked JM Harrington if his sister had called for him, JM Harrington stating that he "heard that See was asking 2" shift for his medication," and JM Harrington discovering that SJM Rilley had spoken to See's mother regarding See's medication. Anthony Rilley, Supervising Judicial Marshal This investigator met with SJM Rilley for a second time on December 18, 2013 at Judicial Marshal Services in Hartford after learning of his conversation with See's mother. Ricardo Taddei, CSEA, Local 2001, was present as SJM Rilley's union representative. SJM Rilley stated that he did not recall any Marshals asking him to contact See's family nor was he asked for medication by See or Judicial Marshals. SJM Rilley stated that JM Harrington came to him and asked if See's sister had called. SJM Rilley advised JM Harrington that she had not, but advised him that See's mother had called and was "concerned with medication." SJM Rilley' stated that he told See's mother that she was free to bring it to him, at which time she advised SJM Rilley that she was in California. SJM Rilley stated that he advised See's mother that anyone could bring medication to him. SJM Rilley stated that she asked him if a nurse could "bring it down" in the morning. SJM Rilley told See's mother that a nurse could bring the medication in the morning and informed her that he would only be there until 7 a.m. and if the nurse arrived later, there would be another supervisor on shift. SJM Rilley stated that See's mother said something to the effect of "I'll see what I can do" but gave no indication as to when, or if, someone would be coming to UADC with medication for See. SJM Rilley relayed this information to JM Harrington who then advised See. Edward Saccu, Judicial Marshal This investigator met with Judicial Marshal Edward Saccu (JM Saccu) on December 18, 2013 at UADC in New Haven. Maritsa St. Jacques, IBPO, Local 731, was present as JM Saccu's union representative. JM Saccu stated that on the date in question he was working 2 nd shift overtime until 10:00 p.m. (11/23/13). JM Saccu stated that See entered UADC through the back door to intake, not the sally port door where inmates normally arrive. JM Saccu stated that See was conscious and standing and was not screaming, yelling or making a scene. JM Saccu stated that in the short period of time he was around See, he never said

anything about medication and "looked like a healthy male \." JM Saccu had no further contact with See. Jennifer Pedrick, Judicial Marshal This investigator met with Judicial Marshal Jennifer Pedrick (JM Pedrick) on December 18, 2013 at UADC in New Haven. Maritsa St. Jacques, IBPO, Local 731, was present as JM Pedrick's union representative. JM Pedrick stated that on the date in question she was working 2nd shift until 11:30 p.m. (11/23/13). She stated that See arrived at UADC with stitches in his head and noted that he had "medical papers" and had come from the hospital. JM Pedrick stated that See "seemed normal," was cooperative, and she could not recall him asking for medication or for her to contact any family members. JM Pedrick had no further contact with See. Shannon Sprano, Supervising Judicial Marshal This investigator met with Supervising Judicial Marshal Shannon Sprano (SJM Sprano) on December 18, 2013 at UADC in New Haven. Joseph Tomasello, CSEA, Local 2001 was present as SJM Sprano's union representative. SJM Sprano stated that on the date in question she was the 2 nd shift supervisor on 11/23/13. She stated that when See arrived at UADC, she was in her office. SJM Sprano recalled a Judicial Marshal from intake telling her that See had a cut on his head. SJM Sprano stated that she asked if See had "medical papers" or any physical complaints. The Marshal advised SJM Sprano that See had medical papers and had no medical complaints. Having no complaints and medical clearance, See was processed at intake. SJM Sprano stated that See never requested that she contact his sister or any other family members and he never raised the issue of medication with her. Andre Wright, Judicial Marshal This investigator met with Judicial Marshal Andre Wright (JM Wright) on December 18, 2013 at UADC in New Haven. Maritsa St. Jacques, IBPO, Local 731, was present as JM Wright's union representative. JM Wright stated that on the date in question he was working 2 nd shift until 11:00 p.m. or 11:30 p.m. (11/23/13). JM Wright remembered that when See arrived at UADC, a marshal whom he could not recall, asked SJM Sprano to come look at See's stitches. JM Wright stated that See did not ask him for medication, nor did he hear See ask any other marshals for medication.

