Prohibition is brou'ht un!er Rule BA of the Rule of ourt. n!er the circu%stances obtainin' in this case, herein Petitioners have no plain, spee!&, an! a!e=uate re%e!& in the or!inar& course of la" "hich "ill  pro%ptl& relieve herein Petitioners fro% the in+urious effects of the acts of the public respon!ents, 'iven the circu%stances obtainin' in this case. B.Petitioners invoe this case as an eception to the rule on hierarch& of courts. *n the case of Ca Du'al-Dlaan $ribal #ssociation, *nc., et al. vs. <ictor (. Ra%os, et al. :G.R. No. 127882, anuar& 27, 2EE4;, the upre%e ourt eluci!ate! the follo"in' !octrine on the proce!ural =uestion on the rule on hierarch& of courts06$his ourt has consistentl& en+oine! liti'ants to respect the hierarch& of courts. #lthou'h this ourt has concurrent  +uris!iction "ith the Re'ional $rial ourts an! the ourt of #ppeals to issue "rits of certiorari, prohibition, %an!a%us, =uo "arranto, habeas corpus an! in+unction, such concurrence !oes not 'ive a part& unrestraine! free!o% of choice of court foru%. $he resort to this ourts pri%ar&  +uris!iction to issue sai! "rits shall be allo"e! onl& "here the re!ress !esire! cannot be obtaine! in the appropriate courts or "here eceptional an! co%pellin' circu%stances  +ustif& such invocation. Fe hel! in People v. uares%a that0# beco%in' re'ar! for +u!icial hierarch& %ost certainl& in!icates that petitions for the issuance of etraor!inar& "rits a'ainst first level :6inferior9; courts shoul! be file! "ith the Re'ional $rial ourt, an! those a'ainst the latter, "ith the ourt of #ppeals. # !irect invocation of the upre%e ourts ori'inal +uris!iction to issue these "rits shoul! be allo"e! onl& "here there are special an! i%portant reasons therefor, clearl& an! specificall& set out in the petition. $his is establishe! polic&. .$he repercussion of the issues in this case on the Philippine %inin' in!ustr&, if not the national econo%&, as "ell as the novelt& thereof, constitute eceptional an! co%pellin' circu%stances to +ustif& resort to this ourt in the first instance.9 :%phasis supplie!;*n the instant Petition, the serious an!
