JAKES: Mr. Chief Justice, and may itplease the Court:The Federal Circuit's rigid and narrowmachine-or-transformation test for all patent-eligiblemethods should be reversed. The requirement that anyand all methods must be either tied to a particularmachine or transform specific subject matter doesn'tfind any basis in either the language of Section 101 oranywhere in the patent statute.It's not required by this Court'sprecedence, and it's contrary to the establishedprinciple that Section 101 should be read broadly toaccommodate unforeseen advances in the useful arts.There are recognized exclusions from Section 101 fromthat broad language, such as laws of nature, naturalphenomenon, and abstract ideas. Those may not bepatented.3
