James Obergefell, David Michener, and Robert Grunn move for leave to file the concurrently submitted
amicus
memorandum in response to Defendant-
Appellants’
Petition for Initial Hearing En Banc.
 Amici
 are Plaintiff-Appellees in
Obergefell v. Wymyslo
, Case No. 14-3057. In that case the Court considered the plight of married same-sex couples when one
dies. The plaintiffs requested that the decedent be listed as “married” on the death certificate and requested that the survivor be listed as the “surviving spouse.” The

State denied the relief since Ohio does not recognize same-sex marriages from other states. The District Court held that the refusal to recognize same-sex marriages on death certificates was unconstitutional and ordered relief for the couples and for the funeral director plaintiff. The appeal is pending. No stay has  been requested or granted. The case raises similar but not identical issues to the instant case and may well be impacted by the instant case.
