CERTIFICATION FOR DETERMINATION OF PROBABLE CAUSE
That Detective Steven Hoover is a Police Officer with the Bellevue Police
Department and has reviewed the investigation conducted by the Bellevue Police
Department, Case Number 13-54055. There is probable cause to believe that David Richard
Schultz II, date of birth 5/4/82, committed the crime of manslaughter second degree,
9A.32.070(1).
On 11/5/13 at about 0630 hrs. Bellevue Police and Fire Departments responded to the Hampton
Green Apartments at 4505 148th Ave. NE, building KK, Bellevue, King County, Washington, for
multiple reports of explosions and fire. The Hampton Green complex contains several buildings
of eight to ten apartments and 4505 148th Av. NE is the actual address of building KK. When
the first units arrived on the scene, they found building KK fully engulfed in flames.
During the course of the investigation I found that Justin Eide, Richard O'Neil, Alexandra
Stanescu, and Bellevue Officer Slusser had previous contacts with tenants of building KK.
Justin Eide, who is an employee of Alegis Construction, reported:
He works for Alegis Construction and they are replacing windows throughout the
Hampton Green Apartments. His current job is to document all pre-existing damage to
drywall, windows, or anything in the units. Around 10/18/13, he was not sure of the
exact date, he went into building KK in the Hampton Green Apartments, and saw a man
with long hair, wearing a beanie cap, sitting on the floor of the apartment making
something with a glass device with tubes running to a compressor that was outside on
the balcony. He asked the subject if he was making hash and the subject said yes, it's
for his dispensary. He smelled butane and marijuana. The glass device was about eight
inches in diameter and had a brown material in it. He also saw a big jar full of green
leaves that smelled like marijuana. He also saw two other subjects in the apartment,
one was thirtyish with red hair and a beard, the other was twentyfive, skinny, with short
dark hair. He reported what he saw to the apartment management.
Richard O'Neil, who is the maintenance supervisor for the Hampton Green Apartments,
reported:
They are replacing all the windows inthe complex. About three weeks beforethe fire at
building KK, he was contacted bya subcontractor named Justin about the tenants in
building KK, apartment 202, having some equipment on theirdeckwith a wire or a hose
running into the apartment through the deckdoor. Theyhad previously asked all tenants
to remove everything from their decks because they have to cover everything on the
decks. Justin also told him that he thought the tenants were making hash.
Hewent to KK-202 and knocked but got no response. He put his key into the lock and
someone yelled, don't open the door. About thirty seconds later a subject came and
opened the door a very small amount ofthe way. When he first walked upto apartment
KK-202 he couldsmell a strong odor of marijuana. When the door was open, he got a
blast ofmarijuana smell. He could also smell a chemical smell from the apartment that
he could not identify. Thesubject who opened the doorwas a white male, maybe
middle eastern. Hetold the subject aboutthe deck. Hewalked around to wherethe
deck for KK-202 was located and he saw, what looked like to him, a small compressor.
The compressor was pulled into the apartment.

f Alexandra Stanescu, who is the manager for the Hampton Green Apartments, reported:
Their records show that Daniel Strycharske rented apartment KK-202 in April.
Strycharske told them that he wanted his friend Jesse Kaplan to live with him but Kaplan
was not on the lease. They later received rent checks from Kaplan.
On 10/17/13 they called the Bellevue Police because a window contractor named Justin
Eide told them that he saw a subject in KK-202 making hash.
Bellevue Police Officer Slusser reported:
On 10/17/13 at about 1430 hrs. he was dispatched to the Hampton Green Apartments
for possible drug activity. He spoke to assistant manager Courtney Callahan who told
him that a window contractor told them that he observed the occupants of apartment KK-
202 cooking hash oil. He went to KK-202 and the door was opened by a white male with
a large beard, wearing a beanie cap, who said his name was Jesse Daniel Kaplan. He
saw two other subjects in the apartment. One was a white male, who appeared to be
tan possibly Asian or Hispanic, with long dark hair with a hat on, who verbally identified
himself as David Richard Schultz. The other subject was a male, tall and skinny and did
not identify himself.
While standing at the door to the apartment, he could smell "raw marijuana". He talked
to the subjects about marijuana and hash, both Kaplan and Schultz told him that they
had medicinal marijuana cards, which they later showed him. He also saw a small
metallic can of what he believed to be butane fuel. He also saw a small cylindrical
device resembling an air pump. He asked Kaplan about the can and Kaplan became
J^ somewhat verbal with him asking ifthe item was contraband. He told the subjects about
* amaintenance worker believing that they were producing hash oil. The subjects said
theywere not producing hash oil. Schultz said that he and his family owned a medicinal
marijuana facility where hash oil was legally dispensed.
He told the subjects that producing hash oil in the apartment would be a violation oftheir
rental agreement. He told themabout the potential volatility of the process and the
possibility of an explosion or fire stemming from it. The subjects again told him that they
were not producing hash oil.
The following are reports from residents ofthe Hampton Green Apartments and first responders
for the day of the fire/explosion.

On 11/5/13 at about 0618 hrs., she remembers looking at her clock, she was in her
apartment when there felt like an extreme burst like an explosion. It sounded like a
bomb going off. At first she thought it was an earth quake. Then she heard aguy yell
fire. Sheopened her front door and saw flames shooting up the staircase. Shewent
back inside to grab something and then she saw flames coming through her front door.
Smoke started coming into her apartment so she got onher hands and knees and went
into her bedroom. She opened upher bedroom window and yelled for help. Two guys
were outside but they couldn't find a ladder toget her out. She ended up crawling out
the window and dropping the three stories to the ground. She fractured her left leg, it's
destroyed from the knee down. She broke her right ankle, fractured the L-1 in her spine,

I On 11/5/13 sometime around0600 to 0630 hrs. she woke up to a loud explosion and a
crash. She thought the bathroom from the apartment above her crashed down into her
bathroom. She and her husband started running out and she saw fire and saw a guy,
who she thinks is her neighbor, walking around in her living room. She later realized that
the wall between their apartments no longer existed. She just saw a quick glimpse of
him. He had a beard and a cap on. Her husband couldn't get the front door open so
they went out on the deck. She jumped from the second floor deck and fractured her
foot.
, who is a tenant in with his wife , reported:
On 11/5/13 at about 0615 hrs. he heard a loud explosion that woke him up and he
sensed that the bathroom above theirs had crashed into their bathroom. They ran out of
their bedroom but he couldn't get the front door open. They went out on to the deck and
jumped off. He wasn't wearing his glasses at the time so most things are blurred but he
could see flames.
Lukasz Andrzejeski, who is a tenant in KK-304, reported:
On 11/5/13 at about 0622 hrs. he was lying in bed when there was a large explosion that
lifted him off his bed. It took him about twenty seconds to put on some shoes and
clothes and he ran out his apartment. Outside he saw the wall, where door was
supposed to be, was missing on apartment belowand to the North (202) of his. He also
saw fire was rapidly spreading. He could see into the apartment belowand he could see
fire everywhere. The fire was originating from the apartment. He said it looked like the
fire was being rapidly fueled by something. He hasn't met the peoplein KK-202 but he
^ has seen aguy with ared beard. He also has heard abuzzing noise from their
^ apartment afew times, like agenerator.

On 11/5/13at about 0625 hrs. she heard a big blast sort of sound and then she started
hearing fire alarms going off. She got up, opened her door and she sawthatthe
apartment diagonally opposite hers (202) was pretty much in flames. She was frantic at
the time but she remembers being ableto see into the apartment and could see the fire
place and could see flames.

On 11/5/13 at about 0620 hrs. she heard a blast and the apartment shook. Her
roommate opened the front door and she could see fire in the apartment
that is diagonally opposite their apartment (202). Shethinks the door tothe diagonally
opposite apartment was open because shecould see the fireplace and a large amount
of fire.
Rustam Hashimov, who is a tenant in KK-302, reported:
On 11/5/13 sometime around 0600 to 0615 hrs. he was woken by an explosion. Hewas
sleeping in the back bedroom and after the explosion the outside walls ofthe bedroom
had opened up and the floor ofthe bedroom was sloping down towards the ground. A
few moments after theexplosion he saw smoke and flames in the living room of his
apartment. He climbed out of the openwall of his apartment.

On 11/5/13 at about 0610 hrs. he was in his apartment when he heard a large explosion.
He went into his bedroom and looked out the window and saw that the unit across from
theirs, on the ground level, was completely destroyed. He saw a man come out of the
destroyed apartment with burned clothes on. He saw that within three or four minutes
flames from the lower apartment moved to the upper unit.
Cassie Howard, who is a tenant of KK-201, reported:
On 11/5/13 at about 0620 hrs. she left her apartment and went to work at the Pro Club
which is next to the Hampton Green. At about 0628 hrs. she heard a large explosion that
rattled the walls of the Pro Sports Club. About an hour later her manager told her that
her apartment was on fire. When she left that morning, she noticed that the lights were
on in living room and adjoining bedroom of the apartment that caught fire.
She has only briefly meet the two males that moved into the apartment. She has seen a
generator on their back patio that has been running constantly since June. About a
week before the fire, she was walking by their apartment when she saw several large
marijuana plants inside the closet of the bedroom closest to the living room. She could
also see heat lamps over the top of the plants.
Bellevue Police Officer J. Moriarty reported:
On 11/5/13 at about 0630 hrs. he responded to the Hampton Green Apartments for a fire
call. When he arrived at the apartment he contacted an elderly female named Nancy P.
Campbell on the west side of building KK. Campbell told him that she lived in KK-104
and at about 0610 hrs. she was awoken by an explosion coming from above her
apartment. Campbell said that the building caught fire and beganto collapse. She said
that she was evacuating her apartment when she was struck in the head by falling debris
and fell to the ground. Campbell said that she believed her right hip was broken.
Kirkland Firefighter Kent Moffitt reported:
On 11/5/13 he and his partner Jeffery Childs wereworking as Kirkland Aid 22 when they
were dispatched tothe Hampton Green Apartments. Theywereassigned to assist an
older lady who said her name was Nancy Campbell. Campbell told him that she heard
an explosion and her apartment was on fire so she tried quickly to get out. Campbell
saidthat on herway out she tripped and fell and hurt her hip. Campbell was very
descriptive of the fire above herand he could see burn marks on herrobe. Theytook
Campbell to Overtake Hospital.
Bellevue Firefighter Fernando Burton reported:
On 11/5/13 he and Firefighter Park were working a medic unit out of station 2when they
were dispatched to the Hampton Green. As they were driving in to the apts, someone
was waving them down. They stopped and hesaw a subject in the back of a car that
was burned. There alsowas a second subjectthat had minor burns and he told the
second subject that he could wait for other medics. The subject had 2nd degree burns
from his elbows down to his hands and from his knees down to his feet. He saidthe
bottoms ofthe subjects feet were chewed up and he had superficial burns on his face.
The subject didn't say what happened to him.
Burton's medic report listed the patient as Richard Schulz, date ofbirth 5/4/82. When I
interviewed Burton, Ishowed him Richard Schultz's Washington State Department of Licensing
photograph and Burton said it was the subject theytreated.

At about 0850 hrs. I arrived at the fire scene and saw hot spots of flames flaring up in building
f" KK and fire fighters were putting water on the building. Building KK was on aslope with the
east side of the building on the upper side on the slope and the west side of the building on the
lower side on the slope. The ground level apts. on the east side were apts. 201 and 202 and
the ground level apts. on the west side were 103 and 104. There were no apts. 101 and 102.
The southeast corner of building KK had collapsed. Apts. 302 and 202 were rubble at ground
level. I saw extensive fire damage on both the East and the West side of the building. A center
stairway also had extensive fire damage.
I spoke to Justin Eide who told me about seeing the subject he thought was making hash in KK-
202 a few weeks ago. I also spoke to several of the apartment's management team, including
Stanescu, who told me that Daniel Strycharske and Jesse Kaplan live in KK-202.
Bellevue Police Detective R. Thompson had gone to Harborview Hospital where he spoke to
David Richard Schultz, date of birth 5/4/82, who said he goes by Richard of Richie. Shultz told
Det. Thompson that for the last few nights he has been sleeping on the couch in Jesse Kaplan
and Daniel's apartment. He said that he woke at about 0530 hrs. this morning and left the apt.
to take something to his car. Schultz said that he was walking back to the apt. when the glass
around the door blew out. Schultz said he opened the door to the apt. and flames hit him.
Schultz said that he grabbed some butane canisters and dragged them away from the apt.
Schultz told Det. Thompson that he didn't know why the apt. caught fire and exploded.
Det. Thompson also spoke to Jesse Kaplan at Harborview Hospital. Kaplan told Det.
Thompson that he was woken up this morning by somethingthat threwhimout of his bed.
Kaplan said he didn't knowwhat happened. He said he lives inthe apartment with Daniel
#^ Strycharske and a third person named Richie (Schultz) is staying at the apartment with them.
At about 1245 hrs. I searched the area around the exterior of the KK building and found several
items including eight 6.6 oz. cans of butane. The Fire Department investigators also beganto
dig outthe southeast corner of the building where apartment's 302and 202had been located.
They were using a backhoe to remove large sections of the building and hand tools to dig out
other sections.
At about 1546 hrs. Ispoke a secondtimewith Alexandra Stanescu, the apt. manager for the
Hampton Green Apts. (Riverstone Properties), Jenny Richards, district manager for the
Riverstone Properties, and Rebecca Kline, VP of Riverstone Properties. Richards told methat
when a building is damaged and uninhabitable they take possession of the property and
relocate the tenants. I then obtained consent to search building KK from Kline.
On 11/6/13 at about 0700 hours myself and Fire Department personnel continued todig out and
search the southeast corner of building KK where apartments 302 and 202 had been located. I
seized several items including:
SRH-13: small brown bottle, East walkway.
SRH-14: glass pipe, East walkway.
SRH-18: Mail with Kaplan's name and address of4505 148th Av. NE on them, SE
bedroom area in drawer of nightstand.
SRH-19: boxwith glass bottles with brown substance in them, SE bedroom area.

At about 1530 hrs. I spoke to Jesse Kaplan at Harborview Hospital. Kaplan told me that
yesterday he was woken by something coming down on him. He said he didn't have his
glasses on and he was able to get out of his apt. by going out through the wall. He said
Strycharske was already outside and Schultz came out after he did and Schultz was badly
burned. He said he stays in the back bedroom and Schultz doesn't live at the apartment but
does stay over and sleeps on the cough in the living room.
I asked Kaplan about the marijuana plants found at the scene and he said that they're "legit".
He said he, Strycharske, and Schultz all have medical marijuana cards. He said Schultz has
been making hash for 15 years and provides them with hash. I asked him about the butane
cans and he said Schultz was storing a lot of things at the apt. I asked Kaplan what they did
that evening and he said Strycharske went to bed first, he watched some TV and then went to
bed. He said he doesn't know if Schultz was lying down or not. Itold Kaplan that Strycharske
has told us that they make hash inthe apt. Kaplan saidthat he doesn't want to mince
words...technically, making hash is having hash inthere and like drying it... Kaplan then
explained that you use butaneto extract the oil. He said the butane evaporates ordissipates
J^ and youlet it sit orvacuum it. Iasked Kaplan about doing the butanethrough the tube and
Kaplan said it's called shooting it. Iasked him whenthe last timethey did it and Kaplan said he
wasn't doing it, Strycharske wasn't doing it, Schultz could have been doing it. Iasked him when
the last time he actually sawSchultz shooting it and he said he didn't know. Iasked a week,
two weeks and he said weeks. Kaplan said he's seen the oil andthat Schultz had been doing it
off site. Iasked Kaplan if he (Schultz) could have been making it last night and he said
definitely. He said he didn't see him (Schultz) making it Monday night. He said it's possible he
(Schultz) was making it. Itold Kaplan that Ifound atube with marijuana in it in the apt. Kaplan
said you can't tell if the tubes been shot because the marijuana is still green after it's been shot.
He said he thinks there were three tubes in the apt., two empty ones and one with marijuana in
it.
In an interview with Kaplan on 11/21/13, Kaplan said he has never shot the butane. He said
Richie always did it.
On 11/5/13 about 1635hrs. Icontacted Schultz in a hospital room at Harborview. I sawthat
Schultz had bandages wrapped over his head, arms, legs, and feet. Iidentified myself and
asked Schultz ifwe could talk to him and he said yes. Itold him that if he was not feeling well
we could talk to him later. He said the drugs may be affecting him but he would talk to us.
I asked Schultz if he would tell us what happened the morning of the fire. He said he was
sleeping on the couch and woke up to the ceiling coming down on him. He said he had been
sleeping on the couch by the door. He said he pushed abox of butane out the door because of
the fire. He said he saw fire in the kitchen near the ceiling burning through from above. He said
f^ he went out the front door. Itold Schultz that he had earlier told Det. Thompson that he was

outside taking something to the car and came back to the apt. and saw the fire. Schultz said
f^ that he went out to his car to get something to cover himself and then went back to the apt. to
look for his friends and that's how he got burned. I asked Schultz if he was making hash in the
apt. using the butane method. Schultz said he doesn't do the butane method. He said it's too
dangerous, he uses the ISO method. He said the ISO method soaks the marijuana with
alcohol and you get the hash when the alcohol is drained off. I told Schultz that I found the tube
used to make the hash and he said that he has never made the hash in the apt. He said he
does the ISO method and never does that in the apt. I told Schultz that I found the glassware
and butane and he said he bought the glass and butane for Jesse (Kaplan) because Kaplan
wants to learn the butane method. I asked Schultz about why he had a box of butane and he
said he had bought it for Dr. J, and was just spending the night at Kaplan and Strycharske's
place and was going to give the butane to Dr. J the next day. He said he can buy the butane
wholesale. He said he had four boxes of butane cans with a total of 48 cans. He again said he
doesn't use the butane method to make hash.
A warrant was later obtained for Schultz's medical records from Harborview Medical Center.
The records state:
Mr. Schultz is a 31 yo man with a history of schizophrenia who is BIB medics from a
house fire explosion with severe burns to his feet, hands, and face. The burns are
circumferential around all 4 ext and singed facial hair. He arrives in critical condition due
to the extent of the burns.
On 11/15/13 at about 0925 hrs. I spoke with Daniel Strycharske at the Police Dept. Strycharske
said he lived in apt. KK 202 at the Hampton Green apts. and sometime between 0630 and 0700
hrs. he woke up to the sensation of heat, pressure, and something falling on him. He said he
f^ crawled out of an exterior wall and once he got outside he could see the east walls of his
(middle bedroom) and Kaplan's bedroom (master bedroom) were gone. He said he couldalso
look through his bedroom into the living room. He said he immediately got out of the apt. and
started yelling for Kaplan. He said it was a matter of seconds, 15seconds at the most, that he
saw Kaplan in his bedroom wearing just boxers. He said he yelled for Kaplan and Kaplan came
out through his bedroom wall and he met Kaplan in the debris field and helped him out. He said
he thenturned and yelled for Schultz and sawflames shoot up bythe door in the NW corner of
the apt. He said he yelled for Schultz and maybe 15seconds later he sawSchultz in the
hallway by his room. He said Schultz waswearing pants, shirts, multiple layers, socks, and
possible shoes. He said Schultz slept on the couch or futon next tothe door and that Schultz
often slept clothed. He said he sawthat Schultz was smoldering all over. He said he sawthat
his hands were burnt badly, his face had been heat blasted, and hisclothes had something
burnt or melted into the fabric.
Strycharske said that they make the hash in the living room area and have maybe done it three
or four times in the apt. He said Schultz would shoot, do it, and they would observe it as a
learning process. He said they would always beventilating, the patio door would becracked,
one of the bedroom windows would be open, and fans would be running. Strycharske said it
takes four orfive cans of butane to shoot depending onthe size of the tube and the quality. I
told him about finding six empty cans that had not been exploded and he said that would be
about right. He saidthat those cans could have been from Sunday.
Strycharske said that after Schultz came out of the apt., Schultz told him that he had taken
something to his car and when he came back into the apt. he heard aloud popping sound from
jpn the apt. above. He said Schultz told him that then the ceiling came down and that's when he
^ blew up.

