FOURTH ORDER AMENDING SENTENCING DEADLINES

The Court AMENDS the sentencing deadlines in this case as follows:

It is ORDERED that disclosure of the Presentence Report to the Court, the defendant,

defendant's counsel, and the attorney for the Government is now due by or before 4:00 p.m., February

9, 2010.

Written objections to the Presentence Report, or a written statement adopting the findings of the

Presentence Report must now be delivered by the parties to the Probation Officer, to the Court, and to

each other by or before 4:00 p.m., February 23, 2010.

If written objections to the Presentence Report have been timely made, the Probation Office

must now disclose any addendum to the Presentence Report by or before 4:00 p.m., March 2, 2010.

Written objections to this addendum must now be delivered to the Court and the Probation

Officer by or before 4:00 p.m., March 9, 2010.

Sentencing of the Defendant is hereby SET for Friday, March 19, 2010, at 9:00 a.m.

Any motions for downward departure must be made in writing and filed on or before March

12, 2010. Sentencing memoranda, and any character letters, shall be submitted to the Court on the

same day, via hand delivery, and NOT filed electronically.

If, during the presentence report ("PSR") investigation, it is determined that Texas Youth

Commission ("TYC") records are needed, the court orders the TYC to release these records to the

Probation Officer assigned to prepare the PSR, acting in the performance of the officer's official duties

pursuant to Fed. R. Crim. P. 32. The specific records that are to be released include documents

pertaining to the defendant's social history, court disposition records, substance abuse treatment

records, psychological evaluations, other mental health treatment records, educational records, general

health records, adjustment while incarcerated records, and release dates from the TYC.
