KNOBLACH APPEALS COURT OF APPEALS RULING TO SUPREME COURT Former Rep. Jim Knoblach (R St. Cloud) announced today he is appealing a Minnesota Court of Appeals decision on the new $90 million Legislative Office Building to the state Supreme Court. The Court of Appeals held today that Knoblach needs to deposit $11.07 million on May 27 if Knoblach chooses to go forward with his lawsuit, as compensation to the state for construction delays in the event Knoblach is unsuccessful. I am not a member of the so-called one percent, and I dont have $11 million to post as bond, said Knoblach. With this decision, the Court of Appeals has rendered meaningless the single subject provision of the Minnesota Constitution on which this lawsuit was based. If this decision stands, it will have serious long term negative consequences for the way state law making is done, by encouraging logrolling the Constitution was written to prevent. I thus feel I have no choice but to make one last appeal to the Supreme Court. The Court of Appeals did allow for an expedited hearing on the issue on June 10. In response Knoblach said: The Courts decision to allow for an expedited hearing June 10, but require me to post an $11 million bond May 27 to get to the June 10 hearing, makes no sense, since I cant post such a bond. The buildings construction is not scheduled until to being until July 1. The Court should have allowed the June 10 hearing without a bond, and rendered a decision by July 1. Knoblach is the endorsed Republican candidate for House District 14B. Several weeks after he filed this lawsuit, former Republican Representative King Banaian, who had been defeated in the last election, announced he would not be running. A few months later Knoblach announced his candidacy. While I am disappointed in this decision, I look forward to holding my opponent Zachary Dorholt accountable for his vote for this $90 million boondoggle, said Knoblach. Hopefully the State Supreme Court will take this case, eliminate the bond requirement, and uphold the Constitution.
