Tax: October 27, 2009 The Constitutional Court has ruledthat enterprise operating in the Madeira offshore zone,where earnings are tax-exempt, are not obliged to makeupfront payments on account (pagamento especial porconta (PEC) – the annual advance instalment oncorporation tax. The Court said PEC was designed to stoptax evasion not to levy tax on companies that are taxexempt. It said Inland Revenue’s efforts to collect thispayment in the zone were unconstitutional under No 9Article 98 of the Corporate Tax Code.
