Appellants Christopher Rich and the State of Idaho respectfully request that  Nos. 14-35420 and 14-35421 be consolidated for all future purposes. Both appeals are from the same final judgment and present the same issue: the validity of Article III, Section 28 of the Idaho Constitution and Idaho Code § 32-201 – which limit civil marriage to the union of one man and one woman – and the prohibition against recognition of same-sex marriages entered into in another jurisdiction under Idaho Code § 32-209. On May 20, 2014, this Court entered a stay in both appeals of the district court’s injunction prohibiting Appellants Rich and Idaho and the Appellant in No. 14-35420, Governor C.L. “Butch” Otter, from enforcing those  provisions. Consolidation will facilitate expeditious resolution of these appeals and avoid unnecessary duplicative filings by this Court and the parties. Respectfully submitted, HON.