On 11/19/131 was informed that Nancy Campbell, 87 year old tenant of KK 104 had died.
Campbell had fallen while fleeing the fire and broke her hip. The King County Medical
Examiner's autopsy report states:
The cause of death of this 87 year old woman, who died in the hospital after falling while
fleeing a fire at her residence, is aspiration pneumonia and urinary tract infection due to
prolonged hospitalization and immobility due to pelvic fracture with hematoma due to
blunt force injury of torso and extremities. Based on the findings of autopsy and
investigations, the manner of death is classified accident.
Bellevue Fire Department's fire investigator Steve Swarthout concluded that the explosion and
subsequent fire originated in the living room area of apartment KK 202. Swarthout stated that it
is his conclusion that the explosion and subsequent fire were the result of the introduction of an
unknown competent ignition source to the butane (ignitablefuel vapor) extraction/hash oil
producing process as it was being conducted in Building KK, unit 202.
According to various web sites on the properties of butane, including Chemicalbook.com,
butane (n-butane) is a colorless gas with a faint petroleum-like odor. N-BUTANE is extremely
flammable and is easily ignited. Vapors from liquefied gas are initially heavier than air and
spread along the ground. It will be easily ignited by heat, sparks, or flames and itwill form
explosive mixtures with air.

Findings:
An explosion originating in Building KK, apartment 202 resulted in a subsequent fire that destroyed
or severely damaged the entire building. The explosion and Fire caused 6 injuries and one fatality.

Overview.
I received a text page from the Northeast King County Regional Public Communications Center
(NORCOM) at approximately 07:14 hours on Tuesday 11/5/13, requesting a fire investigator
response for a structure Fire located at Hampton Greens Apartments, 4505 1481 Ave NE, Building
KK, Bellevue, WA. I contacted NORCOM and responded from Bellevue City Hall at approximately
07:14 hours. I arrived on scene at approximately 07:35 hours. Responding with me were Bellevue
Fire Department (BFD) Investigators DWIGHT ALTENBURG and STEVE SEXTON.
The weather conditions at the time of the explosion and fire were cloudy with light rain.
Temperatures were in the approximate low50's F, and winds were calm. The weatherconditions
were not a factor in the origin and cause of this fire.
An explosion resulting in a fire occurred at a multifamily wood framed apartment building with 10
units. There are 4 units on level 2 and 3, 2 units on level 1 which is located on the west side of the
building. The building is woodframe construction with peaked concretetiled roof. The approximate
8,000 square foot building was constructed in 1985 and was equipped with a monitored fire alarm
system. The building was not equipped with a fire-protection system. Several units where occupied at

Summary
On 11/5/13 at about 0630 hrs. Bellevue Fire and Police Depts. responded to 4505 148
th

Av. NE building KK in the Hampton Green Apts. for a report of an explosion and fire.
First units on the scene found building KK fully engulfed in fire.
Three people were treated for severe injuries that occurred while fleeing the fire and
Nancy Campbell later died from complications from the injury: Nancy Campbell with a
broken hip, with broken ankles and broken leg, with a broken
foot.
Bellevue Fire investigations determined that an explosion and fire began in the living
room area of apt. KK 202.
Daniel Strycharske and Jesse Kaplan, residents of KK 202, stated that in the past, they
have used butane to extract hash oil from marijuana, but had not been extracting hash
on 11/5/13 and had been awoken by the explosion/fire. They said that David (Richie)
Schultz, who was teaching them how to extract hash oil using butane, spent the night on
the couch in their living room on 11/4 -11/5/13.
Strycharske was not injured, Kaplan received minor burns, and Schultz was severely
burned.
On 10/17/13 window contractor Justin Eide saw a subject in apt. KK 202 making what he
believed to be hash. The mgmt. of the Hampton Greens called the Police and Off.
Slusser responded and contact Kaplan, Schultz, and a third subject at KK 202, but they
would not let Off. Slusser inside the apt. Off. Slusser smelled marijuana and the
subjects showed Off. Slusser their medical marijuana cards and said that they were not
making hash.
In a search of the fire scene components of hash making equipment: butane cans, tube
with what appeared to be marijuana, were found.
Investigation
On 11/5/13 at about 0850 hrs. I arrived at the fire scene. The temperature was around 50
degrees, it was overcast, and not raining. It had recently rained, the ground was wet. I saw that
the Hampton Green Apts. was a large complex made up of several three story buildings which
contained 10 to 12 apts. Building KK was in the Southwest section of the complex. I saw hot
spots flaring up in building KK and Fire Dept. personnel were putting water on the building.
Building KK was on a slope with the east side of the building on the upper side of the slope and
the west side of the building on the lower side of the slope. The ground level apts. on the east
side were apts. 201 and 202 and the ground level apts. on the west side were 103 and 104.
There were no apts. 101 and 102. The southeast corner of building KK had collapsed. Apts.
302 and 202 were rubble at ground level. I saw extensive fire damage on both the east and the
west side. A center stairway had extensive fire damage. First responders had taped off the
area around the building.

Det. J. Johnson was sent to Overlake Hospital and Det. R. Thompson was sent to Harborview
Hospital to contact anyone transported to hospitals. Off. J. Premslaar was primary patrol officer
on the scene and agreed to coordinate who was sent to what hospital.
I met with Fire Dept. Battalion Chief, Fire Marshal Ken Carlson, and Fire Investigator Steve
Swarthout. The Fire Dept. personnel stated that all residents of the building had been
accounted for. They decided that they would call the ATF for investigative assistance. I agreed
to assist with locating and interviewing witnesses and collect any evidence that was found.
I was told by initial units at the scene that there was known drug activity in unit KK 202. Lt. M.
Jordon of the Eastside Narcotics Task Force came out to the scene to assist with the
investigation.
At about 0910 hrs. Off. Premslaar told me that there was a witness that had seen drug activity
in apt. KK 202. Lt. Jordon and I spoke with Eide, who said:
He works for Alegis Construction and they are replacing windows throughout the
complex. His current job is to document all pre-existing damage to drywall, windows, or
anything in the units. About two weeks ago, around 10/18/13, he was not sure of the
date, he went into unit KK 202 and saw a man with long hair, wearing a beanie, sitting
on the floor making something with a glass device with tubes running to a compressor
that was outside on the balcony. He asked the subject if he was making hash and the
subject said yes, its for his dispensary. He smelled butane and marijuana. The glass
device was about eight inches in diameter and had a brown material in it. He also saw a
big jar full of green leaves that smelled like marijuana.
I took a recorded statement from Eide.
After the interview with Eide, I asked Lt. Jordon if making hash was illegal and he said he didnt
know. He said possession of marijuana was no longer illegal and the medical marijuana laws
allow patients to manufacture and possess certain amounts of marijuana. He said hash is a
byproduct of marijuana and he doesnt know if manufacturing hash would then be illegal.
At about 0945 hrs. Firefighter Paul Smith gave me a Toshiba laptop (SRH-38) and said
another firefighter, he didnt know who, gave him that laptop and said they found it outside the
fire.
Michael Collier of the ATF arrived to assist with the investigation.
I asked Dets. J. Brack and Hallifax to assist with canvassing and interviewing witnesses.
At about 1000 hrs. I spoke to Det. Thompson by phone. Det. Thompson told me he was at
Harborview and had spoken to David Schultz and Jesse Kaplan who had been in KK 202. Det.
Thompson said that Schultz told him that he woke at about 0530 hrs. and had left the apt. to
take something to his car. Schultz said that he was walking back to the apt. when the glass

around the door blew out. Schultz said he opened the door to the apt. and flames hit him.
Schultz said that he grabbed some butane canisters and dragged them away from the apt.
Det. Thompson said that Kaplan, who has red hair and a beard, said that he has lived at the apt.
for a couple months and sleeps in the back bedroom. Kaplan said that something happened
that woke him up, he jumped up, and ran out of the apt. Kaplan said once he got out, Daniel
helped him.
Det. Thompson told me that Schultzs car is a red older model Trans Am. I asked Det. Lindquist
to locate and impound the Trans Am. Det. Lindquist located and impounded a red Pontiac
Trans Am, WA license ALG 0765.
At about 1020 hrs. I spoke to the Alexandra Stanescu, the apt. manager for the Hampton
Green Apts. (Riverstone Properties), Jenny Richards, district manager for the Riverstone
Properties, and Rebecca Kline, VP of Riverstone Properties. Stanescu said that Daniel
Strycharske is the tenant on the lease for KK 202 but they also believe a Jesse Kaplan also
lives at the apt. She said that a couple weeks ago a window contractor told them that he saw
someone making hash in apt. KK 202. They called the Police and an Officer came out and
contacted the people in KK 202. The Officer told them that possession of marijuana was not
illegal and he would research what they could do, but the officer never contacted them again.
I asked Det. Brack to obtain a statement from Stanescu and also get copies all the rental
documents for KK 202.
At about 1245 hrs. Det. Thompson and I began a search of the exterior area around building
KK. We located and seized the following items:
SRH-1: butane can, west side next to fence.
SRH-2: butane can, west side in front of carport 273.
SRH-3: butane can, west side in front of carport 273.
SRH-4: butane can, entrance to apts 103 and 104.
SRH-5: metal hose, south side of KK building.

At about 1345 hrs. I spoke to Josh Richards of Rich Landscaping. Richards said he has the
contract for the landscaping for the Hampton Greens. He said he has never noticed anything
unusual around building KK. He said he would ask his employees about it and call me if anyone
had seen anything.

At about 1500 hrs. Fire investigations Swarthout and Sexton, and ATF agent Collier had begun
digging out the scene where apts.. 202 and 302 had been located. They used a backhoe to
remove sections of the building and to remove top levels of debris. They uncovered the outside
porch of unit 202 and showed me some divots and scorch marks in the cement of the porch.
There also were some deeper groves, but they had been made by the backhoe digging out the
scene.
At about 1546 hrs. I contacted Stanescu, Richards, and Kline. Richards told me that when a
building is damaged and uninhabitable they take possession of the property and relocate the
tenants. I then obtained consent to search building KK from Kline (SRH-39).
At about 1600 hrs. the Fire Dept. stopped digging out the building because of the darkness.
The property mgmt. had arranged a fence company to fence off the building. I requested Capt.
Hershey to arrange site security for the night.
At about 1645 hrs. I spoke to Lukasz Andrzejewski who said:
He lives in apt. KK 304 and this morning around 0622 hrs. he was in bed and a huge
explosion lifted him off the bed. After the explosion he thought the walls of his apt. were
crooked. After about 20 seconds he ran out his apt. and could see down to apt. 202 and
saw the wall with the front door was blown out. He saw that fire was rapidly spreading
and it originated from the apt. He said it was not a normal fire, it was spreading rapidly
and was being fueled by something. He didnt know the tenants of KK202, but had said
hello to them. He remembered two guys in their 20s, one guy with a red beard. He has
never smelled anything from the apt. but he did remember a buzzing noise like some
kind of generator in the past.
At about 1720 hrs. I left the scene and Offs. Welty, Tomlinson, and Tyler were at the scene.
On 11/6/13 at about 0700 hrs. I returned to the scene and several officers were working
security at the scene. Fire Investigator Sexton and Nicolas and ATF agent Collier began
working on the scene. As they located items, I photographed them and took them as evidence.
Over the next several hours they located the following items which I collected:

Most of the evidence was wet and I later laid it out in the Police Department evidence room
drying room.
While at the scene, a subject spoke to me who said he was a friend of who lived in
KK 303. He said that had jumped out the third floor window and had broken both her
ankles.
Also a Patty Campbell came by the scene and told me her mother Nancy Campbell who lived in
KK 104 had fallen when fleeing the fire and had broken her hip.
At about 1140 hrs. while still at the scene, I spoke to who said:
She lived in apt. KK 203 and on 11/5/13 at about 0630 hrs. she heard a loud blast and
then started hearing the fire alarm sounds. She grabbed her phone and ran out her
door. She looked at the apt. directly diagonal from hers (202) and could see into the apt.
and saw flames. She was not sure if the door to the apt. was open, but she could see
into the living room and could see flames. She could hear someone from inside the apt.
yelling to call 911. She saw a girl on the third floor that couldnt come out by the stairs
and had to jump down.
I took a recorded statement from .
At about 1530 hrs. Det. Thompson and I went to Harborview Hospital to contact Kaplan and
Schultz. Kaplan had just been discharged and we contacted him at the pharmacy. Kaplan had
bandages and suave on his face. He said he was burned on his face and left leg and had hurt
his foot. I recorded the interview with Kaplan (SRH-50). Kaplan said:

Yesterday he was awoken by something coming down around him. He then got out of
the apt. He thought he went out the door but later found out he went out from the
bedroom. He cant see well without his glasses and he didnt have his glasses on at the
time. When he was getting out, Dan (Strycharske) was yelling for him and helped him
get out. He was not wearing any shoes, just boxers. Richie (Schultz) got out after he
was out and Schultz was badly burned.
The apt. is KK 202 and Strycharske is the one on the lease. He didnt get on the lease
originally because of mold problems at the apt. He does stay there off and on since
Strycharske got the apt. He stays in the back bedroom. Richie, whose name is David
Richard Schultz II, doesnt live there but does stay over and sleeps on the couch.
When I first asked Kaplan about making hash in the apt. he answered no. He did say that there
were items to make hash in the apt., like glassware. I asked him about the marijuana plants
and he said that there legit. He said he, Strycharske, and Schultz all have medical marijuana
cards. He said Schultz has been making hash for 15 years and provides them with hash. He
said when he smokes hash, he vaporizes it by putting it on a nail that he has heated up with a
torch.
I asked Kaplan about the compressor and he said that Shultz uses it to age the hash. He said
he doesnt think it was being used that night. I asked him about the butane cans and he said
Schultz was storing a lot of things at the apt.
I asked Kaplan what they did that evening and he said Strycharske went to bed first, he watched
some TV and then went to bed. He said he doesnt know if Schultz was lying down or not.
I told Kaplan that Strycharske has told us that they make hash in the apt. Kaplan said that he
doesnt want to mince wordstechnically, making hash is having hash in there and like drying
it Kaplan then explained that you use butane to extract the oil. He said the butane
evaporates or dissipates and you let it sit or vacuum it. I asked Kaplan about doing the butane
through the tube and Kaplan said shooting it. I asked him when the last time they did it and
Kaplan said he wasnt doing it, Strycharske wasnt doing it, Schultz could have been doing it. I
asked him when the last time he actually saw Schultz shooting it and he said he didnt know. I
asked a week, two weeks and he said weeks. Kaplan said hes seen the oil and that Schultz
had been doing it off site. I asked Kaplan if Schultz could have been making it last night and he
said definitely. He said he didnt see him (Schultz) making it Monday night. He said its
possible he (Schultz) was making it.
I told Kaplan that I found a tube with marijuana in it in the apt. Kaplan said you cant tell if the
tubes been shot because the marijuana is still green after its been shot. He said he thinks
there were three tubes in the apt., two empty ones and one with marijuana in it.
I asked Kaplan if they vent when they do it and he said that they have the stove vent on in the
kitchen. I asked him where they do it and he said the kitchen.

I asked Kaplan about the compressor and he said they did keep it outside but they asked them
to bring it inside because of the construction. He said he thinks it was under the table near the
kitchen.
I asked Kaplan if they had any problems with their appliances and he said the light in the fridge
went out and a plastic water container next the bulb had melted. He said they dont smoke
cigarettes but they do smoke hash. I asked if they smoke in the morning and he said yes, but
not that early. He said he may smoke some after he gets up before he goes to work. He said
its medications.
Kaplan said that they were planning on going into business. He said Schultz would work in the
lab and he and Strycharske would work the business end. I asked if they had actually started
the business and he said no. He said they were having problems with the apt. and they had
planned to find a commercial space.
At about 1635 hrs. Det. Thompson and I contacted Schultz in a hospital room at Harborview. I
saw that Schultz had bandages wrapped over his head, arms, legs, and feet. I identified myself
and asked Schultz if we could talk to him and he said yes. I told him that if he was not feeling
well we could talk to him later. He said the drugs may be affecting him but he would talk to us. I
again told him that if he was not up to it, we would talk to him later. He said he would talk to us.
I asked Schultz if he would tell us what happened the morning of the fire. He said he was
sleeping on the couch and woke up to the ceiling coming down on him. He said he had been
sleeping on the couch by the door. He said he pushed a box of butane out the door because of
the fire. He said he saw fire in the kitchen near the ceiling burning through from above. He said
he went out the front door.
I told Schultz that he had earlier told Det. Thompson that he was outside taking something to
the car and came back to the apt. and saw the fire. Schultz said that he went out to his car to
get something to cover himself and then went back to the apt. to look for his friends and thats
how he got burned.
I asked Schultz if he was making hash in the apt. using the butane method. Schultz said he
doesnt do the butane method. He said its too dangerous, he uses the ISO method. He said
the ISO method soaks the marijuana with alcohol and you get the hash when the alcohol is
drained off.
Schultz coughed some and I asked if he was ok and he said he was loopy from the drugs. I
again told him that we could come back later and he said its ok, hell talk to us.
I told Schultz that I found the tube used to make the hash and he said that he has never made
the hash in the apt. He said he does the ISO method and never does that in the apt. I told
Schultz that I found the glassware and butane and he said he bought the glass and butane for
Kaplan because Kaplan wants to learn the butane method. He said Kaplan is learning the
butane method from a guy named Dr. J. He said he doesnt know Dr. Js name, but Dr. J hangs
out at the Galaxy on Rainer.

I asked Schultz about why he had a box of butane and he said he had bought it for Dr. J and
was just spending the night at Kaplan and Strycharskes place and was going to give the butane
to Dr. J the next day. He said he can buy the butane wholesale. He said he had four boxes of
butane cans with a total of 48 cans. He again said he doesnt use the butane method to make
hash.
Schultz started cough and said he was going to throw up. Det. Thompson and I left Schultz with
a nurse.
On 11/14/13 at about 1000 hrs. I began packaging some of the items from the scene that I had
left in the evidence rooms drying room. When examining the butane cans found on 11/6/13
(SRH-28) I saw that eight of the cans had exploded and had tops or bottoms missing. I
packaged those cans as SRH-28. I saw that six of the cans had not exploded and the cans
were intact. I packaged those as SRH-28A. There had also been a metal tube with the cans
and I packaged the tube as SRH-28C. I laid out the pieces of glass from SRH-30 and
photographed them. I also removed the green matter from the pieces of glass and packaged
the green matter as SRH-30A. I examined the lamps, plants, and pump like device I found in
the closet area (SRH-32). I divided the items with the parts of the lamp as SRH-32. The parts
of four plants as SRH-32A, and what looked like part of a pump as SRH-32B. I also took the
media card out of the camera (SRH-36) and packaged the media card as SRH-36A. I left
several of the items in the drying room to continue to dry.
On 11/15/13 at about 0925 hrs. I contacted Daniel Strycharske at the Police Dept. Strycharske
said:
He lived in apt. KK 202 at the Hampton Green apts. Sometime between 0630 and 0700
hrs. he woke up to the sensation of heat, pressure, and something falling on him. He
crawled out of an exterior wall. Once he got outside he could see the east walls of his
room (middle bedroom) and Jesses bedroom (master bedroom) were gone. He could
also look through his bedroom into the living room. He couldnt clearly see if the
bedroom wall was also missing.
He immediately got out of the apt. and started yelling for Kaplan. It was a matter of
seconds, 15 seconds at the most, that he saw Kaplan in his bedroom wearing just
boxers. He yelled for Kaplan and Kaplan came out through his bedroom wall and he
met Kaplan in the debris field and helped him out. He then turned and yelled for Schultz
and saw flame shoot up by the door. He had drawn a diagram of his apt. and pointed to
the NW corner of the apt., the living room area. He said the flame was like someone
holding a lighter out, it went whoosh.
He yelled for Schultz and maybe 15 seconds later he saw Schultz in the hallway by his
room. Schultz was wearing pants, shirts, multiple layers, socks, and possible shoes. He
was wearing some snow pants, overalls, he normally wears.

He and Kaplan live at the apt. and Schultz stays there sometimes. Schultz had stayed
at the apt. for a few days because they had hired him to watch their place because they
were leery of the construction workers. Schultz slept on the couch or futon next to the
door. Schultz often slept clothed.
He saw that Schultz was smoldering all over. He saw that his hands were burnt badly,
his face had been heat blasted, and his clothes had something burnt or melted into the
fabric.
They make the hash in the living room area and have maybe done it three or four times
in the apt. Schultz would shoot, do it, and they would observe it as a learning process.
They would always be ventilating. The patio door would be cracked, one of the bedroom
windows would be open, and fans would be running.
He went to bed around 2 or 3 and he heard Kaplan going into his room when he was
falling asleep. They had not been making hash that night and had not planned on
making hash that night. He thinks the last time they did the process was Sunday
afternoon/evening.
Strycharske said it takes four or five cans of butane to shoot depending on the size of the tube
and the quality. I told him about finding six empty cans that had not been exploded and he said
that would be about right. He said that those cans could have been from Sunday. I told him I
found the glass tube and he described the tube. He said they had two larger ones and maybe
one or two smaller ones.
Strycharske continued to say:
Schultz told him that he had taken something to his car and when he came back into the
apt. he heard a loud popping sound from the apt. above. Schultz told him that then the
ceiling came down and thats when he blew up.
He had six plants in his closet.
Shultz has a red Trans Am and it was parked in their car port. Schultz would smoke
flowers or bud in the morning, but not right as he was getting up. He would roll a cigar
and cut it up into doses and use his pipe to smoke it. His pipe is curved with a chamber
and a bubble off of it.
A light above the dining room and the refrigerator light had gone out within the last 48
hours. The light in the dining room had been a hanging light but they had the apt.
complex change it out to one stuck to the ceiling.
I recorded the interview with Strycharske (SRH-48). I showed Strycharske the red Trans Am
that Det. Lindquist had towed to the Police Dept.and Strycharske said it was Schultzs car.
On 11/19/13 I was informed that Nancy Campbell, 87 year old tenant of KK 104 had died.
Campbell had fallen while fleeing the fire and broken her hip. I spoke to the Medical Examiners

office and they said that Campbell had died from pneumonia which was a complication from the
broken hip.
At about 1100 hrs. Det. Johnson and I met with Patty Campbell and Ann Spangler who were
Nancy Campbells daughters.
On 11/21/13 at about 0930 hrs. Det. Johnson, Fire Investigator Swarthout, and I met with
Kaplan at his apt. Kaplan was limping and I asked him if he was still injured from the fire. He
said he had an infection on his foot. I asked him what else he injure during the fire and he said
his face and left leg.
I asked Kaplan how long it took him to get out of the building and he said about 20 seconds. He
said he was wearing boxers. He said it was about one minute later that he saw Schultz come
out and Schultz was badly burned on his hands. I asked Kaplan what time he had gone to bed
the night before the fire and he said sometime after midnight. He said Strycharske had gone to
bed first and then he went to bed about a half hour later. He said Schultz was still up when he
went to bed. I asked Kaplan if he had ever shot the butane himself and he said he had never
done it without Schultz. He said Schultz always did it. He said he might have helped Schultz
but it was always Schultz who shot the butane. I asked Kaplan about any empty bottles of
butane and he said there might have been some left it the apt. from when the shot before.
I asked Kaplan if they wear goggles when they shoot the butane and he said no. I asked him if
he wears goggles when he smokes and he said no. I showed him the photo that Off. Tyler had
taken of him at the hospital that showed redness around his eyes. He said he doesnt know
why there is the red pattern around his eyes. He said his face was burned in the fire.
I asked Kaplan if he would be willing to take a polygraph test and he said he didnt think that lie
detectors were very accurate and what if we asked him about other things besides the fire.
Kaplan gave me the boxer shorts that he was wearing when he went to the hospital, which were
still in a sealed plastic bag from the hospital (SRH-49). I later hung the boxers in the evidence
room drying room.
On 11/22/13 I finished packaging the items from the fire scene that I had left in the drying room.
On 11/26/13 I met with Patty Campbell at her office in south Bellevue. Campbell gave me a
bathrobe (SRH-50A) and a jacket (SRH-51) which she said her mother had been wearing when
she was taken to the hospital. I saw that the bathrobe appeared to have soot and burn holes in
it. The jacket had brown stains that appeared to be blood on it. Campbell also told me that she
had received several emails from some of her mothers friends that talked about what her
mother had told them about the fire. Campbell said that she would write up some notes on what
her mother told her and other people.
On 11/26/13 at about 1400 hrs. I met with at the Kirkland Care Center. I
recorded the interview with (SRH-54). said:

She lived at the Hampton Green Apts. unit KK 303. On 11/5/13 at about 6:18 AM she
was up, ready for work, when she felt a burst like an explosion. At first she thought it
might have been an earthquake, but she didnt notice any swing, and then she heard
some guy yell fire. She opened up her front door and saw flames coming up the
staircase. She called 911, grabbed her cat cage, and then saw flames coming through
the front door. Smoke started coming in and she got on her hands and knees and
crawled to her bedroom. She opened the bedroom window and called down to two guys
for help. The two guys below said they would catch her. She climbed out the window
and jumped. She broke her right ankle, shattered her left leg, L-1 fracture in her back,
broken left arm, and carpal tunnel in her left wrist that was from the surgery on her arm.
It was about a minute and a half from when she heard the explosion to when she
opened her door and saw the flames.
She didnt know the people who lived in 202 but she heard a lot of parties going on and
there were always people out and about.
She did see her neighbor Nancy Campbell that morning wrapped up in someones
blanket. She didnt see her fall.
On 11/27/13 at about 1135 hrs. I spoke to Rustam Hashimov. Stanescu, the Hampton Green
manager, said that apt. KK 302 was rented by Aboda Corporate Housing which houses people
for corporate customers. I spoke to Aboda who told me that Rustam Hashimov had been living
in the apt. on 11/5/13. I took a written statement from Hashimov. Hashimov told me:
He is an employee of Microsoft and had been living in KK 302 at the Hampton Greens
for a few weeks. On 11/5/13 at about 0600 to 0615 hrs. he was woken by an explosion.
He was sleeping in the back corner bedroom and when he was woken up he saw that
the outside walls of his bedroom had opened up and the floor was sloping out. A few
moments after the explosion he saw smoke and flames in the living room area of his
bedroom. He got out of his apt. through the opening in the wall. When he got out he
saw a W/M with blond hair who said he cant see and that his apt. blew up.
On 12/11/13 at about 1500 hrs. I met with and who had lived in
KK 204. I took recorded statements from both, separately (SRH-53).
said:
She lived in KK204. At around 6:00 to 6:30 she was woken up by a loud explosion and
crash. She thought the upstairs bathroom fell into their bathroom. She tried calling 911
but her husband told her that there wasnt enough time. She ran out into their living
room and she saw fire. She first thought that she saw her neighbor, W/M, beard, beanie
type hat, in her living room. She saw that he was fully clothed. He was just kind of
walking around in the living room. She didnt think he was burned. She then realized
that there was no wall between her apt. and her neighbors apt. She thinks it was about

three to four minutes from when she was woken up to when she saw the neighbor and
the fire.
She doesnt know her neighbors in KK 202 but she has seen them before. She did not
see her neighbor Nancy Campbell that morning.
said:
He and lived in KK 204. At about 6:15 he was woken up by a loud explosion and
what he thought was the bathroom from the apt. above his crashing down into his apt.
He ran to the front door and saw that the roof was missing and he could see fire. He
tried opening the front door but it would not open. He went back and got some
documents from a closet then took his wife out on to the balcony and had her jump. He
then jumped off the balcony. He was not wearing his glasses at the time and his vision
is bad and can only see blurred images without his glasses. It was about two minutes
from when he was woken up by the explosion to when he went out into the living room
and saw the fire.
He doesnt know the neighbor in KK-202 but he has seen him and talked to him once.
On 12/13/13 I spoke to Udayakumar Thangaraj by phone. Thangaraj had a strong accent and
there was some problems communicating. Thangaraj said:
He and his wife Lavamua Udayakumar lived in KK 103 but have since moved to Arizona.
On the day of the fire, they were woken up around 0630 by alarms. They went outside,
heard an explosion, and saw flames on the next floor up from their apt. They did not
know the people in KK 202.
On 12/18/13 at about 1000 hrs. I emailed T. Wallace of the Kirkland Fire Dept. asking for any
reports on medics examining or transporting anyone at the fire. I also left a message with the
Redmond Fire Dept. asking for reports.
I spoke with Cassie Howard by phone and asked her if she remembers seeing Nancy Campbell
the morning of the fire and she said no.
I spoke with Lukasz Andrzejewski by phone and asked him if he remembers seeing Nancy
Campbell the morning of the fire and he said no. I asked Andrzejewski about the name Tikilah
Reynolds, which was listed as a tenant in his apt., and he said she is his wife and was in
California the day of the fire.
I received an email from Wallace that contained the Kirkland Fire Dept. report showing that
Kirkland firefighters Childs and Moffitt examined Nancy Campbell. I emailed Wallace asking for
Childs and Moffitts contact information.
On 12/18/13 I released the laptop computer (SRH-38) that a firefighter had found and was later
turned over to me, to Patty Campbell. Campbell recognized the computer as belonging to her
mother, Nancy Campbell.

On 12/19/13 at about 1330 hrs. I spoke to Bellevue Firefighter Tobias Burns. According to Fire
Dept. reports, he and firefighter Regalado were working Aid 3 on 11/5/13 and examined and
transported Kaplan. Burns said that he remembers treating a subject with burns to his face and
neck and transporting him to Overlake first and then Harborview. I showed Burns the Fire Dept.
report and agreed that it was Jesse Kaplan. I also showed him the DOL photo of Kaplan and he
said it was the guy. He said that when they asked Kaplan what happened, Kaplan said that he
had gotten up to go to the bathroom and there was some type of explosion.
I received a fax from DOL that contained title history on the Schultzs Firebird (SRH-75). The
documents show a registration issued May 2013 to Jesse Robinson of Kelso. There is also a
Certificate of fact signed by Robinson dated 5/3/13 stating he bought the Firebird from Steve
Lancaster.
On 12/20/13 at about 1230 hrs. I met with Bellevue firefighter Fernando Burton and station 2.
Burton said he was working as a medic on 11/5/13 when he responded to a report of a fire at
the Hampton Green Apts. As they were driving in, someone was waving them down. They
stopped and he saw a subject in the back of a car that was burned. There also was a second
subject that had minor burns and he told the second subject that he could wait for other medics.
I showed Burton the Fire Dept. report and he said it was the report that Park filled out that day
on the subject they examined and transported. The report listed the name Richard Schultz. I
showed Burton the DOL photo of David Richard Shultz and Burton said it was the person they
examined. Burton said Schultz had 2
nd
degree burns from his elbows down to his hands and
from his knees down to his feet. He said the bottoms of Schultzs feet were chewed up and
Schultzs had superficial burns on his face. I asked Burton if Schultz said anything and he said
Schultz only talked about the pain. Burton said that Schultz didnt talk about what happened.
Burton said that Schultz was wearing a jacket but he doesnt remember what Schultz was
wearing on his legs. Burton said he doesnt think Schultz was wearing any shoes. Burton said
that they transported Schultz to Harborview Hospital.
I took a recorded statement from Burton (SRH-59).
On 12/23/13 at about 1550 hrs. I met with Kirkland firefighter Jeffery Childs at Kirkland fire
station 25. Childs said that on 11/5/13 he and Ken Moffitt responded to the Hampton Greens to
assist with the medical response. He said they were directed to an older woman who said her
name was Nan. He said that Nan told them that she woke up to a loud noise and saw that her
apt. was full of smoke. He said that Nan told them that she went back to get something and as
she was coming back she had to bend down because of fire above her. He said that Nan told
them that she tripped as she was leaving and fell. He said that she told them that her hip hurt.
He said that they saw burn marks on Nans clothing. He said that they too her to the medic van
where Moffitt examined her and transported her to Overlake Hospital.

On 1/2/14 at about 1330 hrs. I met with Kirkland Firefighter Kent Moffitt at Kirkland Fire Station
25. I showed Moffitt the fire report and he said he had filled it out after the incident. Moffitt said
that on 11/5/13 he and Jeff Childs were working Kirkland Fire Aid 22 when they were sent to the
fire at the Hampton Greens to assist with the injured. He said they were directed to a woman
who had a broken hip. He said he spoke to the woman who said her name was Nancy
Campbell and he remembers she said she goes by Nan. He said he remembers the woman
being older. He said he wrote her name and age on the report. He said he remembers the
woman telling him that she had left her apt. because of the fire. He said he remembers the
woman telling him about how there was fire above her and embers where falling on her. He
said he remembers seeing burn marks on her clothing. He said the woman told him that as she
was leaving her apt. and she tripped and fell. He doesnt remember if the woman told him what
she tripped over. He said the woman complained of hip pain. He said he doesnt remember
which side but his report has her right side. He said they transported the woman to Overlake
Hospital.
I took a recorded statement from Moffitt (SRH-61).
On 1/8/14 Patty Campbell sent me an email that contained some notes she wrote up about
what her mother told her and some photos of her mothers phone and slipper that they found
outside her mothers apt. I transferred some of Campbells notes to a statement form and sent it
back to her and she signed off on the statement. I attached the notes and photos to Campbells
statement. In her statement Campbell said:
On 11/5/13 at about 0741 hrs. she got a call from Overlake Hospital about her mom
being at the emergency room. A few minutes later she got a call from her mother who
told her that there had been an explosion that woke her up and she had fallen on her
way out of the building. Her mom said that her hip might be broken. When she got to
the hospital her mom told her that there was a very loud noise that woke her up about
6:30 and the fire alarms went off. Her mom said she put on her bathrobe and left the
building. Her mom said she did not see a fire at that point and thought it would be safe
to go back inside to grab some important things. Her mom said that she was coming out
of the apartment after getting some items and she tripped and fell just past the end of
the stairs that went up through the breezeway to the second floor apartments. Her mom
said she knew as soon as she fell that she had broken her hip, it was very painful. Her
mom said a woman jumped from an apartment above her and two men insisted that she
needed to get away from the building because they could all see flames and cinders
were raining down on them.
On 2/28/13 I received a search warrant from King County District Court Judge, David Steiner,
authorizing me to search the red Firebird and to obtain Schultzs medical records from
Harborview.
I faxed the warrant to Harborview records.

At about 1415 hrs. Det. JA Johnson and I searched the Pontiac. Det. Johnson took photos
while I searched the car. In the trunk, I located:
SRH-62: torn cardboard box with gas cartridges, quantity 96 on them
SRH-63: black plastic garbage bag, containing:
SRH-63A: three plastic caps, roll of black tape, empty plastic package for cigar wraps,
brass nozzle with clamp, rubber band. All the items had an oily substance on them and
some green flakes.
SRH-64: broken glass bong. The neck was broken off. I later dropped the bong and
broke it further.
SRH-65: green plant stems
SRH-66: plastic baggy with sticker on it that had RX Strain, Sour Kush
SRH-67: glass tube
SRH-68: green flakes, that appeared to be marijuana, on floor of trunk
On the floor of the drivers side back seat I found:

We finished the search at 1415 hrs. and I put a copy of the warrant and return of service inside
the car. Det. Johnson booked the media card containing the photos (SRH-72).
On 2/6/14 I picked up a copy of Schultzs medical records from Harborview (SRH-73). I had a
copy of the records scanned to a PDF. Listed under history of present illness is:
Mr. Schultz is a 31 yo man with a history of schizophrenia who is BIB medics from a
house fire explosion with severe burns to his feet, hands, and face. The burns are
circumferential around all 4 ext and singed facial hair. He arrives in critical condition due
to the extent of the burns. He remained HDS in ED without airway compromise.
Baseline labs notable for leukocytosis and 18k and lactate 6.1 base deficit 2.7.
On 2/12/14 I received a copy of the autopsy report from the KCME office (SRH-74). The report
read:
The cause of death of this 87 year old woman, who died in the hospital after falling while
fleeing a fire at her residence, is aspiration pneumonia and urinary tract infection due to
prolonged hospitalization and immobility due to pelvic fracture with hematoma due to
blunt force injury of torso and extremities. Based on the findings of autopsy and
investigations, the manner of death is classified accident.

On 3/27/14 at about 0930 hrs. I spoke with the Washington State Crime lab and they told me
that since butane is a gas at room temperature, it would be highly unlikely that they would find
any butane in any of the fire debris.
At about 1430 hrs. I removed one of the jars from the box (SRH-19) found in the southeast
bedroom area and repackaged it as SRH-19B. I removed about a two inch long section of the
suspected marijuana (SRH-30A) that was in the glass tube (SRH-30) found in the living room
area and repackage it as SRH-30B. I removed one of the plants (SRH-32C) found in the middle
bedroom closet area and repackaged it as SRH-32C. I requested that the three repackaged
items be sent to the Washington State Lab for testing.
On 3/28/14 at about 0730 hrs. I faxed a request to Harborview Medical Center for
medical records. I also faxed a request to Overlake Hospital for medical records.
At about 0930 hrs. I spoke to attorney John MacMillan, who is representing the Hampton
Green Apts. I was referred to MacMillan by Stanescu, the manager for the apts. I was asking
for documentation for the monetary loss to the Hampton Greens. MacMillan said he would send
me something.
MacMillan later sent me an email that listed the costs of repair to buildings KK and LL totaled
$204,136.59.
Det. Thompson had taken photos of the scene on 11/5/13 and in his report he lists that they
were booked into evidence under RKT-1. However, there were no photos listed in the case
booked into evidence by Det. Thompson. Det. Thompson has since retired from the
department. Det. Thompson had given me a CD that contained copies of the photos he took. I
booked the CD he had given me into evidence under the evidence number RKT-1.
I spoke to Strycharske by phone and he said that neither he nor Kaplan have spoken to Schultz
since they were in the hospital. He gave me the number 360-402-7346 for Schultz.
There is a hand written not on Schultzs medical records that state that Schultz was released to
his father from Georgia and lists a number 803-529-8235. Lexis Nexus lists David Richard
Schultz Sr. with an address in South Carolina.
On 4/1/14 I tried Schultzs number several times and got a recorded message from Verizon that
the caller was not available. I called the number of for Schultz Sr. and he told me that he did
come up to Washington and his son came down to SC with him but he has since returned to
Washington. He said he doesnt know where his son is staying but he would guess near his
kids in the Olympia area. He said he doesnt have a number for his son and the mother of his
children is named Kat Douglas and lives somewhere in the Olympia area.

1. 11-05-13, 0750 hrs: I was contacted by Lt. Patricelli and was requested to respond to
Overlake Hospital to contact some people reference an on-going fire investigation. Det.
R. Thompson was assigned to contact a potential victim at Harborview Hospital. I was
told that the fire may have been part of an explosion that occurred inside of unit KK202
at 4505 148

Ave. NE in Bellevue.
0800 hrs: I arrived at Overlake Hospital ER and met with the staff there. I learned that
three people were present in the ER who were associated with this investigation.
- Nancy P. Campbell, DOB/07-07-26, was being treated for a fractured pelvis
and internal bleeding. Campbell reportedly resided in unit KK104.
- , DOB , was being treated for a fractured left foot.
reportedly resided in unit KK204 with her husband ,
DOB/ . had not been injured.
- Daniel J. Strycharske, DOB/04-06-86, was being evaluated for minor
scratches and abrasions. Strycharske reportedly resided in unit KK202 with a
couple of male friends.
I waited for Strycharske to finish with his medical evaluation before making contact with
him. I also learned that his injuries were very minor and that he would be discharged
from the hospital in a short time. I introduced myself and stated the purpose for my
contact with him. Strycharskes initial information included:
- He is the leasee of unit KK202. He lives at this apartment with two male
friends named Jesse Kaplan and David Richard Schultz II. Schultz goes by
the name Richard or Richie.
- Strycharske stated he was sleeping in the guest bedroom when he was awoken
by an explosion and debris falling on him. The event, the cause of which was
not clear in his mind at that point, cause one of bedroom walls to be
destroyed. He was able to escape his room via the damaged wall.
- Seconds before the building burst into flames, Strycharskes roommates exited
the apartment through the damaged walls also. Schultz was burned badly on
at least one of his hands. Kaplan was less injured than Schultz.
- Strycharske spoke briefly about the ongoing practice of extracting hash oil
from marijuana within the apartment - a process that involved using
pressurized butane.
- He provided me with a drawing to help acclimate me about the apartments
floor plan, his bedroom and where the extraction process was taking place
(see Item JAJ-2)
- He agreed to provide me with the t-shirt (Item JAJ-3) and pajama pants (Item
JAJ-4) he was wearing at the time of the incident. The pants had already been

Item JAJ-5.
- He also agreed to have his injuries photographed. **I later transferred these
photos onto CD and placed them into evidence as JAJ-1.
0921 hrs: After Strycharske was discharged from the ER he accompanied me to my
assigned detective vehicle to provide a recorded interview. The interview last about one
hour and eight minutes. See the interview transcript for details. At the completion of the
interview Strycharske was brought to the Overlake Hospital waiting area to wait for a
friend to pick him up.
I then went to 4505 1486

Ave. NE and made contact with Det. Steve Hoover, the lead
investigator in this case. I was near the fire scene for a short period of time relaying
information that had been told to me by Strycharske before leaving on another
assignment.
I then returned to BPD and placed the above items into evidence. After that was
competed I drove to Overlake Hospital and briefly contacted , Dob/
. was inside of their apartment #KK204 with her husband
, DOB , when this events occurred. They had both been sleeping at
the time. suffered injuries including a fractured left foot and some facial
abrasions.
I also confirmed that Nancy P. Campbell, DOB/07-07-26, was at Overlake Hospital also
and was undergoing medical treatment for a fractured pelvis and internal bleeding. She
was not available for contact at this time.

2. 11-06-13, 1315 hrs: I contacted by telephone and obtained a recorded
statement from her about the event. See transcribed statement for details.

3. 01-28-14, 1309 hrs: I assisted Det. Hoover during the search of a Pontiac WA license
ALG0765 today. I took digital photos during the search process. After the search was
completed Det. Hoover assigned me Evidence Item Number SRH-72 (for the photos that
I subsequently transferred onto CD and placed into evidence).

0800 hours,
I was requested to respond to Harborview Hospital where it was reported a tenant of the Hampton
Green Apartment complex was being treated for wounds suffered in a fire at his apartment. I was ad-
vised there was some type of an explosion at the apartment complex and building KK was completely
engulfed in flames. The person who had been transported to Harborview may have been living in the
apartment believed to be the source of the fire. I was requested to contact this individual and conduct
an interview as well as collect any evidence.
As I was driving to the hospital a Bellevue Fire Department Medic Unit passed me and I was later told
that another victim was being transported to Harborview with burns.
0830 hours,
I arrived at the hospital and spoke with Officer Seth Tyler who was standing by outside one of the
emergency room stalls with an orange plastic bag. He advised the bag contained burnt clothing from
the victim that the hospital staff had removed. I took possession of the bag. Officer Tyler told me the
victim was currently in the X-ray room. The victims name was David Richard Schultz, DOB:
05/04/1982.
After Schultz was removed from the X-ray room, he was wheeled into an ER treatment stall where I
introduced myself to him and told him I was investigating what happened at the fire. I told him I wanted
to ask him some questions but wanted to make sure he knew he was not under arrest just because the
police were talking to him. He said he understood. Schultz was in a lot of pain and I noted he had
burns on his head, face, hands, feet and the skin had bubbled and was peeling from his flesh. He ap-
peared to be in a lot of pain and verbally expressed as much. I asked him if he understood me and if I
could speak with him about what happened. He stated I could. I did not take a taped statement from
Schultz at this time due to the fact he spoke softly and he was in pain but he revealed the following in-
formation to me:
His name is David Richard Schultz, but he goes by the name Richard or Richey. His DOB: is
05/04/1982. He is from South Carolina and doesnt really live or have an address but he has been stay-
ing with Jesse Kaplin and Daniel. He did not know Daniels last name. They live in the Hampton Green
Apartment complex and the building they live in is way in the very back. He told me he is a provider
of medicinal hash oil to Jesse and Daniel. Schultz said he had been spending the last few nights on the
couch at this apartment because Daniel and Jesse were having some problems with the construction
workers who were replacing the windows on the site. When asked if Schultz has a job, he said he works
at the dispensary at White Center Alternative Care. He told me he makes hash but he didnt have any
of his stuff with him and all his stuff is all at the dispensary where I do my work. When asked
what would cause the apartment to explode like it did, Schultz said he didnt know and what he did
know is that he was he had got up this morning around 5:30. His roommates, Jesse and Daniel were

sleeping as they typically get up around 9:00. Schultz told me he was getting ready to go to the dispen-
sary and had walked out to his car to put some stuff inside. As he walked back to the apartment he
heard a loud pop and the glass door on the side of the apartment blew out. Schultz said he opened the
front door and went inside the apartment to get some butane that was in a case and as he opened the
door, he was hit with a wall of flames. He said he went in anyway and dragged the box out into the
hallway outside the door. I asked why he would drag this case of butane outside and he said because
he didnt want them to blow up in the fire.
Schultz stated he had no idea what would catch on fire or explode in the apartment and didnt know
why this happened. I asked him if he were making hash inside the apartment and he was adamant that
he wasnt. He told me that about two weeks ago some construction workers reported to the police that
they were making hash inside the apartment but a Bellevue Police Officer stopped by and he showed
him that they werent. He said the police officer looked inside the apartment at what items he had and
it was confirmed they were not making hash there. Schultz told me Jesse and Daniel were concerned
because the construction workers wanted to get inside their apartment and they didnt trust them.
Schultz believed a blond guy working on the windows was suspicious although Schultz said he didnt
suspect this construction worker of blowing the apartment up or setting a fire.
As we spoke, Schultz was requesting from the nursing staff, pain medication and they transported him
to the 9
th
floor burn unit. I advised Schultz I would follow up later with him.
I then re-contacted Officer Tyler who was standing by with Jesse Kaplan who had arrived by Medic
Unit. He was only wearing a pair of boxer short and a coat. The coat was placed in a blue bag by hospi-
tal staff.
Officer Hodges and Barker arrived to assist. I turned over the orange bag and the blue bag to them
and requested they photograph and book the clothing items into evidence.
I then went into another emergency room bay where I introduced myself to Jesse Kaplan. Kaplans
injuries were visibly not as drastic as Schultz. He appeared to have suffered some burns to the face and
head and his beard and hair were burned and blistered. Kaplan also suffered some abrasions on his
legs. He told me he lives at 4505 148

Ave. NE #KK 202. He told me the apartment complex is called
the Hampton Greens. He told me he lives with Daniel Strycharski whose name is on the apartment
lease. Kaplan said he was trying to get onto the lease but was having some issues with mold growing in
the unit and they were having problems with the management getting things fixed. He told me a third
person has been staying at the house and his name is Richey. They were having issues with construc-
tion workers coming into the house and Richey was asked to stay because they always wanted to have
someone there when the construction workers were around. Kaplan was asked how this explosion
could have happened in the apartment. He told me he was sleeping in the guest room and suddenly he
was thrown off the bed or possibly jumped out of bed and fell down. He wasnt sure what happened
except that it reminded him of a war zone. Kaplan told me he didnt see any fire, didnt hear any ex-
plosion, he only knows he was somehow tossed or jumped out of his bed and was trying to get out of

the house. He said he could not see because he didnt have his glasses on and he somehow managed to
make it out the front door where Daniel found him and help him find his way to a safe place outside the
apartment. Kaplan said he was only wearing his underwear and someone gave him a coat, (he didnt
know who or where it came from). He said he saw the apartment on fire but did not remember getting
burned or how that happened. Kaplan said he typically gets up in the morning between 7 and 9 AM.
He said he works at Microsoft as does Daniel. Schultz works at an alternative care center in White Cen-
ter. He told me that Richey Schultz makes hash oil but there isnt anything he uses that would cause an
explosion.
Kaplan told me he is a patient of the alternative medicine due to back pain and prefers the oil to mari-
juana. When asked if hash was being made at the scene, he said no. When I asked him if he knew
what Richey was doing up at 5:30 I the morning, he said he didnt know that either except to say he
probably was getting ready to go to work.
I asked Kaplan if anyone would have been smoking cigarettes in his apartment this morning. He said
they all smoke cannabis but he and Daniel were sleeping and he thought it too early for Richey. They
have a fireplace in the unit but it has never been used. They have electric heat and no gas. Kaplan in-
sisted he had no idea what could have caused an explosion and/or fire.
Kaplan told me Richey drives a red Pontiac Trans Am that should be parked in the parking lot directly
outside the apartment. He did not know the license number. When I asked him where Richey is from,
he told me he lives in Chehalis.
The interviews at Harborview Hospital ended at 1000 hours and I drove to the fire scene to update and
brief Detective Hoover.
1030 hours,
After briefing Detective Hoover on my interviews at Harborview I contacted Detective Lindquist who
began a search for the red Pontiac Trans Am. It was my opinion based on my conversation with Schultz
and his statement that he had taken stuff out to his car; that there may be evidence pertaining to the
origin of the explosion and fire in his car and that it should be towed away for safe keeping. Detective
Lindquist advised finding a red Pontiac Trans Am on the south side of building KK. The license number of
the car was ALGO765, Washington. This car was registered to a David R. Sandy of Chehalis, WA. Be-
cause Schultz is also a David R. and he is from Chehalis and there wasnt another red Pontiac Trans Am
around in the entire complex and this one was directly outside the KK building, I advised Detective Lind-
quist to seize the car for a possible search warrant at a later date.
I then began taking scene photographs of the area around building KK and by using the Fire Depart-
ment latter truck, took several photos above the building, (see RKT-1).

0945 hours,
I made contact with Tyone Fellows who is a construction worker at the Hampton Greens campus. He
stated he is on a project replacing all the windows and sliding glass doors for the entire complex. He
specifically told me he went to building KK unit 202 because they needed to get into that apartment to
work on the sliding glass door for replacement. He said there was some type of compressor on the deck
of the patio that was next to a liquid that he said appeared to be cooking oil and it smelled like some-
thing he could not describe. He said the compressor he thought was electric because there was a cord
going back into the apartment and the slider door could not shut because the cord was going through.
He said he had to contact the occupant to get him to take the contraption back inside so they could
work on the door. Fellows said the person who he spoke to at the house was possibly Middle Eastern
decent. This was about two weeks ago. Fellows provided me with a tape recorded statement concern-
ing these facts, (see attached statement).
I also took a tape recorded statement from Richard ONeill, the Hampton Greens Apartment mainte-
nance supervisor. ONeill told me he was familiar with building KK and specifically unit #202 because a
couple weeks ago the maintenance workers could not get into the unit to make some repairs. He said
he went to the door and could smell the odor of marijuana coming from inside unit 202. He said he
knocked on the door a couple times and nobody answered so he put his pass key into the door. Imme-
diately someone yelled at him not to come inside. About a minute later a male with dark long hair an-
swered the door but only partially opening it. ONeill said there was no question about the smell of ma-
rijuana emitting from this unit but there was also another odor he could not describe that was a chemi-
cal smell. He observed a compressor that appeared to be making some sort of liquid that again he had
no idea what this was about. After leaving the apartment he immediately went back to the office to
report and make a written statement as to what he had observed, (see attached taped statement from
ONeill).

