itsprovisionsbytheCity.Includedarethefollowingfivefactors:(1)TheCityhasimplementedaNewPlanforpublicemploymentpractices,includingprocedurestoensurecompliancewiththeNewPlanandtoidentifyinstancesofnon-compliance;(2)TheCityhasactedingoodfaithtoremedyinstancesofnon-compliancewiththeAccordandpriorCourtordersthathavebeenidentified,andpreventarecurrence;(3)TheCitydoesnothaveapolicy,customorpracticeofmakingemploymentdecisionsbasedonpoliticalfactorsexceptforExemptPositions;(4)TheabsenceofmaterialnoncompliancewhichfrustratestheAccord'sessentialpurpose.TheMonitorandtheCourtmayconsiderthenumberofpost-AccordcomplaintsthattheInspectorGeneralfoundtobevalid.However,technicalviolationsorisolatedincidentsofnoncomplianceshallnotbeabasisforafindingthattheCityisnotinsubstantialcompliance;and(5)TheCityhasimplementedproceduresthatwilleffectlong-termpreventionoftheuseofimpermissiblepoliticalconsiderationsinconnectionwithCityemployment.(Dkt.642,§LG.8.)3.Overthepastseveralyears,theCityhasdevelopedandimplementedpoliciesandprocedurestohelpensurethatunlawfulpoliticalreasonsandfactorsarenotandwillnotbeconsideredintheCity'semploymentactions.TheCourthasapprovedtheCity'sGeneralHiringPlan(Dkt.2007,2279),andHiringPlansfortheChicagoPoliceDepartment(Dkt.2466)andtheChicagoFireDepartment(Dkt.2568).TheCityhasfurtherrevisedtheseHiringPlanstoaddressissuesthataroseastheHiringPlanswereimplemented.CopiesoftheHiringPlans,asamendedthroughthedatehereof(collectivelythe HiringPlans ),areattachedasExhibits2,3and4fortheCourt'sreviewandapproval.4.TofacilitatemonitoringoftheCity'scompliancewiththeHiringPlansandinvestigationsintoallegedviolationsofthoseHiringPlans,theCityandtheOfficeof

theInspectorGeneralfortheCityhaveagreedtoaprotocolforaddressingclaimsofattorney-clientprivilegeandworkproductprotection.AcopyoftheProtocolisattachedasExhibit5,hasbeenadoptedbytheCityandthePartiesrequestthatitbeapprovedbytheCourtaspartoftheordersoughtbythisMotion.5.TheCitysubmitstheHiringPlansandProtocolasevidencethatithasimplementedproceduresthatwillcontinueaftertheAccordisterminatedtoeffectlong-termpreventionofunlawfulpoliticaldiscrimination.6.TheAccordprovidesthatpriortoafindingofSubstantialCompliancetheCommissioneroftheDepartmentofHumanResourcesandtheMayorwillsignaCertificationofSubstantialCompliancestatingthat,afterappropriatereviewandinquiry,theCommissionerandtheMayorbelievethattheCityisinSubstantialCompliancewiththeAccord.Accord,§LG. and2.CopiesofsuchcertificationsareattachedheretoasExhibits6and7.7.BaseduponreportsbytheMonitorandtheInspectorGeneral,andreviewoftheHiringPlans,theProtocol,andtheCity'sconductinthelastseveralyears,PlaintiffsagreethattheHiringPlansandProtocolcanreasonablybeexpectedtosatisfytheobjectivesoftheAccord,andthattheCityhasmettherequirementsoftheAccordforafindingofsubstantialcompliancewiththeAccord.8.ThePartiesandtheMonitoragreethattheCity