JM Wright remembered See speaking with NHPD about posting bond with a credit card. JM Wright stated that he told See he could have a family member speak with a bondsman. That was the only conversation JM Wright had with See and the only mention of contacting a family member. JM Wright added that See was "as polite as can be," "I wish all of them acted that way." Michael Durno, Lead Judicial Marshal This investigator spoke with Lead Judicial Marshal Michael Durno (LJM Durno) via telephone on December 19, 2013. Maritsa St. Jacques, IBPO, Local 731 was present via telephone as LJM Dumo's union representative. LJM Durno stated that on the date in question he was working 2nd shift until 11:30 p.m. (11/23/13). LJM Durno stated that See's only medical issue upon his arrival at UADC was the stitches. LJM Durno added that See had "clearance paperwork [from the hospital]" and was in "pretty good spirits for what was happening with him." LJM Durno stated that See did not ask him or hear him ask any other marshal to obtain medication for him. LJM Durno stated that See did not ask for any medical attention and did not ask him if his sister had called. LJM Durno stated that none of See's family members called for him while LJM Durno was on duty. Roberto Ortiz, Judicial Marshal This investigator spoke with Judicial Marshal Roberto Ortiz (JM Ortiz) via telephone on January 9, 2014. Maritsa St. Jacques, IBPO, Local 731 was present via telephone, as JM Ortiz' union representative. JM Ortiz stated that on the date in question he was working 2nd shift until 11:30 p.m. (11/23/13). JM Ortiz dealt with See while he was at intake. JM Ortiz stated that he could not tell if See was under the influence of drugs or alcohol and added "all he was talking about was how he screwed up with the police officers." JM Ortiz stated that See was cooperative. JM Ortiz stated that See did not ask him for medication, he just said that "he was hungry." JM Ortiz stated that See did not ask him to contact family members; he was "just wondering where was his partner." JM Ortiz added that his only other interaction with See was during a tour where See asked for something to eat. JM Melendez stated that he was "on intake" when See arrived at UADC. This investigator asked JM Melendez if See appeared to be under the influence of drugs or alcohol. JM Melendez stated "not at all," he "seemed very calm." JM Melendez stated that See did not mention medication, ask about medication, or ask marshals to contact family members. FINDINGS
Samuel See was arrested by NHPD on Saturday 11/23/13. Samuel See suffered an injury during said arrest which required medical attention. See was brought to Yale New Haven Hospital by NHPD. Upon being evaluated and treated for his injury, See received medical clearance, and was transported by NHPD to UADC. The Judicial Marshal's Office Medical Consultant's Report dated 11/23/13 that accompanied See to UADC, signed by Consulting Physician "Hirschman PA" (exhibit 22) noted in the section Medication with Directions: "sutures #s indecipherable eyebrow." See was released from YNHH on 11/23/13 at 8 pm. YNHH Emergency Department paperwork for See (exhibit 23) that accompanied him to UADC indicated that See was seen by Vivek Parwani, MD and Allison Hirschman, PA on 11/23/13 with the diagnosis of an "eyebrow laceration." See was not prescribed any medication. Upon See's arrival at UADC intake at 9:10:44, surveillance video showed that See was calm, following the instructions of Judicial Marshals and was processed without incident. This processing included a thorough search of

his clothing, shoes, and person, which included having him open his mouth for a visual inspection. Judicial Marshal Services Prisoner Behavior Report (JD-MS-5 Rev. 4-12) for Samuel See dated 11/23/13, completed by LJM Durno (exhibit 24), had "NO" checked in response to all questions including: "Does the prisoner appear to be under the influence of alcohol and/or drugs?" o SJM Rilley added the following handwritten note to question six: "At approx. 12 (indecipherable) mother called saying Mr. See has medical and psych issues that he takes medication for. Told her (SJM Rilley) would send Mr. See to the hospital should there be an incident involving illness SJM Rilley 12:00 pm" See was placed into cell B-31 located in the B-block at 9:56:32 PM. by Judicial Marshal staff where he remained until discovered unresponsive at 6:00:00 a.m. There is no evidence to support that while at UADC, See acted in an irrational manner, or displayed the actions of someone who was impaired by drugs or alcohol. See was described by several Judicial Marshals as being "very polite" and cooperative. There is no evidence to support that See indicated to Judicial Marshals that he was in need of medical attention. JM Harrington's statement that he "heard that See was asking 2"d shift for his medication" was not substantiated. Archived surveillance video footage confirmed that Judicial Marshals conducted and documented all cell block tours as per Judicial Marshal Policy and Procedure 214-06 Cellblock Tours. The initials on the document provided as exhibit 14 is consistent with the video footage. Video footage confirmed the statements made by Judicial Marshals that resuscitation efforts began immediately upon discovering that See was unresponsive and removing him from his cell. CONCLUSION
Based on the information gathered during this investigation, it can be concluded that Judicial Marshal Services staff working at Union Avenue Detention Center on November 23, 2013 and November 24, 2013, performed their duties as prescribed by The Judicial Branch Administrative Policies and Procedures Manual and The Judicial Marshal Services Policy and Procedure Manual. As such, there is no evidence to support the fact Samuel See's death at Union Avenue Detention Center on November 24, 2013 was the result of negligence or inattention by Judicial Marshal Services staff.

