Resolution Designating an Urban Public Park Location on the Library Lot Site.

Whereas, City Council approved a resolution (R-07-517) on 11/05/07 directing the Do nto n Develop!ent "uthority (DD") to prepare a ritten reco!!endation #or construction o# a $outh %i#th "venue underground par&ing garage hich ould include 'a(ove ground, in the short-ter!, sur#ace pu(lic par&ing, and support in the long-ter! develop!ent hich could include, (ut is not li!ited to, a residential, retail and/or o##ice (uilding(s) and a pu(lic pla)a along either %i#th "venue or the ne ly constructed street*+ Whereas, ,he DD" presented a site plan #or the $outh %i#th "venue -ar&ing .arage (located at /10 $outh %i#th "venue) hich City Council adopted (R-00-011) on 02/17/00 ithout addressing the repeated, !ultiple pu(lic co!!ents (e3g3 during the 10/14/05 '6pen 7ouse+ and 10/21/05 -lanning Co!!ission !eetings) re8uesting a pu(lic pla)a or green space instead o# the /5 sur#ace par&ing spaces in the design* Whereas, ,he City o# "nn "r(or issued Re8uest #or -roposals 974/ #or develop!ent o# City-o ned property on top o# the ne par&ing structure at /10 $outh %i#th "venue in "ugust, 2000 and the R%- called #or proposals that ould include a (ene#icial use o# the site such as a pu(lic pla)a, as ell as provide a positive #inancial return or (e #inancially neutral, to the city hile de!onstrating a clear (ene#it to the co!!unity and t o proposals #or par& develop!ent #or the site ere a!ong the su(!issions* Whereas, "nn "r(or lost its historic central, civic open space hen the old County Courthouse and its la n ere replaced and again, !ore recently, hen the !odest City 7all la n as sacri#iced to (uild the ne :ustice Center addition* and Whereas, ,he ;i(rary <loc& $tudy (;uc&en(ach/=iegel!an, 1001) and the Reco!!ended >ision ? -olicy %ra!e or& #or Do nto n "nn "r(or (Calthorpe "ssociates, 2001) (oth called #or the creation o# a su(stantial, ',o n $8uare+ type o# pu(lic par& or pla)a on the ;i(rary <loc&* Whereas, ,he Do nto n -lan (2000) states 'pu(lic spaces play an i!portant role in structuring the 'i!age o# the city+ (y creating #ocal points @ or land!ar&s -- hich punctuate the ur(an #a(ric and provide relie# to the hard sur#aces o# the (uilt environ!ent3 ,hey also create opportunities #or social interaction* i# they are located and designed to attract use, they can add su(stantially to the vitality o# do nto nAs street li#e*+ Whereas, the Baster -lanC ;and Dse Ele!ent (2000) set as o(Fectives the dedication o# '!ore par&land than is re8uested (y the -ar&s ? Recreation 6pen $pace (-R6$) -lan+ and the creation o# lin&ages to eGisting par&s hen ne par&land is dedicated* Whereas, the -R6$ -lan 2011-2015 assessed a need #or additional open space in the do nto n and stated the goal to 'Wor& ith the Do nto n Develop!ent "uthority to plan #or renovation and ac8uisition o# do nto n open space, including the develop!ent o# the li(rary lot* Whereas, ,he City Council reFected the develop!ent proposal that e!erged #ro! the R%- 974/ process (R-11-114) on 04/04/11, (ased on 8uestions a(out the via(ility o# the >aliant proposal #or a hotel and con#erence center and the level o# ris& that ould (urden the City*

