ADDENDUM
B1. Probable Cause Statement
ON 07/21/14 AT APPROXIMATELY 0800 HOURS, THE DEFENDANT WAS IN A VERBAL ARGUMENT
WITH HIS WIFE, WHILE INSIDE THEIR SHARED RESIDENCE LOCATED AT 8050 S. POINTE
PARKWAY WEST, APARTMENT 2057, PHOENIX, ARIZONA. THE ARGUMENT TURNED PHYSICAL
WHEN THE DEFENDANT ATTEMPTED TO KISS HER AND REMOVE HER CLOTHING. THE VICTIM
TOLD THE DEFENDANT SEVERAL TIMES TO "STOP." WHEN HE CONTINUED, SHE BIT THE DE-
FENDANT'S LIP. THIS WAS DONE TO GET AWAY FROM HIM AND STOP HIS ADVANCES. AFTER
THE VICTIM BIT THE DEFENDANT'S LIP, HE HEAD-BUTTED HER IN THE FACE, WHICH SHE
LATER LEARNED HAD CAUSED A NASAL BONE FRACTURE AS A RESULT OF THE HEAD BUTT. THE
PHOENIX POLICE DEPARTMENT WAS CALLED BY A WITNESS REFERENCE THE LOUD ARGUING.
UPON OFFICERS ARRIVAL VICTIM REPORTED SHE WAS ENGAGED IN A VERBAL ARGUMENT OVER
THE TELEPHONE WITH A FAMILY MEMBER. SHE ADVISED SHE AND HER SON WERE THE ONLY
OCCUPANTS IN THE RESIDENCE. AFTER THE OFFICERS LEFT THE VICTIM FLED WITH THEIR
SON. SHE LATER RETURNED AFTER THE DEFENDANT TEXT HER A PICTURE OF A KNIFE AND
STATED HE DID NOT WANT TO LIVE ANYMORE. IT WAS LATER LEARNED BY INVESTIGATORS
THE DEFENDANT WAS HIDING INSIDE THE RESIDENCE WHEN OFFICERS RESPONDED ON THE
INITIAL CALL. SHE SAID HE HAD THREATENED TO KILL HIMSELF IN FRONT OF HER AND
THEIR CHILD IF SHE ALERTED THE POLICE TO THE ASSAULT, SO SHE DENIED TO THE OF-
FICERS THAT HE WAS PRESENT AND THAT SHE HAD BEEN ASSAULTED. ON 7/22/14, AT AP-
PROXIMATELY 1600 HOURS, ANOTHER ARGUMENT ENSUED BETWEEN THE PARTIES. THIS ARGU-
MENT TURNED PHYSICAL WHEN THE DEFENDANT PUNCHED HIS WIFE ON THE LEFT SIDE OF HER
FACE WITH HIS RIGHT CLOSED FIST. HE ALSO BEGAN PUNCHING THE WALLS CAUSING VIS-
IBLE DAMAGE. THE DEFENDANT THEN PICKED UP A SHOE AND THREW IT, STRIKING THEIR 17
MONTH SON IN THE STOMACH. THE VICTIM TOLD THE DEFENDANT SHE WAS CALLING THE PO-
LICE. HE GRABBED HER CELL PHONE AND THREW IT TO THE GROUND FROM THE SECOND STORY
RESIDENCE. AS THE DEFENDANT WAS FLEEING, WITNESSES REPORTED SEEING HIM THROW THE
CELL PHONE AND HEARING THE VICTIM YELL "HE FUCKING HIT ME; I'M CALLING THE PO-
LICE". WITNESSES OBSERVED THE VICTIM HOLDING HER FACE AND THE TODDLER CHILD
WHILE STATING THE ABOVE. WITNESSES ALSO SAW SWELLING AND DISCOLORATION TO THE
LEFT SIDE OF HER FACE. THE VICTIM BEGAN PACKING BELONGINGS WITH THE NEIGHBORS'
HELP AND FLED THE STATE. AFTER FLEEING, THE VICTIM REPORTED THE INCIDENT TO THE
PHOENIX POLICE DEPARTMENT BY TELEPHONE AS SHE NOW FELT SAFE. THE VICTIM'S MEDIC-
AL RECORDS WERE LATER OBTAINED, WHICH CONFIRMED SHE SUSTAINED A "CLOSED FRACTURE
NASAL BONE". THE CHILD DID NOT SUSTAIN PHYSICAL INJURY. THE VICTIM LATER
PROVIDED THE INVESTIGATOR WITH PHOTOS DEPICTING DAMAGE TO THE INTERIOR WALL OF
THE RESIDENCE AND TEXT MESSAGES WHICH INCLUDED A PICTURE OF A KNIFE, ALONG WITH
THREATS OF SUICIDE. ON 09/17/14, THE DEFENDANT WAS INTERVIEWED AND ADMITTED TO
THE INCIDENTS INVOLVING HIS WIFE BUT DENIED ANY PHYSICAL ASSAULT BY HIM. THE DE-
FENDANT DID ADMIT TO PUNCHING THE WALL, THROWING THE PHONE, AND HIS WIFE BITING
HIM ON THE LIP. HE ALSO ADMITTED TO HIDING IN THE BATHROOM WHEN PHOENIX POLICE
OFFICERS RESPONDED ON 07/21/14 AND SENDING A PICTURE OF A KNIFE WITH THREATS OF
SUICIDE.