SURVEILLANCE VIDEO TIMELINE Saturday November 23, 2013 to Sunday November 24, 2013
This investigator's review of surveillance video footage of UADC B-block, made note of whether or not Judicial Marshals made visual contact with See's cell while conducting block tours. In some instances it could not be determined from the video footage whether or not visual contact was made with See's cell. Therefore, this investigator visited UADC and re-traced the route that marshals took during their block tours on the dates in question. This investigator was able to determine that marshals had a clear view into See's cell (exhibits 10 & 11) approaching B-block from the Holding Tank/M-block hallway before coming into view of the surveillance camera for B-block. As such, it can be presumed that visual contact was made by marshals into See's cell, during all block tours.

6:01:40 AM LJM Reilly and JMs Dadio and Abdul-Lateef were in See's cell, JM Rivas was outside of the cell setting up the AED. 6:01:44 AM SJM Rilley arrived at See's cell. 6:01:53 AM LJM Reilly, JM Dadio and Abdul-Lateef removed See from the cell and placed him on the floor in a supine position. 6:02:37 AM JM Dadio began chest compressions (CPR). 6:04:04 AM JMs stopped CPR for the AED to analyze See. 6:04:18 AM CPR resumed with JM Harrington doing chest compressions. 6:06:02 AM LJM Reilly relieved JM Harrington of chest compressions. 6:06:22 AM JMs stop CPR for the AED to analyze See. 6:06:43 AM CPR resumed with LJM Reilly doing compressions. 6:08:50 AM AMR EMTs arrived at See. 6:09:02 AM AMR EMT took over chest compressions. 6:10:38 AM NHFD Paramedic arrived with another crew member. CPR stopped, monitor hooked to See. 6:13:34 AM AMR EMTs cleared the scene. 6:15:00 AM NHFD Paramedic crew member disconnected the monitor from See. 6:20:02 AM NHFD cleared the scene. 6:23:00 AM JMs Dadio and Harrington covered See's body with a blanket. 6:41:10 AM JMs Harrington, Dadio, and Abdul-Lateef cleared prisoners from B-block.

7:47:23 AM NHPD arrived and photographed See's body and cell B-31. 7:55:42 AM Representatives from the Chief Medical Examiner's Office arrived on scene and processed See's body.

Policy Judicial Marshals must operate cellblocks and holding areas in a safe and secure manner. Authority and References A. Connecticut General Statutes 6-32d, 6-32f, 18-81cc B. Judicial Marshal Services' Policy and Procedures 210-04 (Prisoner at Medical Facility), 213-09 (Prisoner Behavior Report), 213-01 (Reporting of Incidents), 213-04 (Post Orders and Logs), 210-02 (Restraints), XXX-XX (Prison Rape Elimination Act Lockup Standards) D. 1) The Prison Rape Elimination Act of 2003, 45 U.S.C. 15601, et seq. 2) The Prison Rape Elimination Act Lockup Standards, 28 C.F.R. Part 115. Area of Responsibility Supervising and Lead Judicial Marshals assigned to supervise a cellblock must ensure that Judicial Marshals assigned to the cellblock are alert, aware, and conduct themselves in a professional courteous manner at all times. Detainees held in the cellblock must be properly secured and cared for in a manner that is consistent with the established policies and directives of the Chief Judicial Marshal, Judicial Marshal Services and the Judicial Branch.

General Responsibilities Supervising and Lead Judicial Marshals assigned to the cellblock will be responsible to provide a safe and secure environment for detainees, department staff and all other authorized individuals entering the cellblock. Marshals must closely monitor the needs of the detained individuals and provide needed care immediately.

General Instructions A. At the beginning of the shift conduct roll-call and assign staff to appropriate post and document. Issue portable radios and monitor all radio transmissions. Issue cell and security keys and complete appropriate key control log Check video monitoring devices to ensure proper functioning.

At the start of each shift, supervise security sweep of the cellblock, sally-port and prisoner movement area to ensure the following and document in facility log and on Supervisor Report. 1) 2) 3) 4) 5) 6) Cells checked for contraband, weapons, damage and cleanliness. Prisoner's elevators and holding areas checked for weapons and contraband.

Secure cellblock for prisoner intake and processing. Judicial Marshals must properly identify each prisoner using Police UAR, D.O.C. photographs and related paperwork. Intake each prisoner in accordance with Judicial Marshal Services Policy and Procedure XXX-XX (Prison Rape Elimination Act Lockup Standards). Document the cell letter\number of each detainee. Monitor the handling and documentation of prisoner property. Ensure that Judicial Marshal conduct 15 minute or more frequent tours of housing and holding areas and complete tour log (Refer to Judicial Marshal Policy and Procedure 214-06 (Cellblock Tours)). Conduct hourly tours of the cellblock and related post, and monitor Judicial Marshals for policy compliance. Monitor the medical needs of the detainees and provide the appropriate medical care. Document tours and all pertinent information in the facility log and Supervisor's Report. Perform hourly prisoner counts (counts should also be completed following any mass movement) and document in facility log. Institute lock-down during mass movement of prisoners, escapes or emergencies (or midday lunch break 1:00p.m. 2:00 p.m.). Conduct end of shift audit of prisoner property.

