JURY DEMAND Plaintiffs MT. DERM GmbH (“MT. DERM”) and NOUVEAU COSMETIQUE USA, Inc. (“NOUVEAU COSMETIQUE”), by and through their attorneys, for their Complaint against Defendant CONNECT, Inc. (“Defendant” or “CONNECT”), allege the following:
NATURE OF THE ACTION

This is an action for patent infringement arising under the patent laws of the United States (Title 35 U.S.C. §§ 1
et seq.
) based upon Defendants’ infringement of United States Patent  No. 6,505,530.

JURISDICTION AND VENUE

This is an action for patent infringement. The claims arise under the patent laws of the United States, Title 35 U.S.C. §§ 1
et seq
. 3.
 
This Court has subject matter jurisdiction over this action pursuant to 28 U.S.C. §§ 1331 (federal question jurisdiction) and 1338(a) (original jurisdiction under patent laws). 4.
 
This Court has personal jurisdiction over Defendant CONNECT because, on information and belief, CONNECT resides in and transacts business within this district and has committed acts of patent infringement in this district, including, without limitation, the importation, offer for sale and/or sale of the infringing products described herein. Venue is  proper in this district pursuant to 28 U.S.C. §§ 1391(b), 1391(c), and 1400(b), because CONNECT resides in and has a regular and established place of business within this district and  because CONNECT has conducted regular acts of infringement within this district by selling, offering to sell, and, importing the infringing products.
THE PARTIES

Plaintiff MT. DERM is a corporation organized under the laws of Germany having its  principal place of business at Gustav-Krone-Str. 3, 14167 Berlin, Germany. 6.
 
Plaintiff NOUVEAU COSMETIQUE is a corporation having a corporate office and  principal place of business at 111 North Orange Avenue, Suite 775 South Tower, Orlando, Florida, 32801. 7.
 
Plaintiff MT. DERM sells tattoo and permanent make-up application devices as well as needle cartridges used with these devices through a chain of distributors in the United States. It has all rights, title, and interest in United States Patent No. 6,505,530. 8.
 
Plaintiff NOUVEAU COSMETIQUE is the exclusive licensee under United States Patent No. 6,505,530 for products sold and used in the permanent make-up field. 9.
 
Upon information and belief, Defendant CONNECT is a Nevada corporation having its principal place of business at 5348 Vegas Drive, Las Vegas, Nevada 89108. Upon information and belief, CONNECT operates NPM USA and is doing business as NPM USA, which is also located at 5348 Vegas Drive, Las Vegas, Nevada 89108.

Upon information and belief, CONNECT maintains an internet website at http://npm-usa.com that advertises and sells infringing permanent make-up (PMU) application devices and needle cartridges for use with permanent make-up (PMU) application devices that it markets as the “ORON57 permanent makeup machine” and the “NPM Line of Needles,” including, without limitation, “Needle no. 1 white color with 0.25 mm diameter,” “Needle no. 1 120RL white color with 0.35mm diameter,” “Needle no. 1 140RL white color with 0.40mm diameter,” “Needle no. 3RL sky blue color with 0.25 mm diameter,” “Needle no. 3RS yellow color with 0.35 mm diameter,” “Needle no. 5RS color green with 0.30mm diameter,” “Needle no. 7RS color transparent with 0.30 mm,” “Needle no. 7M color purple with 0.30mm diameter,” and “Needle no. 11D color gray with 0.30mm diameter.” 11.
 
Defendant CONNECT markets and sells devices for applying permanent make-up (PMU) and/or tattoos and needle cartridges for use with such devices that compete with products manufactured, marketed, and sold by Plaintiffs and that are the subject of this action.
THE PATENT-IN-SUIT

On February 12, 2002, Application No. 10/072,991 was filed before the United States Patent Office (“USPTO”) as a continuation of Application No. 09/671,650. On January 14, 2003 the USPTO duly and legally issued U.S. Patent No. 6,505,530 (hereinafter “the ‘530 Patent”) entitled “Ink Application Device for Tattooing or for Making Permanent Make-Up.” A true and correct copy of the ‘530 Patent is attached hereto as Exhibit A. 13.
 
The named inventors of the ‘530 patent are Frank Adler, Walter Lisee and Gerhard Türk. 14.
 
The inventors assigned all right, title, and interest in the ‘530 Patent to Plaintiff MT. DERM. 15.
 
Plaintiff NOUVEAU COSMETIQUE is the exclusive licensee of rights to the ‘530 Patent in the United States in the permanent make-up field. 16.
 
The ‘530 Patent is now and has been at all times since its date of issuance, valid and enforceable.
