How to use this BDP 1. 2.


Identify the level to which an executive belongs from Appendix to BDP i.e. level IA to IE, level I/III/IV and Chief of Corporate Functions. For administrative and expenditure sanction of items of capital nature, refer explanatory notes on powers relating to expenditure of capital nature and relevant clauses of administrative approval and expenditure sanction for capital items as given in index. For administrative approval and expenditure sanction of items of revenue nature, refer explanatory notes on powers relating to expenditure of revenue nature and relevant clauses of revenue expenditure given in index. For procurement of materials/hiring of services/turnkey contracts/emergency purchase/discarding and disposal pertaining to MM functions, refer to relevant clauses of MM powers given in index. 2) The basic philosophy followed in the BDP is to assign powers of capital expenditure to Level-I varying from Rs.1 crores to Rs.25 crores for Level-IE to IA (not below GM) Executives only. Marginal powers of capital expenditure up to Rs.5 lakhs have been assigned to Level-II (not below DGM). The third tier of Area Managers responsible for each field within an Asset, Forward Base Managers within a Basin, and Location Managers within a Service have been given powers up to Rs.1 lakh to meet operational requirements. However, in respect of expenditure of revenue nature, sufficiently commensurate powers to Level-II, III, IV and other Chiefs / Executives have been given depending upon the operational requirements. Detailed explanatory notes have been given in the sections relating to Capital and Revenue expenditure to facilitate clarity on utilization of these powers. 3) Corporate Level - The Chiefs of Corporate Functions like Planning, Projects & Capital Budgeting, Equipment Management, Technical Audit & QA; Business Development, JV and Marketing, Legal, Corporate Communications, Corporate Affairs, CVO, Internal Audit, Commercial, Performance Management, HRD, Employee Relations, EXCOM have also not been assigned high powers for capital expenditure and the same has been restricted up to Rs. 5 lakhs only. However, Chief Info-com and Chief MM have been assigned higher powers of capital expenditure of Rs.15 crores to take care of certain centralized requirements 4) The powers of purchase and acceptance of tenders were hitherto confined to Material Management (MM) Executives and Regional Directors except where specifically permitted to the other competent authority. In the last meeting, the Board had approved extension of the purchase powers to Asset Managers also. It is proposed that the Asset Managers, Basin Managers, National Chiefs of services, Heads of Institutes, Head of Plants ,Heads of Regional Offices and Chief Info-Com may be vested with the powers to purchase and/ or procure services /works equivalent to their expenditure sanction powers. Head of the Material Management function in the Assets / Basins/ Services/ Institutes/ Regional Office/ Plants shall have powers of purchase and acceptance of tenders up to 20% of the powers of the respective Asset/ Basin Managers/ Chief of Services/ Head of Institutes/ Regional Heads/Head of plants , with a view to ensure that all lower value proposals are not remitted to the Asset/ Basin Managers/ Head of Plants, etc.. The second level Executives supporting the Head MM shall also be vested with marginal powers of purchase and acceptance of tenders. 5) Extent of powers mentioned in the BDP is against open tender if not clearly specified 6) Level-I executives/ Head of Institutes have powers of purchase , fabrication, repair & maintenance and other contractual works on nomination basis if not clearly specified. 7) In respect of powers of purchase, fabrication, repair & maintenance and other contractual works a distinction has been made between open tender, limited tenders and purchase on nomination basis. The powers for limited tenders are restricted to 75% of the open tender process and for purchase on nomination basis, the power are restricted to 35% of open tender process. In case the value of the tender exceeds the powers to place orders for procurement, the tender will be approved by the next higher competent authority

8) Similarly in case of tenders( open / limited ) if there is only one single acceptable tender, the powers shall be 75% ( open /limited tender ) if the tenderer is a PSU and 50% ( open /limited tender ) if the tenderer is a private party, of the powers of the respective purchase authority. In case the value of the tender ( limited / nomination) exceeds the powers to place orders, the tender will be approved by the next higher competent authority.

11) The Asset managers/Basin Managers/Plant Managers/ Head Regional Offices /Chiefs of Services/ Head of Institutes and Chiefs of Corporate Functions shall have powers for unbudgeted capital items up to 10% of their expenditure sanction powers provided the total approved budget is not exceeded. 12) The Asset managers/Basin Managers/ Plant Managers/ Head Regional Offices /Chiefs of Services/ Head of Institutes and Chief of Corporate Functions shall have full powers of re-appropriation From one capital item to another subject to such item falling within sanctioning power of the concerned authority and provided there is no re-appropriation between plan and non-plan. For re-appropriation between inventory items, contractual and other charges within the approved budget of their respective Assets, Basins Services, Institutes and Regional/Head Office.

13) Expenditure sanction and purchase proposals falling above the powers of Asset Managers/Basin manager/ Chief of Services/Head of Institutes and Chiefs Corporate Functions shall be taken to the respective Directors to whom they are reporting for approval or further action, as the case may be. 14) Powers of higher authority where not defined shall be equal to the next lower authority. 15) Wherever Level-I only has been mentioned without suffix A, B,C, D,& E, it shall mean that all the categories (A,B,C, D&E) under Level- I shall have the powers mentioned against them. 16) Powers mentioned in BDP for different levels to be exercised only in the case of approved budget. 17) Financial concurrence is required to be obtained at the budgeting stage itself. If the same has not been obtained at the budgeting stage, financial concurrence is required to be obtained unless the case is specifically covered under FCNR. For the purpose of financial concurrence , the level of finance executive should not be less than two levels below the sanctioning authority. 18) Administrative approval and expenditure sanction is to be given by competent authority in respect of items provided in the approved budget. 19) Emergency procurement to be made only from manufacturer/ authorized dealer/ reputed supply house. 20) Monthly statement of expenditure approved above Rs.100 lakhs in each case to be reported to next higher authority 21) The following principles /guidelines which shall govern the exercise of delegated powers : 21.1. The Asset/Basin Managers are the fulcrum of core production and exploration activities with other Chiefs supporting these activities and are principally accountable for production and reserve accretion in their given areas of operations. These executives therefore need to be suitably empowered to enable them to discharge their responsibilities effectively. In case of any difference of opinion within their respective areas of operation, the respective Asset /Basin Manager, Chief of Service and Head of Institute, being in-charge, would have the authority to decide on the issue, recording reasons and reporting the same to one level above. 21.2 The due diligence and compliance mechanism for exercise of delegated powers needs to strengthened and towards this end a continuous monitoring and review by way of a periodic Compliance Report to ascertain the efficacy and efficiency of the money spent and reporting variances in performance with due explanation be established . A report on all cases of expenditure exceeding Rs. 50 crore be put up to the Board for review. The cases involving expenditure below Rs. 50 crore be continued to be reviewed by EPPMC or Functional Directors, or Level-I executives based on expenditure involved .

21.3 The delegated power shall be exercised by the delegatee within the overall approved budget limit. 21.4 The delegatee of powers shall not be authorized to further sub delegate the delegated power.

21.5 The delegatee shall not exercise the delegated power in anticipation of budget approval by the Board 22 At present, level I executives enjoy full expenditure sanction powers for stores and spares. However for contractual services, full expenditure sanction power have not been specified, as a result of which all such proposal have to be considered by the EPC. It was proposed that full expenditure sanction powers for contractual services be vested with the concerned Directors. However all procurements above Rs.50 crs shall be made with the approval of Executive Purchase Committee 23. As regards Limited tender/Single tender, it was proposed that the level-1 executives namely Asset/Basin Manager, Chief of Service and Head of Institutes, etc. be authorized to procure the items/ hire services on nomination/single tender basis as per conditions mentioned in BDP. 24. Chief of Info-Com shall have expenditure sanction and procurement powers in respect of info-com items to be procured centrally. Powers in respect of info-com items to be procured by Assets /Basins / Services/ Regional Offices/ Institutes and Corporate Offices etc. shall vest with these executives as per delegation. The CIO may however lay down the standards for various info-com items and also enter into rate contracts with various vendors for facilitating standardization and procurement by other offices