9:21 a.m. This is an interview related to case 13-54055. And Im at Overlake Hospital in
the parking lot in my car with Daniel J. STRYCHARSKE.

S: STRYCHARSKE.

D: Okay. And Im gonna spell that. Its S-T-R-A-Y-C-H-A-R-S-K-E.

S: Wait. Theres an A?

D: Okay.

S: If you have A-Y, thats wrong.

D: Okay, so how about this? You spell. Would you just give me your full name and date of
birth and spell your last name.

S: Yeah, yeah. Full name, Daniel James STRYCHARSKE. Last name, S-T-R-Y-C-H-A-R-S-

D: And are you the leasee of that apartment?

S: I am.

D: And but you have people that are currently either living with you or staying with you, is

S: I have, I have two other people staying with me. One is more of a permanent occupant.

D: Okay. And who would, who are the people that are staying with you currently, and if you
can tell me how, what their status is then of

D: Occupancy.

S: Jesse D. KAPLAN. He is essentially my roommate but he is not on the lease but he is
considered an occupant. David Richard SCHULTZ the second. He is a business partner
and he has been at the apartment for, perhaps a month or a little bit more than that. He
owns a residence in the southern part of the State, so he usually springboards back there,
and then, comes and stays with me for a bit

D: And how long has Jesse been staying there?

S: Since April.

D: Okay. Is that your move-in time?

S: My move-in time was in March. He was in a different apartment for a small overlap period
at the end there, so he finished out his lease term at a different apartment complex, and
then, moved in the end of April.

D: Okay. And your cell phone is 304-279-9135?

S: That is correct.

D: And what do you do for a living?

S: I am a computer programmer.

D: And how about Jesse, what is he doing?

S: He is a software developer, engineer and test, an _____ at Microsoft.

D: Okay. And David?

S: He is a, he has his own personal investments and businesses. So, hes an entrepreneur
or however you want to say that.

D: Okay. Does David SCHULTZ go by Richie?

S: He goes By Richie Rich usually.

D: Okay.

S: Yes.

D: Is he rich?

S: [laughs] I guess. [laughs]

D: Is he? Okay. Alright. So, tell me a little bit about the layout of your apartment.

S: The layout of my apartment, the, upon coming into my apartment, theres an open space
that extends about 10 feet into the room, maybe 12 feet. This consists of the living room
on the left side and the dining room on the right side, going Theres nowhere for it to go
except patio door on the left side which then leads out of the apartment complex, the
apartment on that side of the wall. Going to the dining room, on the right side still, as you
continue into the apartment, youll come into the kitchen. That is a through-way kitchen
and that goes right into the bathroom door and into the bathroom. Going past the kitchen,
but before the bathroom, taking a left, theres a hallway that then leads to the two
bedrooms. The guest bedroom on, in, straight in front, and the master bedroom on the
right side, and the master bedroom is connected to the bathroom.

D: So, the apartment has only one bathroom that can be used by two entrances to the
bathroom?

S: Two entrances to the bathroom.

D: Okay.

S: Public and one private in the master bedroom.

D: And you were nice enough to help me out with the diagram of your apartment here while
you were

S: Uh-huh.

D: After your initial consultation with medical staff here, so I appreciate that.

S: Uh-huh.

D: And you drew, do you recall drawing this diagram for me.

S: I do.

D: And you indicated on the diagram that you primarily use the guest bedroom.

S: I, in fact, one hundred percent, use the guest bedroom as my bedroom.

D: And Im thinking thats, usually as a guest bedroom, its usually a smaller bedroom than
the master?

S: It is slightly smaller, yes, uh-huh.

D: Alright. Who, who normally is assigned to the master bedroom then?

S: Jesse has his stuff in the master bedroom.

D: Okay. And that would be like his normal personal property.

S: You could say thats his, yeah.

D: Or beds and the like

S: Yeah, you could say thats his room.

D: Okay.

S: But, really, he stopped, he stopped using it for the last, like month or two, primarily
because the mold problem, and so, has been sleeping in the living room.

D: Okay. And would it be fair to say that the master bedroom is a corner bedroom and has
two windows in them?

S: Corner bedroom with two windows, one large window that opens, and another smaller
window that is sealed and unopenable.

D: Okay. And do you have like aso, youre on the second floor but it sounds like, from our
conversation here at the hospital, that the building is situated kind of in a hillside.

S: That is correct.

D: To where

S: The second level is actually at ground level.

D: Okay.

S: On my side of the building.

D: Okay. So, it would vary though.

S: But as you then go to the other side of the building, you go down

D: Okay.

S: Steeply to the point where there are two apartment units on the first floor. And theyre also
at ground level, so theres a hill that were on.

D: Okay, perfect. So, how do you, how do you know Jesse then?

S: I mean Jesse and I have been friends for, since 2009. We were together at a place called
Airtight Games.

D: Currently?

S: Not currently, no, no. We worked there in 2009 for about a year. We worked together as
testers. And then, after that initial meeting and, and working together, weve just stayed
friends ever since.

D: And how long have you been in Washington State?

S: Um

D: Approximately.

S: Approximately since 2004, minus two years.

D: Your phone number is a West Virginia area code?

S: That is a West Virginia area code __...

D: Is that where youre born and raised?

S: No.

D: Okay.

S: I was born and raised in Wisconsin.

D: Okay.

S: My parents and family, for the most part, lived in West Virginia.

D: Alright. Thank you for doing the background with me on this. So, now, were gonna talk
about this morning.

S: Uh-huh.

D: And just, Ill probably interrupt to seek clarification on some things.

S: Okay.

D: But youre very articulate in terms of describing things for me, so just, I would like to either
go step by step if you canand hows the temperature doing in here? Is it good?

S: Were good.

D: Okay. Let me know if it gets too hot or if you want warmer, okay?

S: Okay.

D: Alright. So, wont you go ahead and tell me about what happened this morning and how
you came to be at Overlake Hospital.

S: Okay. I guess, to begin, I found myself waking up this morning to falling debris and pieces
of wood to me where the apartment above me is coming down on me. The moment I
completely realized that this is what was happening, I bolted out of my room and not
through the door. I ended up going out through the wall because the, the way I was
seeing it at that moment, the apartment on top of me was coming down. The wall had
blown out from the apartment coming down and there was a clear exit for me. I literally
just got up and started running and realized I was outside of the apartment. At that
moment, I turned around and began to just see if, what has happened to Jesse and
Richard. At that point, that was when it seemed to me that the fire began, was at that
moment right then because there was no, there was no flames and, and fire before that.
And then, as soon as I started yelling for Jesse, I saw him beginning to come through the
debris, and he was like, Where was I? Was I in my room or the living room? Like he
didnt actually even know at that point. He was disoriented. I, and then, at that point, we
both were thinking about Richard, and that was when we started to see the fire. About 10
seconds, 15 seconds later, theres, a person approaches us through the debris, and its
Richard, and he is burned pretty badly, on his arms especially. Jesse seemed to be
maybe singed a little bit, but otherwise, he was looking physically okay. Obviously, Im no
doctor, so but he was talking. We were on our feet. Richard eventually had to sit down
and he was taken to the hospital by a private individual who was helping out at that
moment.

D: Okay. So, youre in bed, asleep when this whole situation occurs.

S: Right, correct.

D: And I noticed in the hospital and I noticed it when youre looking at your diagram here that
you must wear some type of eyeglasses cause you have a hard time seeing close up.

S: Right. I definitely do wear eyeglasses. I also have contact lenses, all of those missing
now, so

D: Okay.

S: Right now, my vision is at a, about a less than one foot excellent focal visibility.

D: Okay. So, you wake up to

S: Chaos.

D: Okay. Can you differentiate it between hearing an explosion or just feelingI think you
mentioned the term pressure.

S: Right.

D: And debris.

S: I, I, I guess I cant differentiate it because of the speed with which it happened and the
quickness with which I removed myself from it.

D: Okay.

S: It, definitely, there was like a weird point where I dont, again, I dont know if it was
disorientation or whatnot but there was perhaps one point where, as I was like crawling, I,
I, I maybe thought it was like hot. But then, I quickly was outside, and that was quickly
dispelled, so Im, you know, Im not sure what that leads to, but that was the only other
thing that I could, in a sense, recollect.

D: You have a wood, a window in your guest bedroom. Do you know along what direction
that wall is?

S: I, it is mostly east-facing.

D: Okay.

S: If Im not mistaken.

D: So, to help me clarify for the recorder, which is hard to do sometimes

S: Uh-huh.

D: Your laying in bed, you wake up to an event that is occurring immediately that caused you
to wake up.

S: Yup.

D: That includes the things that youve talked about which includes debris. It includes that,
the wall, your east wall then. Well just call it east wall.

S: Yeah.

D: That has the window. Has a hole in it or its

S: It seemed to, like it had

D: Its an opening at some sort

S: Theres a, there is now an opening and that, upon looking backso, obviously, things
were falling behind me, so I cant know if part of that was the wall afterwards but I had no
resistance.

D: Okay. You

S: Outside of the things that where I was crawling over.

D: Okay.

S: I had no resistance of a, of being able to crawl through my east wall, so.

D: Okay.

S: There was a hole or it had fallen down or had been shaken and crushed.

D: Okay.

S: Through this event.

D: So, what were you wearing then at the time that you escaped from your bedroom through
your east wall?

S: I was wearing a, a pair of pajama pants that are baggy and I was wearing a simple, plain
white T and nothing else.

D: Okay. Youre barefooted?

S: No socks, no underwear. No head gear of any kind.

D: No footwear?

S: No footwear.

D: So, you crawl out of your east wall outside your apartment and you turn around and look
at your building.

S: And I see

D: But now, can you see fairly decently then when things area way from you? And how far
are you from your building when youre making observations, approximately?

S: Okay. So, lets see. I am approximately 20 to 30 feet away.

D: Okay.

S: When making observations and looking back at it.

D: So, youre trying toand I dont want to put words in your mouth but are you trying to get
your mind about what the heck just happened and why am I crawling out of my wall?

S: Yeah. I, definitely, thats likethe crawling out was just like

D: Instinctive?

S: Survival instinct.

D: Okay.

S: The moment I realized Im out, Im in a place. I went like, at first I thought it was a dream,
to be perfectly honest with you. I thought it was a dream at first and it was just chaotic and
I would wake up soon. When I realized I wasnt going to be waking up cause this was
real, I then realized that I was in the lawn in front of the LL building, which is the building
right next to mine. So, Im near the, theres a tree right out front and the carport. Im
basically between those two and Ive now gotten my head around the fact that this is real
and I just crawled out of my apartment and, in a way, I should not have been able to do.

D: Okay.

S: And then, I turned around and looked back and..

D: And what do you see?

S: I see the corner of the top apartment has bowed down now.

D: Okay.

S: At this point, probably four feet.

D: Over the corner of your master bedroom.

S: Over the corner of the master bedroom at that point.

D: Youre

S: Upon now looking back, it is clear the entire, either through this or some other mechanism,
the walls were, were down at that point. And, and

D: In 202.

S: In KK-202.

D: Which didnt provide support to the apartment above.

S: Above it, right. And so, at this point

D: And what else did you see?

S: Im looking into my apartment and Im basically looking like the wall of my closet, sodo
you have that picture still?

D: I do, I do.

S: Theres on the, on the far side across from the window.

D: Here it had been

S: Of my room. Theres a closet.

D: Okay.

S: This wall, that closet wall was still intact.

D: So, its a closet along that would be along the hallway?

S: It

D: Side of your room?

S: Yeah. In my room, along the hallway closet. And then, that wall, the one that divides the
closet in the hallway, was definitely still there.

D: How about can you see into the master bedroom?

S: I could see into the master bedroom at that point most definitely. It looked like some of the
wall between my room and the master bedroom was still intact as well but, at that point, it
was, there, there was just a lot of debris flying around. I mean a lot of smoke and debris
and ashes and, and particles, sorry. Thats what I mean. Particles of stuff.

D: Okay.

S: Just kind of everywhere.

D: In the air.

S: Yeah.

D: In the air and on the ground?

S: In the air and on the ground. And then, at that point, that was when Im making these
observations and I am yelling and screaming my roommates name at the top of my lungs,
like, Jesse, Jesse, Jesse, cause Im thinking he might be dead.

D: Sure.

S: Like Ive barely got out of there kind of thing, like fuck. And so, I

D: Where did you see him come out of?

S: He comes out of essentially, like theI dont know exactly where he came out of because
when I, because I turned around, just sort of like, Help, like trying to see like

D: Uh-huh.

S: Just tried to assess things somehow. By the time I turned back, he was already just
outside of the apartment, walking through the rubble like I had. He didnt go through the
front door either, right. So, hesand then, hes like then walking like towards me. I ran
to him and I helped him out. Hes okay but hes totally shaken up.

D: So, does is he coming out a wall?

S: I dontlike he is coming out the same east wall basically.

D: Okay.

S: So, the, the, like

D: Alright.

S: Say the east wall of the building, I dont know exactly where at what point he came from
but hes coming to me from the east, through the east wall.

D: You know, one of the things I forgot to do, since its, we have a recording going on, Ive
been holding the recorder, and I told you that, about the microphone and stuff, is it okay
that we record our interview today?

S: Oh, absolutely. Yes.

D: Okay.

S: Yeah, yeah.

D: Ive been holding the recorder here while were talking in my car, so I just, I forgot to put it
on the...

S: Huh.

D: Like the official record.

S: Yeah.

D: In the State of Washington, when somebodys recording your voice, you should get a
verbal acknowledgement from them. So, sorry. Im a little late but

S: Thats totally fine. I guess I, we had agreed upon that earlier, so.

D: Right. Okay, so when Jesse comes out, do you, is he disheveled or is he

S: Hes in his boxers. Nothing but his boxers.

D: Okay.

S: [laughs] He, um, uh

D: Any injuries that you can overtly see that you were cognizant of or maybe

S: I, Im like, I, I went up and was like grabbing him by like the shoulders and whatnot and I
just, uh, he, he felt like he definitely had some, like he was pure skin. You know, he had
boxers on, so he had stuff. Like I dont know if it was like embedded in him or, or whatnot
but I was like brushing stuff off of him and I dont know how bad his injuries were.

D: Okay.

S: But he mentioned later that he was gonna go to the hospital with Richie because he
wasnt sure if he might have burn injuries as well or not.

D: Okay.

S: So

D: So, lets, lets clarify this for the record.

S: Uh-huh.

D: In terms of things being embedded or being on him

S: I dont know.

D: Would he

S: I would say they were on him because I was brushing them off of him. So, like as I was
holding him, I was just kind of like brushing.

D: Okay.

S: And, and that was about it really, so.

D: Did you see anything with hisso, Im always careful not to put words in peoples mouths
but in terms of overt injuries, it sounds like you didnt observe anything overtly.

S: Right.

D: Was there anything like anything on his face or

S: Um

D: Keeping in mind that you cant see when youre close up, so.

S: Right. I mean like that, thats the thing. Like I, I wouldnt feel comfortable saying anything
about that.

D: Okay.

S: Because at that moment, like I, I couldnt actually see. It was very, it was also dusk or
dawn, I guess but, but it was not, it was pre-dawn at that point. You know, like

D: So, talk about that for just a second.

S: Okay.

D: So, whathow dark is it there?

S: Its like the sun is, its still the very dark-blue nature of the sky.

D: Okay.

S: You can tell the lights coming up in that, actually in the next like 30 minutes, were gonna
be having light.

D: Okay.

S: But at that moment, its like that pure, pre-dawn where visibility is very difficult and low
from low light. I, I dont know exactly when this occurred but I do know that after I ran out
and after wed assessed ourselves for a second, and we realized Richie needed to get to
the hospital. I asked

D: Before, before you do that

S: Okay.

D: Im sorry. And I, I warned you Id interrupt.

S: Yup.

D: So, in your mind, Jesse does not need any overt medical attention at that particular point.
Youre still assessing each other.

S: Right, right. Were still assessing each other.

D: And you

S: I know I can feel myself. I feel good and I feel like Im, Im pretty injuredly, injuredless.

D: Okay.

S: With Jesse, I looked at him and I tell he was, whatever closer.

D: Okay.

S: To whatever it was. I can tell that he had a bigger impact than I had.

D: Okay.

S: However, it looked like he was on his feet. He was talking, he was breathing. No overt
injuries, though I can tell hes more shaken up than I am.

D: Alright.

S: Right.

D: But you still dont know where David is.

S: We still do not know where David

D: When did

S: Richard is, right.

D: And, and so, what do you want to call him? Do you want to call him Richard or David?

S: Richard.

D: Okay.

S: Richard would be easier.

D: So, well tell, well call David Richard SHULTZ II, well be calling him Richard from now
on?

S: Yes.

D: So, when does Richard come out of the apartment and what does he look like when he
comes out?

S: Hes a mess. And thats aboutand thats also after the fire has started as well.

D: Okay. So, what

S: So

D: Give me a timeframe on what

S: So

D: What happened when

S: Jesse comes out.

D: Okay.

S: I assess with him 10 seconds, 20 seconds, 30 seconds, probably later.

D: Uh-huh.

S: Were both at that point then, Wheres Richie at? Were both, you know, we both see
and look that a fire is starting. I

D: Where?

S: Uh Essentially, it looks, its, its definitely coming from my apartment at that point.

D: Okay.

S: Um

D: Any particular area?

S: I, thats, thats where its, its now trying to place it, just because of all theId say like, Id
say the kitchen. Like the, the, like where the dishwasher was in the kitchen, which is, you
know. So

D: Okay.

S: So, yes. I would say it came from

D: So, then

S: It started from the kitchen.

D: So, now, Richard comes out.

S: So, now

D: Whats he dressed in?

S: Then, at that point, were, yeah, were scream for Richard. We see a body coming, a
shape coming through but hes not responding to us, so we, we get close enough to him
and we start to pull him out, and he, he has clear burns like all over his skin.

D: Okay.

S: Like on his, sorry, on his hands. Not all over his skin. On his hands.

D: Is he a black male?

S: He is, um, not black but he, I believe he is a mixed Native American, Caucasian.

D: Okay.

S: So, he, it looks like his hands got, got jacked pretty bad.

D: Okay.

S: Like it definitely looks like his, his stuff got messed up.

D: Is he

S: And it looks like

D: Is he coming out of the holes that you guys were coming out off, had come of?

S: It, it, it looked to me like Jesse and Richie, Richard came from the same spot.

D: Okay.

S: So, yeah. Like wherever exactly that was, it was somewhere coming through the east wall
again.

D: Alright.

S: The door was not being utilized at that point.

D: And so, what was being said now to Richie, Richard?

S: Um, atwell, at that point, Richards just like, just like he basically literally is like shit. Like
the skin is melting off my hand. I looked at it and I can see that, yeah, theres a piece of
his hand is beginning to peel away pretty badly.

D: And youre talking about his right hand?

S: Um, my ride side, so his left hand actually.

D: Okay.

S: Uh-huh. And it looked, it looked actually like both hands were, were in pretty bad shape.

D: Clearly, it need medical attention.

S: It clearly needed medical attention, and that was where, that was when like there was a
gentleman who had come out from the LL Building whos clearly obviously saw what was
going on and looked at Richard, was like just got his keys and everything. It was just like,
Get in here because you need it now. Like, The ambulance are gonna take time. You
need to get to the hospital right this second. So, hes, I dont know that gentlemans
name or any of his information.

D: He, he took Richard to the hospital?

S: He, Richard and Jesse both. Jesse accompanied Richard because also, at the same
time, he was saying, Im actually kind of feeling like I should get checked out. Like, right.
So, he took a precaution for himself. Richard definitely needed it, and I was staying
behind so that I could just, Im the one on the lease.

D: Okay.

S: I figured I needed to be there at that point.

D: Okay.

S: But, and

D: Did they say, did anybody, did Jesse or Richard say anything about what had happened?

S: No, no. Like neither one of us. Or, or I thinkuh, give, give me a second to try to like, uh,
remember exactly what was said during the, that moment.

D: Cause sometimes I think with roommates, youd go, What the hell just happened?

S: Right. I mean no, that, that was, that was definitelybut well, to be perfectly honest, my
first thought was, Holy shit! The dry rot and the mold and everything. But just, weve
been worried about the structure.

D: Okay.

S: And the safety and that the health, and our personal health and the hazards of the
building. Weve been worried about that. Those are some of the things wed brought to
the apartments attention. So, that was in my initial instinct, right. Then, when of course,
when I see the fire go up and I hear the, the remaining cans of butane that are in my
apartment pop off, thats when I, I start to think I cant believe it would have been anything
that had gone wrong in that process but its a possibility, you know.

D: Okay.

S: So, like thats, thats the part where I was thinking that I dont, I dont recall a, I dont think
we said anything to each other outside of like, What the hell was that? What, whats
going on, cause Richies basically in shock.

D: The medical, medical issues need to be addressed.

S: Right. And, and, and so, we were, we were just like weve got to do that. And Im running
to the LL Building and Im pounding on everybodys door like, Wake up, wake up, wake
up, fire. Like I woke everybody up in that building, got them up and out cause

D: Are they that close to you?

S: It, the thing is it looked like the, it looked like the flames were, were going to be potentially
encroaching on those. Theres, um, where my patio is, theres a small hill, and then,
bushes and the, and the building. So, its like its 5 feet.

D: Oh.

S: Like Im thinking no need to be taking stupid, no need to not tell everybody because
something clearly happened in this building and it is going up in flames. Everybody
around here needs to know that right now. So, I woke everybody up in the LL Building.
And then, and in doing that, yeah

D: This is four apartments?

S: Uh, the LL Building has one, two, three, four, five, six, seven, eighttechnically, it has ten
but I only reached eight. I only, because at that point I noticed that the whole, everybody
was waking up on all around, all around us.

D: Okay.

S: All the buildings around us were waking up, so.

D: So, lets talk about then the, the butane canisters and stuff.

S: Uh-huh.

D: Tell me, tell me whats going on with what iswell, let, lets just get, before we get into
that, lets get this issue of mold and stuff in your master bedroom

S: Oh.

D: Out of the way here. So, theres been an issue in your apartment related to mold in the
master bedroom?

S: Uh, mold throughout the apartment but very much the master bedroom is the, the big spot.

D: And that has been something that youve been dealing with the apartment management?

D: Okay. And through, along with the mold issue, youve had conversations with
management about a marijuana extraction.

S: That is correct.

D: Issue or

S: Uh-huh.

D: Process.

S: A process thats going on.

D: Practise.

S: Uh-huh.

D: Okay. So, tell me about, tell me about that.

S: Okay.

D: The marijuana extraction process thats going on in your, in your apartment.

S: Okay. Um, to give it a more specific name, its a hash oil butane extraction.

D: Okay.

S: Um, to just give a quick overview of the, the general process

D: Perfect.

S: You take cannabis material, you stuff it into a glass tube. You seal the open end of that
glass tube with a micron filter so that it filters certain, to a certain width. And then, at that
point, the tube is set up such as a can of butane can be pushed through it and it, it actually
takes the butane from gaseous form to liquid form. And the liquid butane then runs
through the cannabis, extracting the THC.

D: By gravity? By gravity?

S: By gravity.

D: Yeah.

S: Yeah. By, by gravity and pressure at that point but mostly the gravity helps a lot. And
then, at that point, the, the butane liquid is extracting the THC and CBD oils out of the, out
of the, the cannabis material.

D: And where do the oils go then?

S: That then goes into a glass container or glass jar of some kind. The butane, and that
chamber can be put through a vacuuming process to stretch out and to more quickly
remove the butane that is still contained within the oil. Once this process is completed,
you have hash oil but the THC or CBD content of

D: CBD meaning?

S: Cannabinoids.

D: Okay.

S: Its a difficult word to say but its a, the CBDs are definitely the more of the, um, pain
reliever aspect, and the THC is more of the, the, the, like head high in that kind of
medicinal effect. So, its two different types of medicine at that point if, if you wanted THC
or CBD, all done through the same process though. At this point, that, that is, thats all
that the butane ends up being used for, the shot-through a tube. And then, at that point,
theres no, there are no flames and there are no ignition sources.

D: How big, how big of a container is the, are, is the butane in?

S: The butane is in a slightly bigger than a 12-ounch can, so I would say 14 or 16 ounces.

D: So, is it poured into the tube over the canabis or just squeezed in?

S: No. The way its, its, it is definitely a, its a pressurized, um, can.

D: Okay.

S: And it has a knob on the top, such that when you push down on the knob a little bit, theres
a hole in the middle of that knob, and thats where the, the gas shoots out of it The glass
tube is set up in such a way that it kind of has like a nipple at the end that then this knub
goes into.

D: Okay.

S: And as you push the can into it, shhhhhh (sound)

D: Okay.

S: The, the pressure inside or the pressure differential inside versus outside create, makes
the gas go immediately to a liquid. And then, it runs through and extracts out, um

D: And where does the liquid thenso, the liquid from the butane

S: And the THC and, and cannabis material

D: Is all, is mixed.

S: Is altogether mixed at that point, and thats why

D: Thats at the bottom of the glass tube?

S: Right, through the screen that you put on there.

D: Okay.

S: That filters out. That makes sure you dont get any of the actual plant matter and whatnot.

D: Okay.

S: And then, you also can screen it to a particular level that you want. And then, that can be
for a different medicinal, medical reasons as far as like, um, how much THC, how much
CBD, et cetera.

D: Okay. So

S: That, that, all of that is a liquid form in the bottom. In, in like a glass, um, container of
some kind.

D: And then, the oil and the butane oil

S: The butane liquid at that point.

D: Butane liquid and the oil are combined. And how do you separate those two?

S: So, the, thats where the vacuuming process and evaporation comes into it. The
evaporation can occur naturally but its normally put through a vacuum. What the vacuum
does is it stretches out the air, thus pulling the oil apart and allowing more of the butane to,
to, to get out from the, the molecular structure of that oil.

D: So, is, is the glass that the butane liquid and the marijuana oil drops into, is that a kind of a
beaker that then can, a vacuum system can be attached to it then or

S: Um, right. It, it ends up being a, a, um, well, its actually more of a flat dish then, as that
gets to a certain point, cause it fairly quickly actually gets to a point of being malleable as
opposed to a liquid. So, then, what itthen, its scraped off and put onto parchment
paper. And then, the parchment paper is put into a vacuum tank. So there, so there,
there are two pieces of glass here. The one thats, when it comes down onto first initially
as a liquid.

D: Okay.

S: Very quickly, like within, I dont know, 20 minutes, it will become malleable. It is such that
you could like scrape it with something. And then, that gets put on to parchment. It will
get scraped out and put on the parchment paper. And thats when it goes in the vacuum

chamber because the parchment paper is easier to work with inside of the vacuum
chamber.

D: Okay.

S: So, the vacuum chamber is a, a cylindrical glass jar. Parchment paper goes into it. And
then, the seal top goes on. And then, the, the vacuum pump is turned on.

D: So, is this a kit?

S: Its not a kit. It is, uh, lab equipment thats

D: Okay.

S: So, so, this was not something that like all came together as one unit that was like sold.
No.

D: Okay. So, is it something thatso, who, who developed the, the process and the
equipment?

S: Richard.

D: And hes only been there for a few months.

S: Uh-huh.

D: So, did he bring that in with him or did he develop the process ?

S: Uh, he brought it in. He brought that to us. In a sense, its like we met at, at hemp fest.
And so, the, that was where the topic came up. And then, he showed us. And that was
where we were interested in it and wanted to, for, you know, to see it further basically.

D: Okay. So, the equipment belongs to Richard.

S: Um-huh.

D: And where was the equipment set up then to do the processing?

S: The dining room.

D: Okay. And so, the butane canisters, how many do you think were in your apartment
before the ex, the incident this morning?

S: Ten, a dozen maybe.

D: And how much marijuana was in there?

S: Oh, actually, theres likebut heres another distinction. There was, there is actually like
bud level marijuana.

D: Okay.

S: And then, theres trim which is essentially bud level marijuana gets to that point because
its been trimmed.

D: Okay.

S: All the trimmings that have occurred, that actually was more what was in, in the apartment
and there was probably, __ a couple pounds.

D: Okay. So that

S: Cause it, it takes, it requires a good amount of trim in order to be able to do this.

D: Isnt trim noted, usually the kind of the waste product of marijuana plant?

S: Right but that, right. Its, its the waste product in the sense that the buds are what people
want cause it looks good, tastes good but the, the amount of THC and CBD in those
leaves and the trim

D: Okay.

S: Is still going to be high.

D: Okay.

S: And so, thats where, thats where its an extraction because you dont want to be using
that kind of trim to smoke or anything like that but it still has good stuff.

D: Okay.

S: So, you, you use some sort of a, um, like gas to liquid extraction like this. Um, and the,
this is a known process that has been developed and, and used in this industry for
decades.

D: Okay. So, the process doesnt include any open-flame device.

S: Absolutely not.

D: Okay. But it does include electricity for the vacuum system?

S: The vacuum and the butane are never on at the same time but in the sense of the process
that, yes, the vacuum at the end would require electricity, um, in order to, to turn on the
well, yes. Sorry, yes, huh. It still, it also uses, uh, uh, like vegetable oil to, to act as a

lubricant and for the oil of thebut it is also plugged in to get the power because its a
vacuum, it requires a lot of suction.

D: Okay. And is it yourso, thats in the several months that Richards been staying there
that he, he set up that process. Youve been, youve been dealing with that process
because, its my understanding from our earlier conversation

S: Right.

D: In the hotel or the hospital, rather, that not only has management seen the equipment but
Bellevue Police had been over?

S: Right.

D: To check it out?

S: Right. So, about two and a half weeks ago, probably about three weeks ago now at this
point, um, there was a police incident that the management company, at the request of
one of the maintenance workers, not the construction workers but their maintenance
worker came in and fixed my, my shower was clogged. He obviously saw the equipment,
didnt know what it was, figured he, you now, I dont blame him, so he went to
management, told them about it. They decided to just call the police right away and get,
and send them over to my apartment. I was not there actually at the time. Jesse and
Richard were. Um, but that ended up, that entire conversation ended with the police
officer saying, You guys are doing nothing wrong and youre not actually running a
business out of your apartment, so thats not illegal either, and you all have your
paperwork. So, he

D: Okay.

S: He, at that point, was like, Uh, theres no reason for me to be here and there was actually
no reason for me to even have been called here. You guys are more than covered. So,
at that point, we, we just continued then doing, continuing on with the process at that
point, uh, and, uh, the apartment management hadnt brought it back up since and, and
so, it seemed to me like that entire conversation had been finished between myself and
the apartment complex.

D: And well get to that a little bit because I understand that you have some kind of awell,
lets, lets, lets try to, lets, Im sorry. Lets continue on with thenow, is there any kind of
state, medical recommendation that you have to, to do this process or

S: Oh, I, I

D: Can you tell me a little bit about that?

S: Yeah, I have a, like all three of us have have state medical recommendations which
allow us to, to a certain degree in a sense of amounts we can make.

S: Hash oils. We can grow plants, we can do X number of things legally.

D: Okay.

S: And we can legally have Y amounts of those things at any given time.

D: For your personal use.

S: For per, for personal use or use within the collective.

D: And you, youve dealt with, through your authorization, through the Hope Clinic?

S: Uh-huh.

D: And wheres that at?

S: That, in Downtown Seattle.

D: Okay.

S: I, Id be able to get you the exact address.

D: Okay.

S: But not just this moment.

D: And what is your medical condition that you went through this process to get the state

S: Yeah. In, um, in the 8
th
grade, I suffered a, uh, somewhat severe, uh, back twist, a back
injury basically and, since then, um, smoking marijuana has improved my quality of life.
So, that was the, thats the med, the reasoning behind why I have it.

D: So, the extraction, the extraction process is to get like hash oil then?

S: Uh-huh.

D: Is that, would be the

S: Yeah.

D: Okay.

S: Yeah.

D: And so, and hash oil then would be eventually a product that can be smoked then or put
on cigarettes or

S: Uh-huh. Right. It, it actually can be a, mostly its vaporized. Um, meaning that theres a,
uh, a metal nail, for lack of a better terminology. Its the most common way of, of imbibing
it but basically you, you take a small torch. Um, like say a lighter torch, right?

D: Uh-huh.

S: And then, you heat up this nail or if you already have a

D: You mean like a nail that is

S: Like, like, its a, like a, a

D: To build something?

S: Yeah. I, I need to describe it a little bit more.

D: Okay.

S: Because its a nail but then, it has a fixture around it that has several holes in it for the air
flow.

D: Okay.

S: And then, a rim around it to protect the substance from getting out.

D: Okay.

S: So, its a bowl, but on the bottom of it is a nail. And you end up heating that nail up so that
you can vaporize the hash oil.

D: Okay.

S: And then, so then, youre doing it like a traditional water pipe at that point. In fact, you
could use a traditional pipe and just have a new piece put on it for this. So, thats, uh, the
butane or its, uh, the, the nail is heated up. And then, at that point, you just dab it. Its
often called dabbing. And because, you, you know, usually take a little stick and you have
a little bowl of it at the end and you just stick it on the nail and it vaporizes and heats
instantly, and so, then, you just inhale at that point.

D: Okay.

S: And its actually much safer and much more, um, uh, healthy for you because youre not
actually burning plant matter. Youre vaporizing good medicine.

D: Okay. Is the extraction process paperwork, is that different than

S: Um

D: Paperwork that you have then?

S: Uh, the extraction paperwork, it, I guess that is where there might be a kind of gray area
because of the legality issues currently going on. However, I know that Richard has the
information that, cause he has been doing this in the, in California as well. Uh, and hes
been in this medical industry for 15 years, so he has the proper, um, license at that point
in a sense to be able to do this, though our medical recommendations, from the way I
understand it, allow us to do this up to a certain amount.

D: Okay.

S: What he provides us, just being able to, if we wanted to go past that at a certain point.

D: Okay.

S: So

D: So, the equipment that would be in your apartment in your living room area, including all
the glassware and anything, the paraphernalia related to doing the hash oil process, would
that be Davids or Richards stuff or

S: Yeah. And I mean I, it

D: Or you guys share costs

S: There, there could, there could potentially be one piece of glassware, like one of the bowls
that I grobbed from Goodwill.

D: Okay.

S: Or something like that. But, otherwise, the, the bigger pieces like the, the glass tubes that
the stuffed with the trim

D: Uh-huh.

S: The, the vacuum pump, et cetera, yeah, those are, those are his. He brought those with
him.

D: And do youso then, the finished product is used by all three of you?

S: Right.

D: Okay.

S: And its, its used between the three of us and we, at that point, it is a donation, uh

D: If you give it to somebody else.

S: Then, theyre allowed if they have, they, and they, of course, always have to have their
paperwork, right.

D: Do they have to, are they allowed to use it then in your apartment?

S: Um, yes, because, at that point, we would both haveI wouldnt want them to, but legally
speaking, they would be able to. However, we did not do any of those sort of dealings out
of our apartment because of the fact that, on the lease, it says we cant. So, we cant
actually run a business, which technically its not, but even if they wanted to look at it that
way, we werent running the business out of the apartment.

D: Okay. So, when you find yourself out of the apartment, you were, youre, you have no
glasses.

S: Uh-huh.

D: Your contact lenses are out.

S: Right.

D: You have no, you have a, I dont see that youve had a cell phone.

S: No, my phone is probably gone and burned and melted at this point.

D: Youre, and youre dressed in your pajamas.

S: Yeah.

D: Basically. Richie, what was he, Richard, what was he dressed in?

S: Uh, he was dressed in, uh, jeans. Um, I think he had like a, a pair like snow pant overalls,
like snow pants with the, the overalls on.

D: Like ski bibs?

S: Like kind of, yeah, ski bibs actually, exactly.

D: Shirt?

D: Elf?

S: And awell, its, its long and it hangs.

D: Okay.

S: Like kind of back and down, so.

D: Like an elf in the North Pole?

S: [laughs] Something like that, right.

D: Okay. Yeah, okay.

S: Yeah, yeah, exactly though.

D: Yeah. I havent seen it, so I, its the first thing that popped into my mind.

S: Um, yeah. And then, I think, I think he wears like kind of bracelets andnot like bracelets
but he had like a, a thick thing on. Uh, I forget exactly what it was.

D: Okay. So, if Not a So, if an explosion in there, theyre still sorting through all those
things.

D: I havent really followed through with it. Its an explosion of sorts related to theis this a

D: The process of using butane under pressure to, to put through the marijuana cut

D: To be able to provide you with a hashish oil, slash, butane-fluid type product, that then the
butane is siphoned off as best as possible.

D: To leave a, as clear, as pure of a hash oil product as you can get that stuff. Thats the
whole thing, right?

S: Oh, yeah.

D: Okay. So, that is not done with any fire process but if there is a fume process, fumes in
your apartment from the butane, and somebody uses one of those hot lighters to heat,
heat up

S: Uh-huh.

D: Your nail to be able to use some hash oil

S: I, um, I have a, a, Ive watched the extraction process go on as the nail was being heated
across the room.

D: Yeah.

S: And Ive actually seen that dozens and dozens of times. In, in sense of Ive seen what
it, youre talking about as the potential for it.

D: Okay.

S: And it has not happened many, many times before.

D: But

S: Not to say that it couldnt this time.

D: Especially when youre sleeping.

S: Uh-huh.

D: And would it be fair to say you dont know whats going on in your apartment or this place
then?

S: Right, at that point in time, while Im sleeping, I do not know whats going on out there.

D: What, what time, what time did you go to bed?

S: It was approximately 3 a.m.

D: And who is in your apartment when you went to bed?

S: Jesse and Richard, thats who.

D: Okay. And so, after 3 a.m., so youve beenthis, this event is occurring. I get here at 8
oclock in the morning. So, youve been in bed for maybe just approximately 3, 4 hours or
so.

S: Right.

D: Maybe. Around that period of time.

S: Yup.

D: While youre sleeping, you dont know whats going on in your bedroom with Jesse and
Richard.

S: In the, for the rest of the apartment, right.

D: Cause you dont know if Jesse went to bed? You dont know if Richard ever went to bed.

S: Right. I

D: They may, they may be up.

S: They very well.

D: Doing things, yeah.

S: They could be doing things, yeah. Uh, I, I will say that I actually have no, I do not know
what they are doing in the 4 hours that Im asleep before the event happened.

D: Okay, alright. We took some pictures of some of your superficial scrape injuries.

S: Uh-huh.

D: In the, in your emergency room cubicle. And I did that with your permission, is that
correct?

S: That is correct.

D: And, in fact, you helped me.

S: And I held ruler up and everything like that.

D: Used this. Okay.

S: Uh-huh.

D: And currently I have your clothing that you were wearing at the time. And at some point at
the end of the investigation, whatever it will be, Ill return that to you. Is there anything
thatI am, I am certain at this particular point that an explosion occurred in your
apartment related to some Oh, before I, before I get to that, but keep that in mind, that
little comment of mine. Lets go back to, whats the construction going on in your
apartment?

S: Uh. The construction that was going on outside of my apartment, not inside.

D: Okay.

S: Um, well, scratch that. Mostly outside, and they were coming inside occasionally. Um,
the patios and windows were all being replaced across the entire apartment complex
across every single building because there was a known mold issue with all of those
windows. There were mold factorys. There, it, and I wont get into that detail

D: Okay.

S: Too much right now but it was so, it was extremely bad and it has prompted me, it had
prompted me to, half a dozen to a dozen times, bring it up to the apartment complex to the
point where this morning, Jesse and I, barring any of this happening, were actually going
to be speaking to a lawyer about the potential action we could take against the apartment
because of it.

D: Okay.

S: Um, so, the construction was like five, six-man crews were supposed to be going on each
apartment and, from the outside onlywell, initially, I was told from the outside onlyto
pull the patios and windows out and pop new ones, and then, seal them up. Um, this
ended up getting to the point where they did but they, they told us, Oh, they do have to
come inside to remove blinds, and things like that. And, through that and the interactions
between one of the construction workers and Richard, that was how the police ended up
getting called, along with what the maintenance worker had seen when he came to fix
Cause that actually ended up happening at the same time.

D: Okay.

S: So, I think the maintenance worker also overheard the construction worker soliciting
Richard for medicine. And through all that, I think he got the impression that, as they put
it, we were running a drug ring. The police officer showed up and was like, You guys
arent running a drug ring. In fact, youre doing everything within the legal law, the legal
limits, right, so

D: And that was a couple weeks ago?

S: This was two and a half to three weeks ago, right.

D: Do you have gas for your cooking or is there any

S: No.

D: Natural gas products?

S: No, theres no natural gas line, as far as I understand, in the apartment.

D: Alright.

S: But youll want to probably ask them about that to be sure.

D: Okay. And so, but you dont have a gas-fired

S: No.

D: Fired fireplace?

S: No. No, no, no, not.

D: Or cooking stove?

S: Nope, not. The stove is, um, electric, um, grill top. Uh, theyre coil tops. And then, the,
um

D: Your furnace?

S: The furnace is just electrical.

D: Okay. Alright. If it turns out that thean explosion of sorts originated from your
apartment, what do you think, what, do you have any opinion as to what would have
caused that?

S: A really, really massive fuck up.

D: Of what?

S: Uh, uh, like thatand, and, honestly, I cant.

D: Okay.

S: Like, like it is to the point of, its impossible for me to think that, through the processes that
Ive seen happen over the last couple months, that it got screwed up so bad as to have
caused that.

D: So, now

S: I understand that its definitely a possibility, but for me, as the question is being asked, I
actually cant see anything reasonable having gone wrong. Something awful must have
happened basically.

D: So, how long does the process take and how much butane is used to do like a

S: A single

D: A single

S: A single tube that holds maybe

D: Youre indicating what, three-foot long?

S: Im indicating about a meter long?

D: And how, how, whats the diameter of your tube?

S: The diameter of the tube would be about two to three inches.

D: Okay.

S: In diameter.

D: And you pack that with marijuana.

S: And you pack that with the trim or marijuana or, you know, just the

S: Um, it, its literally just like a, um, you know, like a bed rack and like the sliding poles that
can come on them. And its literally just like a pole that has a

S: Um, a flat end on it.

is pressurizing a little bit inside the glass tube.

S: Thats also why specific glass tubes are used.

D: Okay.

S: Which, uh, Richard has a wholesaler, uh, license, so hes able to go to the wholesaler and
get them for fairly cheap actually.

D: How many, how many tubes are in there?

S: Um, well

D: In your apartment?

S: There were only two, up until a few days ago. And then, he had wanted to replace a
couple of them, so there were more like four or five but not all of them being used and
certainly not all being used at the same time.

D: Okay.

S: They cant be. They can only be used one at a time.

D: So, the, the glass tube is about three feet long.

S: Yup.

D: And with a three-inch diameter approximately.

S: It is, yup.

D: And its supposed to be made for this extraction process.

D: Okay. And then, so, the bottom of the tube has a filtering system to keep out debris.

D: As the liquids start to drop into a glass container.

S: Right.

D: On the top of the tube is there, theres a special

S: Theres an inlet hole thats very specifically made for a can of butane.

D: Is there, is there a cap that goes over the glass?

S: Yeah, yeah. Theres, its glass.

D: That has that hole?

S: Its a, its glass with a hole in it basically, and its usually a spiral hole.

D: Okay.

S: Um, then, a little plastic, uh, safety condom, I guess, for lack of a better word. And then,
and then, the can ends up pushing into the piece of plastic.

D: That was

S: And that, it has a hole in it which allows it to flow.

D: Since I have, since I havent seen the butane cans, theyre 12 ounces?

S: Uh, sure. Lets just call it 12 ounces, yeah.

D: Is it the size of a coke, Coca-Cola can?

S: Its a lit, its just a little taller than that, so thats why Im saying maybe like 16.

D: Is it circular or

S: Its a, a drum. Its cylindrical.

D: Okay. And it has some kind of a, a, does it have a flip up?

S: No, no. Its a, its just a straight can. And then, at the top is sort of a, a, a circular, sort of
has a mound, like a little, almost like a little hill.

D: Uh-huh.

S: And then, a, basically a spike. And what that spike is, its a, its a hole. And its, as you
push down on the spike

D: So you take

S: So, you push down on the edges of the spike, gas will come out from the middle of it.

D: So, if youre holding on toand I appreciate your going over this with me.

S: Uh-huh.

D: Im holding, if Im holding onto the or the butane cane, am I gonna insert that spike into
the top of

S: That plastic knob on the glass tube.

D: Okay.

S: Uh-huh.

D: Does that have to be replaced then each time?

S: Um, not each time.

D: Okay.

S: But, obviously after certain uses, youll want to replace it.

D: So, whenso, the can is under, as the can is filled

S: The can is pressurized as well

D: Pressurized, okay. So, so, the pressurization of the can plus the tube and all that stuff, the
whole thing is related to pressure and pressure, pressure and, pressure, pressurized
butane that turns into a liquid inside the glass tube that helps with extracting the

S: To help with that.

D: If you would drop them, would there, with the, have you ever had where the glass
cracked?

S: Uh, yes. We had actually had a tube crack before and

D: Under the pressure of the contents of the whole, whole thing.

S: Right, right, because, right, because

D: Of the butane.

S: Of the butane.

D: Okay.

S: Because also, what, what happens is that it gets, uh, a bit, it gets fairly cold as well
because of that sudden state change.

D: Okay.

S: Um, and so, so, you have to have, uh, wear a glove while youre holding the tube because
eventually the tube is gonna get actually kind, a little bit icy. So, we have definitely had it
before where a tube cracks one, ruptured.

D: Do you

S: You know, like, and

D: Do you have to hold the tube or do you have a stand or something?

S: That, that goes back and forth. Some, some of the tubes are smaller. I indicated the
longest one that we had.

D: Uh-huh.

S: So, like the smaller one especially, you can just sit with it basically. The bigger one, you,
you generally will hold it yourself. Um, but, but, occasionally, theres an apparatus thats
used to help stabilize it at the same time, so.

D: So, if somebody was doing the process with the tall glass, would he like hold on to the
tube, and then, hold on to the can and just send, sit there in a chair and pull it through your
legs?

S: Uh, more, more. I mean more or less kind of. I mean its it, its slightly different than that
but youre pretty much there. Youre right on with that.

D: Would be, thered be variations

S: Therell be, there, there could be variations on that. Its depending on his mood if you
want to stand or sit or whatever. But like really, at that point, youre right. He, its one
hand on the tube, one hand on the butane can and a glass jar to catch it underneath.

D: And how fast is it going before youre then done? Or do you

S: Um

D: Do you do the whole can of butane?

S: The, the butane, the butane part of it takes all of 15 minutes at most.

D: Okay.

S: Like its one can. And then, depending on the side of the tube and the amount thats in
there, a second or third can, right?

D: Okay.

S: But theres no more than, I think on the biggest extraction, six cans might be used on like
the, the largest tube that we have but I think thats actually over. I think its, its only four or
five.

D: How do you know when the process is finished?

S: Because you can actually see the, um, the color of the liquid. It immediately is, is a, like a,
a green-yellow and it is, it, it basically gets clear, uh, at the point of, of its done. So, youll
see like one clear or one yellow drop for like four or five clear drops, and thats when
youre done.

D: Okay.

S: That, theres a, theres a very clear part of when its done.

D: So, so, during the process, you keep adding cans of pressurized butane to the glass
nipple or the nipple on top of the glass cylinder.

S: Right.

D: Until, until the color of the liquid coming out shows you that its done.

S: That, that the oil

D: Okay.

S: The THC and the CBDs have been extracted because now its all, the butane, liquid
butane is coming through clear, meaning that its not pulling anything through anymore.

D: And so, and that process can go as long as, depending on how hard you pack the, the
material or how much material is in it or how, how long your glass tube is.

S: Its, its more about the length of the glass tube and the amount of material. And those two
are very dependent on each other.

D: Alright.

S: Thats a lot. And that is the time factor, the dependency, and it only takes about a minute
per can of, of pushing it through at that point. So, really, the entire butane process of it
takes all of five to ten minutes. And then, at that point, like the actual amount of butane is
far less than the number of cans because some has already evaporated in the air. And
then, the rest is trapped.

D: Through where?

S: In the liquid. Like, like as, as its being pushed, some butane will pop up the side, right.
And, and thats a slight amount to get it to evaporate into the air. But this is, again, its
also something that Ive seen happen while the, the flamewell, then, the nail was being
lit on the other side of the room, so thats what Im saying, like knowing a little bit actually
about the chemistry of this as well, it would have required like a dozen of those butane
cans, all going into the, at, into gas, atmosphere for that to have caused enough to have
caused an explosion, like, one

D: Yeah. You dont, you dont have first-hand knowledge as to that?

S: Uh, I, I mean I dont necessarily have first-hand knowledge.

D: Okay.

S: As I know I, Ive studied math and chemistry.

D: Okay.

S: And especially this stuff because Im, it, Im involved in it in a sense.

D: Uh-huh.

S: Like I, its going on. And so, I wanted to know about it. And so, that was why I felt
comfortable having, having it done in the apartment because there was no, as far as I
understood, there was no way this could happen. Unless, again, something

S: Either happened in the night or my, my whole thing is I think its something that none of us
knew about.

D: Okay.

S: And thats how it, it came to be but I dont, so.

D: Okay. Would it be fair to say that fumes from the butane can get out when the can is
being put into the top of the glass tube? It can be...

S: Un, it would be fair to say. Yeah, itd be fair to say that a small amount could escape.

D: And some fumes can be developed when the in-product comes out of the bottom of the
tube, along with the, the hash oil.

S: At that point, um, at that point, the, the only amount, its the, theres the liquid butane, and
the thing at the bottom

D: Uh-huh.

S: And thats very slowly evaporating.

D: Okay.

S: Uh, so, at that point, yeah, there would be a small amount of butane gas also going into
the atmosphere at that point.

D: Okay.

S: Um, but all

D: Okay.

S: But it, it generally goes very quickly into the vacuum chamber, so then, that butane is
isolated.

D: And then, when it goes into the vacuum chamber, the fumes then go where?

S: Uh, in fact

D: Outside?

S: And, yeah, inside the vacuum chamber would like, cause you have to mult you have to
vac it multiple times, so you like vac it up. It sort of honey-combs out, and pour, it gets
porus. The gas releases. You extract, you undo the vacuum and you let that gas out, and
we would do that next to the patio door.

S: Yeah. So, then it was going outside.

D: So, if it wasnt being done

S: Thats, again, well, another wrong word. Its like

D: Possible.

S: It probably is not

D: Possible source of

S: I, I, yeah, in that sense but

D: Something thats potential.

S: Yeah, but, but it would, again, its, the jar is like this big.

D: Which is During a recorder you cant see.

S: Oh, Im sorry. The, the diameter would be, um

D: Eight inches?

S: Eight inches, six to eight inches. And the depth would be maybe a foot.

D: Uh-huh.

S: To ten inches. Uh, and, and then, that, that is the size of the chamber that is what the
vacuum stuff...

D: Okay.

S: Going up there.

D: And if, and if Richard has these severe burns on his hands, what do you think?

S: Uh, well

D: Do you have an opinion about that?

S: The opinion I have about that is if, no matter what happened exactly, it seemed like I was
on like the edge of it.

D: Okay.

S: Because I got away by pretty awesome actually.

D: Yes.

S: Um, those two did not end. The timing of when the fire occurred versus when Richard
came out, Im afraid that he might have been passed out for a second from the initial

D: Okay.

S: Bam. And he was, was too close to the flames.

D: Okay.

S: As they came up. That, thats one scenario thats gone through my mind then.

D: Okay. Yeah, theres beenand we then, since we werent there, we dont know.

S: And, and

D: I dont know that.

S: Right, right. I dont know either. Like all I know is that I saw the building come down. I
turned around, the building is down. I get my roommate. I looked back at the building.
And now, suddenly its, its starting on fire.

D: Okay.

S: And its starting on fire like pretty quickly too.

D: Right.

S: Like it wasnt just a

D: Perfect.

S: Uh, uh, like, Oh, I can see the smoke. Its like, phoo, phoo.

D: And then

S: And then, that is when I started running to the other building so then, like, wow, that just
went up.

D: Okay.

S: Like I need to warn people, so.

D: And then, you hear some canisters going off?

S: And then, and then, right then, that would have been the last of like a box of twelve butane
canisters that we had in there.

D: Did they come in a box?

S: Yeah, they, yeah, they come in a box of, its either twelve or nine.

D: Okay.

S: You know, so we would have had twelve or eighteen at that point.

D: Where do you buy that?

S: A box or two box. Again, he gets that at the wholesaler. Uh, you can also go to, um, uh,
any

D: Head shop?

S: Tobacco shop, head shop.

D: Okay.

S: And theyll be able to provide you with

D: Okay.

S: With that. I believe you can, I mean the butane, you can basically pick up anywhere, like
Fred Meyer.

D: Okay.

S: Um, Sears.

D: Alright.

S: Youd be able to pick that up anywhere.

D: Alright. Well, thank you very much for your very candid interview here on this.

S: Okay.

D: It would have been disastrous for me to write this down, and weve been on the recorder
for an hour and eight minutes.

happen and it caught me off-guard and I, the people in the room above me, like thats kind
of where I really hope they werent there.

D: Okay. This is Detective BRACK with the Bellevue Police Department. It is currently
November 5

AT 10:43 a.m. by my watch. Im here at the Hampton Greens Apartment
leasing office. The address is approximately 4505 148

Avenue NE. Im here with the
property manager, Elena A. STANESCU.

Ms. STANESCU, do I have permission to record our conversation?

S: Yes, you do.

