DEFENDANTS OPPOSITION TO MOTION FOR SUMMARY JUDGMENT
BY PLAINTIFFS WELLES AND BEAUREGARD

For the reasons already briefed (Docs. 84-1, 102, 108, 120), defendants oppose
the summary judgment motion of plaintiffs Welles and Beauregard seeking the
right to secure [a] marriage license to marry within the State of Louisiana under
the Equal Protection and Due Process Clauses. Doc. 117. Further, there being no
material fact disputes, defendants ask the Court to enter summary judgment
against plaintiffs Welles and Beauregard on these claims pursuant to Federal Rule
of Civil Procedure 56(f). Finally, believing further oral argument is unnecessary,
defendants oppose plaintiffs request for oral argument. Doc. 118.

6. Defendants admit that Louisiana reserves all legal benefits, responsibilities,
incidents, and effects of civil marriage only to man-woman couples and does
not allow civil marriage between persons of the same sex. LA. CONST. art. XII,
15; LA. CIVIL CODE arts. 86, 89, 96, 3520(B). Defendants, however, deny that
refusing to allow same-sex marriages in Louisiana violates any right of
plaintiffs under the federal Equal Protection or Due Process Clauses.
