OPINION
BYBEE, Circuit Judge:These consolidated appeals raise two issues: first, whetherthe district court abused its discretion when it denied plain-tiffs’ motion to certify a putative class out of concern thatpractical obstacles could potentially develop if plaintiffs’legal theory were ultimately rejected; and second, whether thedistrict court erred in remanding, in light of its certificationdecision, state law claims to state court for lack of subjectmatter jurisdiction. We hold that the district court abused itsdiscretion when it assumed, for the purpose of Federal Ruleof Civil Procedure 23 certification analysis and without anyseparate inquiry into the merits, that plaintiffs’ legal theorywould fail. Accordingly, we reverse and remand for reconsid-eration of plaintiffs’ certification motion and dismiss as mootthe appeal of the remand order.
