Section 544 allows the trustee to avoid a transfer of aninterest in real property of the debtor to the extent a bona fidepurchaser of the property may avoid the transfer “without regardto the knowledge of the trustee or of any creditor.”2U.S.C. § 544.

II. FACTUAL BACKGROUND
The following facts are undisputed.Debtor, Matthew Giroux, executed a mortgage in favor of MERSon December 19, 2005, with respect to property located at 949Somerset Avenue, North Dighton, Massachusetts. Theacknowledgment appears on the same page as the Debtor’s signatureon the mortgage and that of the witness, who was also the notarypublic completing the acknowledgment. The acknowledgment setsforth the following:
