The wife of imprisoned activist Pyone Cho spent about 90,000 kyat (US $75) on a
10-day journey to visit him in jail in Kawthaung, southern Burma. The sister of
another political prisoner, the prominent labor rights activist Su Su Nway, spent
only slightly less on a six-day journey to visit her in Kale Prison in Sagaing Division,
central Burma.
Family members spoke to The Irrawaddy about the huge difficulties they faced as a
result of the regime’s decision to consign activists condemned in the recent series of
trials to prisons in various remote parts of Burma.
Bo Kyi accused the regime of intentionally creating problems for prisoners and their
families, causing mental and physical pain.
Many of the political prisoners were being held under inhumane conditions and
were being tortured, Bo Kyi said. Some prisons had no doctors or facilities for
treating inmates.
“Some political prisoners are not allowed to walk outside their compounds,” Bo Kyi
said. “They even can’t see the sun. It is very dangerous for the health of those
detained in cold locations over the next few months.”
One Rangoon source said a youth member of the opposition National League for
Democracy, Aung Kyaw Oo, serving a 19-year sentence in Pegu Prison, had been
savagely beaten and denied medical treatment.
When Aung Kyaw Oo’s wife visited the prison on December 3 she was denied
permission to see him and had to wait until December 13. A prison source said
Aung Kyaw Oo had told his wife about the beatings.
A defense lawyer, Saw Kyaw Kyaw Min, who recently fled to Thailand, said one of
his clients, Myint Aye, founder of the group called Human Rights Defenders and
Promoters, had also been tortured while in prison.
“Prison authorities questioned him continuously for five days. They didn’t let him
sit down and sleep. He finally collapsed.”
Myint Aye was convicted of involvement in a bomb attack on an office run by the
junta-backed Union Solidarity and Development Association in Rangoon’s
Shwepyithar Township on July 1.
In a statement issued on Tuesday, Elaine Pearson, the group’s deputy Asia director,
accused the regime of using the country's legal mechanisms to threaten political
prisoners and deny them access to justice.
It said Asean should address Burma's lack of respect for the rule of law when it
holds its rescheduled summit meeting in early 2009.
Pearson said: “The government locks up peaceful activists, sends them to remote
prisons, and then intimidates or imprisons the lawyers who try to represent them.
This abuse of the legal system shows the sorry state of the rule of law in Burma.”

A Toast to Asean

While the officials themselves were full of praise and positive comments, the 500
million people in the region may be asking themselves has the Association of
Southeast Asian Nations (Asean) ever done anything to actually change their lives
since it was formed?
The objective answer is very little as a staunch defender of democracy and human
rights.
After all, when Asean debated the new charter that also contains a human rights
section, the rogue state of Burma, a full Asean member, was at the table arguing
against any interference in its internal affairs.
This is the same rhetoric that has come out of Asean for decades, leading many
observers to lose faith in the regional body as a defender of democracy and human
rights.
Only a few months later, the junta’s puppet courts began handing out harsh prison
sentences to more than 200 people from monks to relief workers to leading political
activists, sentences of up to 68 years imprisonment.
The lengthy imprisonments were not enough for the junta, only days later almost all
of the newly imprisoned activists were transferred to remote prisons outside
Rangoon, more systematic, psychological torture not only for the political prisoners
but also for their families who have to spend more time and expense to maintain
contact.
Most Asean officials have recognized Burma as a “problem child” ever since the
grouping embraced the junta as a full member in 1997. At that time, some Asean
officials may have optimistically believed that its fellow nations could influence the
outlaw military government for the better. There is no evidence of that ever
happening for the past 11 years.
Asean has constantly been on the defensive, deflecting calls from Western nations
to do more with its policy mantra of “non-interference” in domestic affairs.
The updated rhetoric in the new charter will be a challenge for several member-
nations to meet, especially authoritarian regimes like Burma, Vietnam and Laos. In
fact, the whole issue of democracy and human rights in Southeast Asia runs hot and
cold in all nations, including founders Indonesia, Malaysia, Philippines, Singapore
and Thailand.
All have blemished records, most recently Thailand, which postponed a scheduled
Asean Summit in December because of political strife. The summit is now set for
February.
Human rights issues are clearly the new hot potato for Asean. Its charter has no
teeth, no provisions for sanctions, suspension or expulsion against member states.
You may rightly ask, what’s the point of having a human rights section if Asean
can’t even expel a state for gross, systematic violations, such as Burma?
Will the Burmese generals fear the Asean human rights charter? The generals will
continue to suppress the Burmese people and manipulate Asean, using the time-
tested, non-interference principle in domestic policies.
The real problem is in the politics within Asean member states. The governments
simply lack a strong belief that democracy and human rights abuses are important
enough to defend and fight for in ways that would effectively penalize member
states.
In spite of the new Asean charter and its human rights pact, don’t expect any big
changes to come from Asean in the future. It will be business as usual when it
comes to member states that practice anti-democratic values and abuse human
rights.

