Potential Pitfalls

The E-Verify system is only as good as the information entered into it. At this point, the system has no way to alert companies if an employee is using some- one else's identification. Also, some con- tractors are concerned that the database Special Catering/Events Section contains erroneous information, and may tag someone as ineligible to work when they are actually legal. Others worry that making usage mandatory will cause the system to be overwhelmed with us- ers, possibly shutting it down, since there are almost 500,000 companies registered in the government's Central Contractor Registration Database who will have to use the E-Verify system. The Executive Order also includes a provision for penalties to be imposed against companies found to employ un- documented or unauthorized workers. However, it's not yet clear whether companies that used the system to determine that an employee was unau- thorized will still face penalties, if they then refuse to employ the individual. In summary, ifyou're doing business with the government, you'll need to register and use the E-Verify system. In our experience, it's easy to use and provides instant confir- mation of a new employee's work status.
