hrough it’s representativebody, FEFAC, feed manufac-turers consider the EUlegislative framework an essentialelement in meeting the Lisbonobjectives for improved competi-tiveness of the livestock chain whileproviding the keys to innovationfor producing better, safer andmore sustainable feeds.
The regulation repeals several existingEU Directives and combines mandatory requirements with co-regulation obligationsinvolving European representatives of feedbusiness sectors (stakeholders).
Key mandatory requirements
Declaration of feed materials: Among thekey features, the elimination of the mandatory percentage declaration of feed materials on the compound feed label constitutes themost significant improvement in the protec- tion of feed industry know-how. For thesake of transparency, feed manufacturers willbe nevertheless required, without prejudiceunder the Directive on the enforcement of intellectual Property Rights, to provide further compositional information within a range of +/-15 percent of the value according to thefeed formulation on customer’s request.Use of claims: The regulation alsoforesees the possibility to make claims for compound feed and feed materials on thecondition that the claim is objective, prop-erly substantiated and understandable by  the customer of the feed. In case the latter is in doubt of the truthfulness of a claim, hecan bring it to the attention of the compe- tent authority which may either consider itas misleading, if the claim is not sufficiently substantiated, or ask the opinion of the EUCommission which may also request theEuropean Food Safety Authority (EFSA)for its opinion.
Issues subject to co-regulation
Pending the publication of the regulationin the Official Journal of the European Unionin September 2009, FEFAC has already established a ‘to-do list’ on a number of issues subject to co-regulation, and in par- ticular with regard to the developmentof a Community Code of Good Practicesfor the Labelling of Compound Feed andProduct claims and the development of theCommunity Catalogue of Feed Materials.Community Catalogue of Feed Materials:This voluntary and non-exhaustive Catalogueof Feed Materials shall be composed of thecurrent EU non-exhaustive list of feed mate-rials as well as the existing list of ‘bio proteins’for which the pre-authorisation procedure isnot required anymore and shall be reviewedby stakeholders in order to better reflect thefeed formulations used by feed manufactur-ers throughout the EU.These draft amendments would there-fore be subject to the approval of theStanding Committee on the Food Chain andAnimal Health – Section Animal nutrition.Internet register of notified feed materials:For the sake of transparency, the final textalso foresees a notification procedure of  those feed materials that are placed for thefirst time on the market and that are not yetlisted in the Catalogue.Such notified feed materials shall be firstreceived by stakeholders and then trans-ferred to an internet register to be updatedon a regular basis.Feed chain in action: To this end, EU feedchain partners decided to adopt a pro-activeapproach by establishing a dedicated jointplatform in charge of reviewing and adapting the current EU list of feed materials on thebasis of the existing 12 categories of feedmaterials.This platform gathers together approxi-mately 30 EU organisations including theEuropean Flour Millers Association, FEDIOL,AAF, COCERAL, FERM and FEFAC. Theplatform has already met several times andaims to accelerate the working processin order to finalise a first revision of theCatalogue of Feed Materials. The practi-cal discussion on the management of theinternet register will take place at a later stage, once the first version of the revisedCatalogue is almost finalised.All feed business operators shall comply with the new labelling rules 12 months after its entry into application, which is expected to be in September 2010.