Whereas, ,he City Council also stated (R-11-114) 04/04/11 that any #uture planning and proposals #or this (sur#ace level o# the ;i(rary ;ane) site shall include a ro(ust pu(lic process* Whereas, ,he DD" oversa construction o# the ;i(rary ;ane underground par&ing garage structure, co!pleted in 2012 and resulting in the net addition o# over 500 par&ing spaces, a ne , !id-(loc& through street, and including ele!ents o# in#rastructure to support #uture develop!ent either on or adFacent to the ;i(rary ;ane -ar&ing $tructure* Whereas, City Council authori)ed the DD" to develop a plan to redevelop do nto n city-o ned parcels including the sur#ace level o# the ;i(rary ;ane -ar&ing $tructure (R11-120) on 04/04/11* Whereas, ,he DD" #ollo ed City CouncilAs direction and i!ple!ented a process called Connecting Willia! $treet (CW$) including an online survey that received over 2,000 responses and !ultiple #ocus groups as ell as pu(lic !eetings* Whereas, ,he pu(lic input received (y the DD" through its CW$ process as strongly in #avor o# additional pu(lic open space in the do nto n* Whereas, ,he DD" presented its report to City Council on 1/14/1/, including the reco!!endation #or an eGpanded pla)a north along %i#th "venue at the CityAs discretion* Whereas, City Council too& no action on the DD" CW$ -lan, instead re8uested that the -ar& "dvisory Co!!ission (-"C) study and !a&e reco!!endations regarding do nto n par&s and open space* Whereas, ,he -"C #or!ed a Do nto n -ar&s $u(co!!ittee and conducted a process that included a survey that received 1,100 responses and !ultiple pu(lic !eetings* Whereas, ,he pu(lic input received (y the -"C as seventy-siG percent (71H) in #avor o# having !ore do nto n par&s and open spaces, strongly in #avor o# a large par&/open space, !ore than !ediu! or s!all, and indicated that the #irst choice site #or a pu(lic par& is the sur#ace level o# the ;i(rary ;ane $tructure* Whereas, City Council accepted the reco!!endations received #ro! the -"C (R-1///0) on 11/07/1/, adopted the! as guidelines including the reco!!endation that 'a par&/open space (e developed on the ;i(rary ;ot that ta&es advantage o# the #leGi(ility o##ered through te!porary closures o# ;i(rary ;ane, ,he si)e o# this space should eGceed the proposed allocated open space in the Connecting Willia! $treet study (5,000 s8uare #eet)*+ Whereas, City Council also approved -"CAs other reco!!endations including, (ut not li!ited to, the i!portance o# 'place!a&ing+ principles and the 'activation+ o# ur(an pu(lic spaces throughC pedestrian tra##ic, relationship to adFacent properties, activities desired (y the co!!unity, and #unding #or !aintenance and security, as ell as close consultation ith the "nn "r(or District ;i(rary (""D;), and #urther pu(lic input regarding the design and uses o# do nto n pu(lic open spaces* Whereas, ,he principles o# 'place!a&ing+ include the ele!ents cited (y the -"C such

as 'access and lin&age, co!#ort and i!age, uses and activities, and socia(ility,+ (ut the concept o# place!a&ing is (etter understood as an ongoing, iterative creative process that cele(rates the co!!unity through the trans#or!ative use o# a particular pu(lic place* Whereas, the -"CAs survey sho ed a pre#erence #or a co!(ination o# pu(lic and private #unding #or the ne ur(an par& and City CouncilAs vote to designate the speci#ic location #or a pu(lic ur(an par& ill ena(le #undraising e##orts to ard the costs o# the design, construction and !aintenance o# that par& to proceed* Resolved, ,hat City Council approve the reservation o# the site #or an ur(an pu(lic par& o# approGi!ately 12,000 s8uare #eet on the sur#ace o# the ;i(rary ;ane $tructure (ounded (y the %i#th "venue side al& on the est, the ;i(rary ;ane $treet cur( to the south, the estern entry to the central elevator to the east, and the southern cur( o# the service alley on the north (see t o related site plans)3 ,his portion o# the sur#ace o# the ;i(rary ;ane $tructure shall (e added to the -R6$ -lan and re!ain a City-o ned, pu(lic par&* Resolved, that the City ill encourage the creative use o# this space to co!!ence on an occasional (asis during the transition #ro! par&ing to pu(lic par& even (e#ore the ur(an par& design and installation or& is co!plete, and here(y re8uests that Co!!unity $ervices and the -ar& Depart!ent or& together ith DD" and the ""D; to encourage groups to reserve the space #or pu(lic activities including, (ut not li!ited to, cra#t #airs, (oo& #airs, #ood carts, #ine arts per#or!ances, and other activities and consider !odi#ication o# per!it re8uire!ents in order to eli!inate #ees #or those see&ing to put on pu(lic progra!s on the ;i(rary ;ane site* Resolved, that the City ill or& ith the developer o# the re!aining portion o# the ;i(rary ;ane site to ensure that the designs #or (oth spaces, an ur(an pu(lic par& and the adFacent develop!ent, co!ple!ent and support each otherAs success#ul uses* Resolved, ,hat all develop!ent on the ;i(rary ;ane site, hether pu(lic or private, ill proceed in close colla(oration ith neigh(oring properties and (usinesses including, (ut not li!ited to the "nn "r(or District ;i(rary, %irst Bartin Corporation, the Dniversity o# Bichigan Credit Dnion, the Inter-Cooperative Council, and the (usinesses #ronting on %i#th "venue and ;i(erty $treet3 -ossi(le goals o# this colla(oration includeC Reorientation o# the physical design and uses o# these adFacent properties so that they help to create pedestrian interaction ith the pu(lic par& on the ;i(rary ;ane $tructure, Creation o# pedestrian al& ays that connect the ;i(rary ;ane $tructure and pu(lic par& to ;i(erty -la)a, ;i(erty $treet and Willia! $treet* Discussion a(out incentives, such as pre!iu!s or su(sidies, that the City or DD" !ight o##er to encourage (oth physical reorientation and pedestrian access/ease!ents through adFacent properties, and Consideration o# possi(le Foint develop!ent on the ;i(rary ;ane $tructureAs re!aining (uild-a(le portion3 //11/14
