Rein in Government Spying: Reform the USA PATRIOT Act and Repeal Telco Immunity 
As Congress considers renewing sections of the USA PATRIOT Act that are set toexpire at the end of the year, we have a unique opportunity to press Congress for new civil liberties protections to shield ordinary Americans against governmentspying.Last month, ten US Senators introduced the perfect vehicle for reform of thesurveillance powers in the PATRIOT Act, as well as the much broader and moredangerous FISA Amendments Act (FAA), the warrantless surveillance law that waspassed by Congress last summer.The new bill, called the JUSTICE Act, would add essential new checks and balancesto a broad range of surveillance powers. In particular, it would reform the notoriousNational Security Letter power that allows the FBI, without court supervision, tosecretly demand that companies hand over your private phone and internet records.Even more importantly, the JUSTICE Act would add strong new privacy protectionsto the FAA, which vastly expanded the government's authority to sweep upAmericans' phone calls and emails without probable cause or meaningful courtreview.The JUSTICE Act would also repeal the immunity for telecom giants that illegallyassisted in the NSA’s warrantless wiretapping program. This would restore the rule of law and allow EFF’s suit against AT&T to continue so that the courts can do their joband rule on the legality of the surveillance.This is our first real shot at meaningful surveillance reform in a long time, but thingsare moving in the wrong direction very quickly. The Senate Judiciary Committeerecently reported to the Senate floor a PATRIOT renewal bill lacking almost all of thecritical reforms included in the JUSTICE Act. For those who care about civil liberties,the critical mission now is to ensure that the Committee's bill is amended to add
 
significant new privacy protections like those in JUSTICE, or defeated altogether, onthe floor of the Senate.It's time to fix PATRIOT once and for all, and now is our chance.