NEW YORK: Of all the questions Barack Obama needs to ask right now, the most
important should be addressed to the Secret Service: How the heck did Muntader
al-Zaidi get his second shoe off?
Al-Zaidi, of course, is the Iraqi television journalist who expressed his rage at the
U.S. occupation of his country by hurling first one shoe, then the other, at President
George W. Bush in Baghdad. He's now in detention.
As for his shoes, they're not going to end up on some gilded stand in a dusty
museum somewhere in the Arab world. They've apparently been destroyed at a
laboratory during a search for explosives. Yes, you read that right.
The shadow of Richard Reid, the would-be shoe-bomber of 2001 whom most
regular air travelers would happily submit to protracted torture, extends even to
Iraq. One thing's for sure: Al-Zaidi, now a hero in much of the Arab world, won't be
short of replacement footwear once he emerges from captivity.
When that will be is anyone's guess. He's apologized to Prime Minister Nuri Kamal
al-Maliki. Bush has urged the Iraqis "not to overreact."
One theory is that time enough is needed for the journalist's bruises to fade. One
certainty is that the pummeling he got was as intense as the reaction to what he did
was slow. A second shoe is one too many. Change the last letter in shoe and you
have shot.
Bush, when the shoes came his way, was in the Green Zone, the walled four-
square-mile home to Western officialdom and the Iraqi government that has about
as much in common with the rest of Iraq as Zurich has with Falluja.
For all it reflects of Iraqi life beyond its walls in what is sometimes called the Red
Zone, the Green Zone might as well be in Baton Rouge.
This sprawling urban garrison, where U.S. forces moved into Saddam Hussein's
Mesopotamian Fascist Republican Palace right after the 2003 invasion, is a
monument to failure. As long it exists in the center of Baghdad, Iraqi democracy will
be hollow.
Al-Zaidi's gesture broke those barriers, penetrated the hermetic sealing, and
brought Red-Zone anger to Green-Zone placidity. In this sense, his was a
democratic act.
What it said was: "Tear down these walls." What it summoned was the deaths, exile
and arbitrary arrests that U.S. incompetence has inflicted on countless Iraqis - a toll
on which al-Zaidi has reported. What it did was thrust Bush, for a moment, out of
the comfort zone of his extravagant illusion. Perhaps, for a second, the other shoe
dropped.
After the incident, I heard from a U.S. friend now serving in the joint security station
in Sadr City, the teeming Shiite district of Baghdad from which al-Zaidi hailed. He
wrote: "We did not get a fusillade of shoes thrown over the concrete barriers and
razor wire. One college engineering student in Sadr basically said re: the press
conference incident: 'Well that's the democracy you brought us, right?"'
But the process is slow. Recovering from murderous despotism takes a minimum of
a generation.
Al-Zaidi's anger was that of a Shiite - at the U.S. occupation and at all the loss.
There is fury and fear, too, among Sunnis, whose "awakening" dealt a devastating
blow to Al Qaeda in Iraq but whose mistrust of the now-dominant Shiite is visceral.
Another of Obama's pressing questions should be: Does my 16-month withdrawal
timetable risk reigniting sectarian war?
One thing is certain: Before the United States pulls out its combat troops, the Green
Zone must cease to exist. While it's there, it's a sign that Iraqis - all Iraqis - have not

leader and could face long imprisonment. But the Green Zone is an insult to all
Iraqis. Al-Zaidi should be released and an Iraqi-American commission on
terminating the Green Zone established at once.

