47 Church StreetTullamoreRe: Eviction notice dated 18
December 2009Dear Ms GarryI acknowledge receipt of your letter requiring me to quit the premises at 47 Church Street statingthat I owe you 1012.40 euros. Of course I will do my utmost to rectify this matter with due haste. Itis not a position I wish to be in and I do apologise for jeopardising our heretofore good relationship. You have always acted in a fair and reasonable manner with me. I know you will probably have mebeaten up if I do not pay you some money soon and the local police will encourage you to do this, however :Would you please clarify the following?1.
You have given me one months’ notice to quit from today’s date. I have been a tenant withyou for longer than three years; I have records going back to when I was your tenant at Flat3, 11 Church St. I believe I should get 84 days? Ref :http://www.globalpropertyguide.com/Europe/Ireland/Landlord-and-Tenant 2.
You say “unless rent payment is paid in full on or before 30
December 2009” This is 12 daysfrom today’s date. Sorry I am confused regarding this.3.
You say you received no Rent Allowance from 12/10/09 to 7/11/09. I completed the formsunder your guidance, I have been interviewed by the Department of Social welfare, theyhave visited and approved 47 Church St, there was no change in my circumstances, andthere was no interruption in my tenancy with you. I would therefore ask you to check thiswith your bank. I have forwarded a copy of your letter and this letter to the Department of Social Welfare. Clearly this is a mistake on their part. I would therefore ask you to defer theamount of 428 euros from my outstanding bill.4.
I moved at your request. My household benefit/living allowance was automatically stoppedtherefore I have received no electricity allowance and no telephone allowance (mytelephone has been cut off as I cannot afford the bill) since moving into 47 Church Street. Ihave re-applied. Last time this occurred when I moved again at your request from 20 ChapelStreet, it took the Department of Welfare five months to rectify this. Perhaps the amount of 113 euros which I believe is owed to me could be temporarily deferred until my paymentsare re-established?5.
For your information, the reason I am behind in my rent was because I was attempting tostart my own business and cease receiving disability allowance. I was led to believe that thegovernment and social welfare actively encouraged this. I applied to the Offaly CountyEnterprise Board two months ago. They came to a decision last week, which was negative. Ihad no choice but to try and maintain the business while the county enterprise boardconsidered my claim. I followed all their guidelines which necessitated expense on my part. Ihave applied and been accepted on a FÁS training course. This is for your information but acopy of this letter is sent to the County Enterprise Board in an attempt to see if they can