Instruct Judicial Marshals to sweep cellblock to ensure that it is free of prisoners at the completion of the shift (24/7 facilities: a count of all detainees must be made at the conclusion of the shift) and document in the facility log. Secure keys, radios and complete appropriate logs.

Special Instructions A. Prisoners who are on protective custody or keep-separate status must be appropriately segregated.

B.

No unauthorized persons including off-duty Judicial Marshals are allowed in the cellblock at anytime without permission from the Chief Judicial Marshal, unless ordered to do so by a superior court judge. Prisoners who are deemed to be a suicide risk must be placed on a continuous watch. 1) Prisoners who are deemed to be at risk of being sexually abused who cannot be placed in a single cell must be placed on a continuous watch. Prisoners who pose an unusual safety risk to other inmates must be segregated, including those deemed to be at potential risk of being a sexual abuser. Those who cannot be segregated must be placed on a continuous watch. Female prisoners will only be moved by female marshals when available, or two male marshals. When releasing an inmate or detainee, established release procedure must be followed in accordance with established directives and procedures. At no time will any member of any Police Department, Inspector for the State's Attorneys Office, member of the Department of Correction or any other individual carry a firearm while in the cellblock. Inmates will remain in leg restraints at all times, unless removed for medical reasons. (Inmates who are pregnant must not be placed in leg restraints). Emergency medical personnel will be immediately notified if a detainee becomes seriously sick or injured. Judicial Marshals must not move prisoners or reassign cells without prior supervisor approval. Prisoners scheduled to attend court must be placed in handcuffs prior to leaving the cellblock area.

In the event of an escape or attempted escape the Supervising/ Lead Judicial Marshal must immediately notify the appropriate agencies and the Chief Judicial Marshal. Facial Laceration
A facial laceration is a cut on the face. Lacerations usually heal quickly, but they need special care to reduce scarring. It will take 1 to 2 years for the scar to lose its redness and to heal completely. TREATMENT Some facial lacerations may not require closure. Some lacerations may not be able to be closed due to an increased risk of infection. It is important to see your caregiver as soon as possible after an injury to minimize the risk of infection and to maximize the opportunity for successful closure. If closure is appropriate, pain medicines may be given, if needed. The wound will be cleaned to help prevent infection. Your caregiver will use stitches (sutures), staples, wound glue (adhesive), or skin adhesive strips to repair the laceration. These tools bring the skin edges together to allow for faster healing and a better cosmetic outcome. However, all wounds will heal with a scar. Once the wound has healed, scarring can be minimized by covering the wour I with sunscreen during the day for 1 full year. Use a sunscreen-with an SPF of at least 30. Sunscreen helps tc r ;duce the pigment that will form in the scar. When applying sunscreen to a completely healed wound, ml s; age the scar for a few minutes to help reduce the appearance of the scar. Use circular motions with your fixv e :tips, on and around the scar. Do not massage a healing wound. HavIE CARE INSTRUCTIONS For sutures:
Keep the wound clean and dry. If you were given a bandage (dressing), you should change it at least once a becomes wet or dirty, or as directed by your caregiver. Wash the wound with soap and water 2 times a day. Rinse the wound off with wound dry with a clean towel. After cleaning, apply a thin layer of the antibiotic ointment recommended by yi infection and keep the dressing from sticking. You may shower as usual after the first 24 hours. Do not soak the wound in vi Only take over-the-counter or prescription medicines for pain, discomfort, or ft Get your sutures removed as directed by your caregiver. With facial laceratior out after 4 to 5 days to avoid stitch marks. Wait a few days after your sutures are removed before applying makeup. Also change the dressing if it ater to remove all soap. Keep the wound clean and dry. Do not get the skin adhesive strips wet. You may bathe carefully, using cautic n to,keep the wound dry. If the wound gets wet, pat it dry with a clean towel. Skin adhesive strips will fall off on their own. You may trim the strips as the we u nd heals. Do not remove skin adhesive strips that are still stuck to the wound. They will fall off in time.

You may briefly wet your wound in the shower or bath. Do not soak or scrub . 1 , wound. Do not swim. If you get a tetanus shot, your arm may swell, get red, and feel

You develop redness, pain, or swelling around the wound. There is yellowish-white fluid (pus) coming from the wound. You develop chills or a fever.
