Specialty group arrived Oct 16 2009 to measure the manway and asess the leak. On Oct 17 2009, as Murphy awaited that repair, the leak worsened, so Murphy shut down the FCCU as a safety precaution. The vendor installed the clamp on Oct 18 2009. The leak was estimated to have lasted 74.5 hours from approximately 09:00 hrs on Oct 14 2009 to 11:300 hrs on Oct 17 2009 when the unit was shut down.Estimated hydrocarbon emissions 44,000 pounds with 155 pounds of benzene. Gentlemen,
The Murphy Oil USA, Inc. Meraux Refinery (MOUSA) is providing this update regarding the
notification for the above-referenced incident. MOUSA reported to the National Response Center,
that this event also resulted in the release of benzene in excess of the 10# RQ. This report was
in error, as the release is exempt from reporting per the Petroleum Exclusion in CERCLA
§101(14):

EPA interprets CERCLA section 101(14) to exclude crude oil and fractions of crude oil -
including the hazardous substances, such as benzene, that are indigenous in those
petroleum substances - from the definition of hazardous substance. Under this
interpretation, petroleum includes hazardous substances that are normally mixed with or
added to crude oil or crude oil fractions during the refining process. This includes
indigenous hazardous substances, the levels of which are increased as a normal part of
the refining process.
As the NRC does not have & mechanism for rescinding, downgrading or amending a Feport, _
