ORAL ORDER: Having reviewed the materials submitted relating to a dispute over the proposed

protective order (D.I. 161, 164), IT IS HEREBY ORDERED that Laird's proposed prosecution bar, extending
to post-grant proceedings, is adopted. Good cause for the requested protection exists, at least to deal
with the risk of the patentee strategically narrowing the scope of its claims based on (even
inadvertently) information it learns from Laird's highly confidential information. Patentee has provided
no evidence that it will be unduly prejudiced by Laird's proposed bar, particularly as there is no evidence
that current litigation counsel has ever participated in prosecuting patents for Plaintiff. Hence, the
balance of interests favors Laird. The parties shall submit a form of protective order, consistent with
today's ruling, no later than August 5, 2014. The teleconference scheduled for August 1, 2014 is