D: Can you spell your last name for me and state your date of birth.

S: S-T-A-N-E-S-C-U. Birthday is March 1
st
, 1983.

D: Okay. And how long have you been a property manager here at Hampton Greens?

S: Approximately eight months.

D: And how many, how much experience, work experience do you have in property
management?

S: Ten years.

D: Okay. So, were here, Im interviewing you regarding a fire investigation at Unit KK-202.
Do you know the name, as best you can, of the individual that resides in KK-202?

S: Yes. Its Daniel STRYCHARSKE.

D: Okay. And Ill spell the last name. Its S-T-R-Y-C-H-A-R-S-K-E. And approximately how
long has he been a tenant there?

S: Since April of this year, 2013.

D: Okay. Is there anybody else formally on the lease or formally a tenant in that unit?

S: No.

D: Okay. Now, you mentioned, when I was speaking with you earlier, about an incident when
a window contractor named Justine EDDY or EIDE, E-I-D-E, went into Unit KK-202 on or
about October 17
th
of this year to perform some work, and theres Mr. EDDY or EIDE
shared with you some observations that raised concern. Can you please share with me
what you heard or what he shared with you regarding Unit KK-202.

S: Yes. He reported that he entered the home approximately in the morning time to begin his
window installation work. When he entered the home, not only did he smell a strong odor
of marijuana but he also described to see what was a hash oil operation in which he just

described that there were contraptions, chemicals, things that he just happened to be
familiar with due to a friend of his recently having made hash oil and harming himself. So,
he reported this right away to our maintenance staff. And then, shortly after to myself as
he was concerned about the safety of just, not only himself but everyone in the building as
well.

D: You mentioned that he saw some items that he believed were consistent with the hash oil
operation cause he had some personal experience or a friend did with that type of
operation?

S: Yes.

D: Did he mention anything else, any smells or odors?

S: Just the odor of, strong, strong odor of marijuana.

D: Okay. And then, what did you do with this information?

S: So, I immediately reached out to our legal counsel, Parker (sp?) and Redford, explained to
them what we were notified of. They immediately said we need to contact the police right
away and report it, and that is what I did. I, we called the 911, and an officer came out
pretty quickly, Officer SLUSSER. He first went to the apartment, and then, came into the
office and reported what he had found.

D: Okay. And youre referencing incident 13-50722 on October 17
th
, at approximately
1446 Hrs. when Officer SLUSSER responded. And can you summarize or share with me
what Officer SLUSSER did and how he handled the situation and the information that he
shared with you.

S: Sure, yeah. He came into the office and he reported that hed been to Apartment Number
KK-202. He said upon arriving, there were three men there, none of which were the
resident, Daniel. He said that he spoke to mainly one gentleman which he did not give me
the name of. He said that this gentleman claimed to be a cardholder which he said he did
verify, a medical marijuana cardholder. The person basically went on to tell the officer that
they were not cooking hash oil that day but admitted to having done it in the past. And he
also told the officer that he had some sort of operation or growing operation in,
somewhere in White Center. The officer said he proceeded to tell him that he needs to
make his has oil there and not on private property and that it is against the lease terms of
Hampton Greens and, and the management company to be making hash oil inside of an
apartment. They, one thing to add, they did throw in there that they felt that the
management office was trying to retaliate against them because they had reported service
request issues and things like that, which of course the officer said, Well, it sounds like
this is purely a drug issue. It can be smelled outside. I can smell it on myself right now.
The officer did report he didnt actually see an operation or any drugs at the time when he
went to the apartment, so he basically told them they needed to make sure they didnt do it
again, and he left, and he came into my office and told me that. I asked him basically
what my next steps were, what I could do, what my rights were as a property manager, as
obviously we were concerned about this. He seemed a little uncomfortable with

answering those questions. He said he was new to the force as well to the State of
Washington and he knew that there were different laws out here. He gave me an incident
number, and then, said that he would be in contact with me in the next day or two after he
spoke to a supervisor just to confirm some laws and policies and whatnot. So, and from
then on, I did not hear from him.

D: Okay. Were you waiting to hear from him or did you have the understanding that thered
be some follow-through and that just hadnt taken place yet?

S: Both really. So, he said he would follow up with me but, really, that very next day,
obviously, I started getting in contact with my legal counsel and, obviously, the issue came
up of, well, were dealing with cardholders and was this truly illegal in the State of
Washington or was it a Federal? You know, theres all sorts of issues with that. So,
basically, what our legal counsel advised is that we need to get a copy of the incident
report and/or we need the officer to let us know if he was willing to testify in court since he
was the one that witnessed everything and experienced it all. So, I immediately began
emailing him, calling him. His voicemail was not set up, so I wasnt able to leave him a
message ever. He did end up calling me a few days later to a week later and leaving a
message when no one was in the office. I did call him back again, was not able to leave a
message or get a hold of him. On several occasions, not only emailed him but called his
main office and asked to speak to him, and they each time took, took messages, my
name, my number, what I needed to speak to him about, and to this day, I have not heard
back from him.

D: Okay. So, is it fair to say that, on your end, you were still working your authority with what
you can or cant do regarding the hash lab as Mr. EIDE reported it to you? So, you were
still working on things on your end up to this day when this other fire broke out, is that

S: Yes, hundred percent.

D: Oh, okay.

S: Absolutely.

D: Fair enough. Okay. Anything else you want to say regarding the incident that was
reported to Officer SLUSSER on the 17
th
?

S: Uh, no. I dont, I dont think

D: Okay.

S: I dont believe so, other than a compressor was reported to be outside on the deck by the
window crew, as well as the maintenance supervisor here. There was an electrical
extension cord coming in from the house tied to it. Other than that, no, nothing. Nothing
else to report, other than just the smell. I personally experienced myself the day that I
called the police. On a side note, I was completing a lender inspection with the bank, and
that was one of the buildings we had to go to. And, upon arriving, just even, Id say even

200 feet away from the building, I could smell a really strong odor of marijuana. I mean
unlike Ive ever smelled.

D: Okay.

S: So, it was, again, I assume it was coming from his home.

D: Okay.

S: Since it was the same day it was reported but, yeah, thats about it.

D: On the incident report for incident 13-50722 on October 17
th
, it names the reporting party
as Courtney CALLAHAN. Whos Courtney?

S: She is the assistant manager here.

D: So, she is an employee.

S: Yes, she is, uh-huh.

D: Okay. In talking about Unit KK-202 or Mr. STRYCHARSKE prior to the incident in October
and today, were there any other complaints or concerns by other tenants or your staff that
raised suspicion about any type of activity in Unit KK-202?

S: No, not necessarily complaints. Daniel has complained about service request issues and
things like that. Hes, tends to just complain about everything, demands things be fixed
and repaired within hours time, things like that, but weve always taken care of him. And
other than that, no, not, not really. Nothing criminal, nothing really concerning. He always
gave the vibe off to our staff, our maintenance staff, excuse me, that he may have been,
what you call stoner, someone who, you know, maybe smokes weed. Again, this is not
something they visually saw. They just got the impression by just the way that his
apartment looked and his appearance and things like that. And so, it was just an
assumption that they had made. But other than that, no, no other complaints or reports or
anything.

D: So, just to be specific, prior to the incident on October 17
th
, there was no reports of
exorbitantly strong odors of marijuana or anything else.

S: No.

D: Prior to that date.

S: No.

D: That was the first time.

D: Okay. Can you describe to me if there was anybody else you suspected to be living there,
residing there or spending a lot of time?

S: Yes. So, when Daniel first moved in in April, he had reported to our office that he was
going to have his friend, Jesse KAPLAN, move in with him and be on the lease. He did
say that Jesse would not be added to the lease until possibly a couple months later, just
because he was in another lease at anther apartment. So, time went by, he never added
himself. We didnt think much of it. When the complaintswell, the service request
started about three months back, every time Daniel came in, Jesse came with him. And
the way Jesse spoke was in, in a sense that he lived here. He spoke as if he were a
resident himself. Jesse also paid rent in a form of a check in his name, was getting
packages delivered here, so when all that was said and done, we basically came to the,
you know, determination, yes, he did live here. We served a 10-day notice to comply to
Daniel, just asking that Jesse be added to the lease per the lease requirements. Daniel
responded by basically arguing the same that Jesse was not an occupant, he just visited
often. We kind of went back and forth about that. Of course, its a very gray area, so we
just explained to him that thats fine if he doesnt want to be added but just the
understanding is he cannot live here. He cant pay rent, he cant get packages, hes not
an occupant. Other than that, he is the only person that I am aware of that could possibly
live in that apartment.

D: And you mentioned that 10-day notice was served on September 5
th
of 2013. Does that
sound about right?

S: Yes. Let me double-check. I believe so. Yes.

D: Okay. Are you aware of either Mr. KAPLAN or Mr. STRYCHARSKE having any type of
friendships or close relationships with any of the neighbors or other tenants in the
Hampton Greens?

S: No.

D: Okay.

S: None.

D: What time did you arrive here today about?

S: I arrived here approximately, I would say 8:15 a.m.

D: Okay. And how did you learn about the incident that took place?

S: At approximately 7 a.m., I received the text message from an old employee who saw the
fire on the news, saw the report.

watch. Im in Unit MM-102. This is regarding the fire investigation, case 13-54055. Im in
Unit MM-102 with the resident, Joe J. DOLAK.

Mr. DOLAK, do I have permission to record this conversation?

J: Yes.

D: Okay. Would you please spell your last name and tell me your date of birth.

J: Spelling of my last name is D-O-L-A-K. I was born December 3
rd
, 1946.

D: Okay. Mr. DOLAK, weve had a brief discussion about what you experienced this
morning. You want to go ahead and kind of start from the beginning and tell me what you
remember about the events this morning?

J: Sure. I was sitting at my kitchen table, listening to the radio. I hear a loud thump, like a
base drum. Almost simultaneously, I felt a shockwave coming from, would be the
southwest corner of the building, diagonally right through my apartment. You could just
tell it just vibrated right through it. About 15, 20 minutes later, I started to hear neighbors
just moving around loudly upstairs. And at first I thought it was just some furniture that
crashed or something. I didnt know. About 20 minutes later, a nice neighbor lady
knocked on my door and said there was a fire in the back. And I just let it go with that but I
did put my coat on and just checked it out and I came back in. About 10 minutes later,
somebody from the Fire Department says, Get what you can. Bring what you need.
Youll have to leave. Theres been a fire and its coming this way. Put my coat back on,
not much else. So, I went to see. Curiosity, I went back to see as much as I could about
that fire, and it was, it was up in flames. And I noticed a, a vent. It was bleeding, forcely
feeding, exiting or exhausting a light smoke or light-colored smoke which is a little bit
unusual at this point. And there was black soot that was coming up, tar, I dont know what
all was burning. Furniture probably. And I thought to myself, lint, lint or dust could create
an explosion. And theres a lot of dryers around here, you know, whenand that could
get clogged and somebody, started drying or something, the heat, could trigger that. That
was the first thought in my mind, a lint explosion, dust explosion. So, I walked in, back
into my car which was 40-foot, started up my car and tried to keep warm and I stayed
there for about 40 minutes. So, people started to segregate, go their own ways, and one
of the neighbors says, Im going back in my house, which is like next door. I said, Thats
a good idea, so I came back in and told until Mr. James BRACK knocked on my door, and
Im telling him, James, what I remember. And the time my watch said 6:27 when I first
heard that and experienced the shockwave.

D: Okay. So, at 6:27 in the morning is when you heard a loud crack, is what you told me.
And then, you kind of felt the shock.

J: It was, it was like a, not a loud crack. It was like a, you hit a base drum.

D: Okay. A boom?

J: Yeah.

D: Like a base drum? Okay.

J: Yeah.

D: Okay. And you also felt the shock wave then.

J: Kind of simultaneously.

D: Okay. Almost simultaneously. Okay. And then, when you were watching the fire, can you
describe the color of the flames that you saw?

J: Bright yellow.

D: Bright yellow. And how about the color of the smoke?

J: White or a very light gray.

D: Did you notice any odd or peculiar smells in the air?

J: No, sir.

D: Okay. Do you happen to know anybody that lives in that building that was on fire?

J: No.

D: Okay. Do you have any, was there ever anything that concerned you about either the
people living there or what might be taking place in that building that was on fire today?

J: No, but like you see people like when I get my mail, and I dont know if they live there or
not.

D: Right.

J: Id say hello, goodbye, and thats it.

D: Okay. Fair, fair enough. Is there anything else youd like to share?

J: Not at this time. I cant think of anything else.

J: And you see these two pieces of junk thing in a bundle.

D: Yeah.

J: And they are junk.

D: Well, you gave a very good detailed statement. Like you said, it sounds like you had
some experience making those observations and getting them

J: Ive been involved in incidents before, reporting like this.

D: Uh-huh.

J: Before I was in the Marine Corps, obviously take tests being an electrical engineer,
masters degree and all that weird stuff. During the Marine Corps, it made sense being a
project manager.

D: Got you. So

J: Im no flake. [laughs] I didnt say I was

D: No, you sound squared away to me.

J: I didnt say I was genius here either.

D: Okay. This is Detective BRACK with the Bellevue Police Department. Its November 5

2013 at about 1:32 p.m. by my watch. This is regarding case 13-54055. Its a fire
investigation. Im currently in Unit JJ-202 with the tenant, Caleb A. PETRIE. Mr. PETRIE,
do I have permission to record our conversation?

P: Yes.

D: Can you spell your last name for me and give your date of birth.

P: PETRIE, P-E-T-R-I-E, and 3/8/75.

D: Okay, Mr. PETRIE, you want to kind of start from the beginning of your first recollection
regarding the fire incident today, what you heard or saw or about what time and go from
there.

P: Yeah. It was about 6:20, 6between 6:15 and 6:30 sometime. I was just starting to wake
up. I could hear a dog barking, and I think thats actually what woke me up was the dog
barking, now that I think about it. And then, there was the a a very loud explosion a
banging sound, I guess. Not really banging. Just one, one explosion is what it was. And
it kind of rattled the windows and, and my fiance thought it was a tree falling on the
building. And I kind of immediately knew it wasnt the tree falling just by the sound of it. It
didnt have a popping, like a tree sound. So, I got up, looked out the window, and the
building next door was, theres flames shooting out both sides of the building. And so, I
got my phone, started to make a video. And then, I could hear people outside yelling, so I
got up as quick as I could and got out there to, to try and help. There was a lady on the
ground. The leg broken. There was a, the building, there was popping sounds coming out
of the building that, that I felt were, were bullets. But, again, it, sure, but it really sounded
like it. And I tried to warn people to get away cause it might be some bullets going off.
So, I, I tried to help the lady who broke her leg who jumped out of a third-story unit and got
her a blanket and just kind of watched. The flames were a bit different than I would expect
to see. I would expect to see orange flames, and these were like white flames, which was
kind of interesting also with the popping sounds. And I, I didnt really know exactly what to
make of it but I knew it wasnt safe, so. Yeah. And then, Fire showed up after people
called and basically took over, so.

D: So, you mentioned that you heard a dog barking.

P: Yeah.

D: Did you hear that dog barking before you heard the loud explosion?

P: Exactly, yeah.

D: Okay. And by the time you heard, what was the time approximately, from the time you
heard the explosion, to when you looked out your window and saw that the building was,
had flames shooting out of both sides?

P: Id say less than a minute.

D: Less than a minute.

P: Uh-huh.

D: Okay. Did you happen to smell anything out of the ordinary?

P: Um, it, it, it didnt exactly smell like just timber or wood burning. It sounded, it, it did have
a, a plasticky smell, I was thinking it couldve been carpet or just peoples tvs and stuff, I
dont know. Um, I just figured thats what it was. So, but there was more, more, uh,
stronger smell than just wood burning, I guess.

D: Okay.

P: I just figured its just normal for a house fire kind of thing but I dont know. I havent really
experienced house fire before.

D: Did you observe anything out of the ordinary regarding the color or volume of smoke?

P: When it was dark I couldnt really tell that much about the smoke. It just looked dark to
me. By the time the trucks came and kind of lit it up a bit, it was just mostly, what I
remember, mostly being white. But then, I didnt, I couldnt really see it when, before like,
you know, so.

D: Do you know anybody that lives in the building that burned down?

P: No, not. I dont know anybody. Ive just seen people going in and out. I dont, Ive never
talked to them.

D: Have you ever noted anything peculiar or strange or suspicious about anything going on in
that building?

P: No, no. Not at all.

D: Okay. And your fiance, Achiko, was also here at the time but shes no longer present to
be interviewed, is that correct?

P: Correct, yes. She had to go to work.

D: Okay. And you took two or three videos of the incident on your phone which now youre
burning a disc for me.

P: Correct.

D: Okay. Was there anything else youd like to share about either what you saw or heard
regarding this incident?

P: Um, uh, I dont know. I think thats about it. Just a, it was kind of, it seemed very unlikely
to have an explosion like this. Thats why I was kind of concerned. Just why would
something explode in a, in a unit that, cause I know these apartments dont have gas, so.
Otherwise, I would have thought well maybe its a gas, natural gas explosion but theres
no, theyre all electric. There shouldnt be anything in here thats gonna explode like that,
so thats what was interesting to me mostly. Scary really, so.

D: You found it odd that in the, in these buildings, especially since they dont have any type of
gas supply

P: Uh-huh.

D: That there would be such a loud and voluminous explosion.

P: Yes, absolutely. It was, it was very loud and that, the shockwave evenI have a friend
who lives in the building next to it. I didnt mention this earlier but he said the, the nails in
his wall came through the sheetrock.

D: Oh.

P: Because of the, the shockwave.

D: Okay.

P: Pressed his walls that hard.

D: What was your friends name?

P: Payman.

D: Payman?

P: Yeah.

D: Okay. And he was in the building next to the one that burned?

P: Uh-huh.

D: Okay. Did you happen to feel a shockwave or notice a shockwave of any sort?

P: Oh, yeah.

D: Okay.

P: Right.

P: Uh-huh.