COMMENTARY
The Iraqi reporter who threw his shoes at US President George W Bush provided a
reminder that to hit someone with a shoe in the Middle East is considered the
supreme insult—but it’s an act of contempt that also probably applies almost
anywhere in the world.
Burma had a shoe issue of its own in the past—although no American was involved.
Britain was at the center of this one.
British diplomats and officials were told to remove their shoes and socks when
visiting the Burmese court. It was more than a matter of etiquette and became a
political issue, too.
The British resented having to stoop to remove their shoes and socks before an
audience with the king. The Burmese regarded it as an act of respect towards their

fuel Burmese nationalism.
The British colonizers took no serious note of Burmese sensibilities and kept their
shoes defiantly on. Soldiers marched in their combat boots through Mandalay
Palace and temples, symbolically trampling on the feelings of monks and the
general Burmese public.
After seeing their monarchy dismantled by the British, the Burmese now felt that
Buddhism and Burmese values were under threat.
In 1916 and 1917, resentment reached a height, with the Young Men’s Buddhist
Association, one of Burma’s earliest civil society groups, registering strong protests
against the British disregard for etiquette. The “shoe issue” further fired Burmese
nationalism and brought many young Burmese into the political arena. Finally, they
won.
Even after independence, the “shoe issue” remained a sensitive one for many
Burmese.
During my high school days, some teachers and principals insisted on students
removing their flip-flops before entering their offices. I remembered a teacher
indirectly suggesting to her students that they should remove their footwear before
meeting her.
I was among the many students who complied, rather than risk the teacher’s anger.
She seemed to be happy to see us performing this act of respect.
It’s good to see the tradition of removing footwear before entering Buddhist temples
and shrines surviving in Burma, but the “shoe issue” has now surfaced in other, less
worthy surroundings
Government ministers and officials are reportedly removing their shoes before
meeting the junta leaders. It’s unclear whether a government order has been issued
requiring them to do so—I was told such an instruction had not been given.
Nevertheless, ministers and officials are appearing shoeless before Snr-Gen Than
Shwe—out of forced respect or seeking some favor or other.
The “shoe issue” cropped up dramatically in 1997, when one small faction of Karen
insurgents led by Saw Tha Hmu He surrendered to Gen Maung Aye, vice chairman
of the ruling council.
Karen people at the ceremony and watching it on TV were outraged when Maung
Aye, during an inspection of confiscated weapons, walked on the Karen flag, which
had been laid on the ground. They protested that Maung Aye’s disrespect had
damaged hopes for national reconciliation.
As Nancy Sinatra once sang: “These boots are made for walkin’.” In some sensitive
circles, however, they have a much more potent and political purpose.

The Straits Times helpfully provided a list of the "unlawful" things that
the Overseas Burmese Patriots (OBP) organised, compared to the
"lawful" things that other Burmese groups did. You will see from the
list that everything that was outdoor was "unlawful", but indoor things
permitted, a point I will come to later.
Does a country have the right to decide who enters and who should
leave? Of course. On that principle, there should be no dispute. The
question is what considerations go into deciding who should leave? If
the considerations are arbitrary or poorly founded, are they rightful?

media and through "uninformed foreign groups".
As you can see above, Wong said these individuals had persistently
defied the laws of Singapore. I think Singaporeans need to ask
themselves, how lawful are these laws, or at least, how lawful is the
manner in which these laws are interpreted? Because if they are
unlawful, then there is no moral justification for doing what the
government did.
Unlawful laws
Among others, these include civil and political rights such as the right
not to be subjected to torture, to equality before the law, to a fair trial,
to freedom of movement, to asylum and to freedom of thought,
conscience, religion, opinion and expression. The rights outlined in the
UDHR also include economic, social and cultural rights such as the
right to food, clothing, housing and medical care, to social security, to
work, to equal pay for equal work, to form trade unions and to
education.
The law the Wong claimed the Burmese broke was that regulating the
freedom the assembly. In essence, Wong said these individuals were
instrumental in organising protest marches without a licence from the
government.
But the reality is that licences are almost never given, except for such
government-promoted events like the Chingay float parade. This
pattern of refusal strongly suggests that the intent of the law has been
thwarted; instead of applying a reasoned consideration of public
safety, it has been used to stifle dissenting opinion – a breach of the
Universal Declaration of Human Rights, now regarded as customary
international law.
Can you penalise someone when the rule he is said to have broken is
an unjust rule in the first place?

