There are nointervenors or amicus curiae in this Court. Hollister's former counsel, LawrenceJ. Joyce and Philip J. Berg, have filed a motion for leave to file an amicus brief in this appeal; that motion is pending.

Hollister appeals the March 5, 2009memorandum and order of the United States District Court for the District of Columbia (Robertson,J.) granting President Obama's and Vice PresidentBiden's motion to dismiss.The memorandumis reported at 601 F. Supp. 2d179 (D.D.C. 2009)and is in the Appendix at 208-12. Hemenway appeals theMarch 24, 2009 memorandum order of the United States District Court for theDistrict of Columbia (Robertson, J.) reprimanding him for filing a frivolous