PART I

POWERS RELATING TO EXPENDITURE OF CAPITAL NATURE

Explanatory Note on Powers relating to expenditure of Capital Nature

For the purpose of exercising powers under this Section, the nature of expenditure at the time of incurrence of the expenditure is to be observed. For instance the expenditure on hiring rigs may be capitalized for development well but at the time of hiring the rigs, the nature of expenditure is revenue. Similarly, replacement of capital items may be charged off to profit & loss account but at the time of incurrence, the expenditure is of capital nature and powers of capital expenditure need to be exercised for same Powers relating to expenditure of capital nature have been restricted to be exercised by Asset Managers/ Basin Managers/Chiefs of Services/Plant Managers/ Head of Institutes/ Chief-Info Com; Offshore IMR; Offshore Supply Base; MM and Head of Regional Office. Asset /Basin Managers, Service Chiefs and other categorized in Level IA (Appendix for BDP) have been assigned maximum powers of capital expenditure upto Rs.25 crores, those in IB Rs.15 crores, IC Rs.10 crores , ID Rs.5 crores and IE Rs.1 cr. Level I consists of Executives not below E-7 (GM). The Level II Executives not below E6 (DGM) have been assigned nominal powers of capital expenditure upto Rs. 5 lakhs to take care of operational requirements. The system of expenditure sanction and indent (STR6) in vogue presently has been completed revamped. Henceforth administrative approval and expenditure sanction in respect of capital items is required to be obtained with due concurrence of Finance, before incorporating the capital item in the budget save for items in respect of which only a token provision has been made. Upon approval of the budget by the Board, the budget itself in respect of such items shall become authorization for financial expenditure (AFE). However to ensure that due diligence is once again carried out even through items falls in AFE category, the powers of placing indent for procurement of the material (STR6), Service or works shall be exercised by Level II Executives to the extent of 20% of the powers of Level I Executives. For items of value above 20%, the indent shall be placed with the approval of Level I executives.. Before placing the indent, the Executives shall reassess need for the items and ensure that the parameters based on which the item was budgeted have not undergone change and/or justification exist for procuring such items. In case of any capital scheme approved by competent authority, no separate expenditure sanction is required for individual items of scheme.

Any major change in physical parameters in an approved capital scheme (even within sanctioned expenditure) requires approval of the sanctioning authority. In respect of capital schemes/projects approved by Directors/C&MD/Board, the powers of purchase shall be exercised by the respective Asset/Basin Managers/Chief of Services/ Head of Institutes/ Plant Manager and Regional Heads upto their own sanctioning/approval powers and beyond that, approval of Directors/EPC shall be obtained.

PART II POWERS RELATING TO EXPENDITURE OF REVENUE NATURE

Explanatory Note on Powers relating to Expenditure of Revenue Nature


1. For the purpose of exercising powers under this Section, the nature of expenditure at the time of incurrence of the expenditure is to be observed. For instance the expenditure on hiring rigs may be capitalized for development well but at the time of hiring the rigs, the nature of expenditure is revenue. Similarly, replacement of capital items may be charged off to profit & loss account but at the time of incurrence, the expenditure is of capital nature and powers of capital expenditure need to be exercised for same. Full powers for stores and spares have been assigned to Level I executives. Wherever full powers are prescribed, they shall mean powers to the extent of budgeted provisions. In respect of items stores & spares, contract services and hiring of rigs, tankers, vessels etc. administrative approval and expenditure sanction is required to be obtained with due concurrence of Finance, before incorporating the item in the budget on the lines of capital items. Upon approval of the budget by the Board, the budget itself in respect of such items shall become authorization for financial expenditure (AFE). The designated authority in the BDP shall exercise powers for placing indent for procurement of material, service or works equivalent to their expenditure sanction powers. In respect of other expenditure of revenue nature such as other charges statutory and misc. payments, standing contractual obligations etc. no separate financial concurrence is required for incorporating the same in budget. Powers of HR Management 1. The powers of HR are to be exercised by the Controlling Officers and other specified authorities (levels) in respect of all the employees of establishments they head.

1(a). Controlling Officer means an officer not below the level of E.2 and immediately above the concerned employee to whom the latter reports for work. Officers at E.6 and above levels will be self-Certifying Officers for the purpose of T.A. and other personal claims. 1(b). Levels for exercising the powers indicated as HR-I, HR-II, HR-III are specified in the Annexure. Levels I, II and III refer to authorities of BDP, circulated vide O.O. No. ONGC/CS/BDP/2002 dated 1st January, 2002. 1(c). I/C-HR/ER means the in charge of HR/ER function at Assets, Basins, Plants, Regional Offices, Services and other offices and In charge-Establishment or InCharge-Administration with Chief-ER at HQ. 2. While exercising these powers, the authorities will follow the existing Rules, Regulations and instructions on the subject. These powers are of an administrative nature and shall not require concurrence of finance, unless otherwise specifically mentioned. Concurrence of HR/ER, where specified will be needed. A senior officer can exercise the power delegated to a junior officer, whenever required, in respect of employees falling under Administrative Control and chain of command.
