IN REMOVAL PROCEEDINGS
ITERLOCUTORY APPEAL
Decision of the Board oflmmigration Appeals
Date: JUN l 0 2014
ON BEHALF OF RESPONDENT: Troy J. Mattes, Esquire
ON BEHALF OF DHS: Jeffey F. Boyles
Assistant Chief Counsel
The Depament of Homeland Security has fled a interlocutory appeal regarding the
Immigration Judge's April 22, 2013 decision. We note that our records refect that a dispositive
order of removal has not yet been entered by the Immigration Judge in these proceedings. To
avoid piecemeal review of the questions which may arise in the course of proceedings befre us,
this Board does not ordinarily entertain interlocutory appeals. See Matter of Ruiz-Campuzano,
17 I&N Dec. 108 (BIA 1979); Matter of Ku, 15 I&N Dec. 712 (BIA 1976); Matter of Sacco,
15 l&N Dec. 109 (BIA 1974). We have, however, on occasion rled on the merits of
interlocutory appeals where we deemed it necessary to address imporant jursdictional questions
regarding the administration of the immigration laws, or to correct recurring problems in the
handling of cases by Immigration Judges. See, e.g .. Matter of Guevara, 20 l&N Dec. 238
(BIA 1990, 1991), and cases cited therein; Matter of Dobere, 20 I&N Dec. 188 (BIA 1990). We
do not fnd that the circumstances of this case present a recurring problem involving a signifcant
issue in the administation of the immigration laws which could not be considered on appeal
during the regular course of froceedings. Accordingly, the record is reted to the Immigration
Court without further action.
1 The Depaent of Homeland Security may move to recalendar proceedings befre the
Immigation Court i the future if appropriate.
