And it's my understanding that you performed your engineering responsibilities and came up with a cheaper way to solve the problem? That is correct. And the cheaper way would have been within the standards of your engineering profession or else you wouldn't have suggested it? Yes, the meeting that I suggested the method that I recommended as the engineer in charge of the storm water systems the theme of that meeting was we really don't have enough money to build this fire station at this site, so they looked at me and they said, we have to follow Jack Schaller, the Assistant Director at the time stated, well, Dan, what do we have to do per our standards at this site to take care of storm water? And what he meant

by that to me is if it was a developer building a commercial building there they had to follow certain standards and we would be following the same standards. As the City? As the City.

existing open ditch that runs diagonal across half of the property. That would normally be

a hassle, but we don't even need that area. We don't have to have anything on it and it's already an open channel. Now I think for

maintenance we just put in a concrete bottom in the bottom of the channel, we put an outlet structure at the downstream end where the water goes in an existing culvert under the intersection, that controlled structure meets my requirements for detention, and -Also gives you access to that canal? And the whole thing is totally open. And

then we also remove even more of the dirt around it to make it into kind of a pond area and then we replant new grass. That way it's

easy to mow, it was a pretty cheap project. Cheap as being what would that project have cost you from an engineer standpoint? I would say the outlet structure and the pipe

At that point I looked over and I noticed Mitch Randles was in the meeting. Who? Mitch Randles, the Fire Chief, and Jack Schaller, and there was some other folks

And Jack said - he looks over at me and he says, all right, he said, the City Manager wants the whole lot level and I said why? I

I'm telling you we've already met with Mark once, he wants the whole thing smoothed off. I said, well, for one thing it wouldn't be meeting our standards and for another you are adding a tremendous amount of money to this project and the first fifteen minutes of the meeting was complaining about the fact you don't have enough money to build it. This was Mitch Stephens? Mitch Randles. Randles. And they said, look, they said we will take your recommendations to Mark, we just don't think he will go for it. And they said what

the materials alone would be $120,000.00, and as it turns out when it was bid out and we purchased the box culvert it was $100,000.00. So you were wrong by 20 grand? Yeah. On the hard equipment? That's just the cost of the box culvert. Would it be a private contractor to do that? Well, it ended up to save money we used City forces. We still had to rent pieces of

equipment that were big enough to handle that large box culvert, specialized pieces of equipment for the compaction around it, and then also a lot of rock backfill materials. Can you give me a final cost in your estimate as you're sitting here today? I would estimate it as roughly as $150,000.00. Okay. So would it be fair to say that you

could have saved the City, your employer, $150,000.00 by designing this area the way you intended to design it? fair statement? Would that be a

I'm going to ask you to a reasonable degree of certainty within your profession, this is getting into your expertise, was your standard that you had designed it, would it have been according to the standards that you understand you to be bound by, the way you proposed to do it? The way I proposed to do it was within our standards, within meeting our own code. You said it was brought to Mr. Rohr. then occurred? At the end of the predevelopment meeting Jack and Mitch both said, look, we will try to get by with the open pond. And they came back What Yes, it would have saved

projects approved by the voters, and he said, yes, he said, I know, but Mark wants us to do that. So he said, but I did win one I said, look, we've got

concession from him.

to try to do something to replace this money and Mark said, we will sell in the future the remaining pieces of property there that we don't really need, we will sell that and the money from that sale will go back to help replace the cost of the box culvert. To

which I said I'm not an expert in the cost of property, but I can tell you you only have one driveway in and out off of Schifferdecker, you're sharing it with the Fire Department, and though it is on a corner of a nice intersection it's still a terrible lot and you're building it on very poor soil conditions that we would have to disclose. We couldn't sell it without disclosing the fact that you're basically going to be stuck with a pier design because we would get in trouble if we didn't. What's a pier design, sir? It's drilled piers for your foundation.

what took place at that meeting, I just know the result coming out of that meeting was we were building this very expensive box culvert system with the one caveat that the future sale of the remaining parcel would go back to help replace that. And they told you that was Mark's suggestion to use those funds? Yes. Now as I understand it the storm water fund is a separate tax? There's a sales tax, part storm water sales tax. Doesn't that require Council vote to approve a project under that? It does.

So you did this under order of Mark Rohr basically? Passed through Jack Schaller, but yes. What's Jack Schaller's position? He was the Assistant Director of Public

No, Jack wouldn't lie. How can you get hold of Schaller? He now works for Olson Associates Consulting Firm. Is he getting money from the City in his - I mean would that affect his -As a consultant, yes. So he may not want to talk about this? He may not. That's true.

Does he still get projects from Mark Rohr? Yes. Well, we selected, myself and the other

It is, and the thing that bothered me the most about it is I have to go and require if you were building an office in the City of Joplin I would require you to follow our -Yes. And no one wants to. No, of course not. It costs you extra money. Absolutely. In the interest of treating everyone the same I would make you do it. I had to make

typically I don't see anything that big on the general number and so, yeah, and it makes it hard. I've tried to put comments on each

purchase order so you know it went to the fire station. Because if somebody came in

and said, well, how much did the fire station cost, they wouldn't really know the number. Because that was not assigned to the firehouse? Yeah, unless an auditor was -Pretty sharp. -- really sharp and looked at the - if he was just looking at the purchases to that project number he'd have one number unless somebody told him, oh, by the way, all these purchase orders here which you have to look through one-by-one and kind of know which ones they are. Would you be able to get that purchase order for me, also? Yes.
