STEVENSON: Mr. Chief Justice, and mayit please the Court:Joe Sullivan was 13 years of age when he wasarrested with two older boys, one 15, one 17, chargedwith sexual assault, ultimately convicted, and sentencedto life without parole.Joe is one of only two children this age whohave ever been sentenced to life without parole for anon-homicide, and no child has received this sentencefor non-homicide in the last 18 years.JUSTICE GINSBURG: Mr. Stevenson, there is aserious question before we get to the particulars ofthis case. Justice Kennedy suggested it in the lastargument.This -- the time ran out for post-convictionrelief in 1993, and this petition is brought in 2007.There is a two-year statute of limitations. Floridasaid there is a procedural bar; we don't get to themerits of this case.3