Deputy Prime Minister and Home Affairs Minister Wong Kan Seng has confirmed the true
intent behind the non-renewal of visas and work permits of some Burmese patriots in
Singapore who were involved in peaceful assemblies and demonstrations.
As expected, DPM Wong has affirmed that “persistent defiance of the laws” was the real
reason why a number of Burmese nationals working or studying here were asked to leave
when their immigration passes expired. (ST, “Myanmar activists ‘defied our laws’”, 18 Sept
2008)
DPM Wong’s statement does not come as a surprise to any of us. The question is, why has
the Government taken so long to confirm what we had known all along?
When 6 Burmese patriots were denied renewals of their PR re-entry permits, employment
passes, work permits, or social visit passes by the Immigration and Checkpoint Authority
(ICA) and the Ministry of Manpower (MOM) in July/Aug this year, no reason was provided
by the authorities. Even on appeal, no reason was given for the rejections. Why has the
Government taken so long to come clean as to the real reason for all this?
DPM Wong said the Burmese nationals disregarded Singapore laws by staging illegal
activities, like outdoor protests, to pursue their political agenda.
The purpose of this article is not to judge whether the laws against public assembly of 5 or
more persons are just or unjust, or to provide reasons whether this particular law has been
selectively applied to suppress dissent. Long time readers know my stand on this.
Rather, I would like to put forward the point that the authorities have displayed a distinct
lack of compassion towards the Burmese patriots.
DPM Wong said that these Burmese “chose to break the law and yet defiantly demand the
right to stay in Singapore as an entitlement“.
This statement is loaded and biased. The Burmese patriots never claimed, explicitly or
implicitly, that they felt their stay in Singapore was an entitlement. During a press
conference on 22 Aug at Peninsula Excelsior Hotel, the host, Mr Myo Myint Maung Marc,
emphasized that the Burmese were not seeking special favours, but only the right to be
treated fairly.
DPM Wong also said, “They have tried to politicize the issue through the media and
through uninformed foreign groups, in the process distorting the actions to remove them
from Singapore as being politically motivated.”
In my opinion, it is DPM Wong who is politicizing the issue, not the Burmese patriots.
When lives and families are at stake, is it so wrong to go public with the issue so as to make
known their plight? If it were a group of Singaporeans who was being victimized in another
foreign country, perhaps DPM Wong would also prefer them to remain silent about their
plight?

'We found that people who on average slept longer were at reduced risk of
developing new coronary artery calcifications over five years,' said Dr Diane
Lauderdale of the University of Chicago Medical Center, whose study
appears in the Journal of the American Medical Association.
Unlike other studies looking at the risks of getting too little sleep, which use
people's own estimates of their sleep patterns, Dr Lauderdale's team set out
to measure actual sleep patterns.
They fitted 495 people aged 35 to 47 with sophisticated wrist bands that
tracked subtle body movements. Information from these recorders was fed
into a computer program that was able to detect actual sleep patterns.
The team used special computed tomography, or CT, scans to assess the
buildup of calcium inside heart arteries, performing one scan at the start of
the study and one five years later.
After accounting for other differences such as age, gender, race, education,
smoking and risk for sleep apnea, the team found sleep duration appeared
to play a significant role in the development of coronary artery calcification.
Sleep matters
About 12 per cent of the people in the study developed artery calcification
during the five-year study period. Among those who had slept less than five
hours a night, 27 per cent had developed artery calcification.
That dropped to 11 per cent among those who slept five to seven hours,
and to 6 per cent among those who slept more than seven hours a night.
Dr Lauderdale said it is not clear why this difference occurred in people who

Because blood pressure tends to fall off during sleep, it could be that people
who slept longer had lower blood pressure over a 24-hour period.
'People think that sleep doesn't matter but clearly it does. Sleep deprivation
is a public health problem and studies such as this show how increasing
sleep duration can have tremendously positive effects,' Dr Parker, who was
not involved in the research, said in a statement.
