The undersigned hereby orders that, on or before January 9, 2015, each of the parties
submit a brief (no more than five pages) detailing the reasons why this action should not be
stayed pending resolution of the Latta v. Otter, et al. action before the United States Court of
Appeals for the Ninth Circuit (Case Nos. 14-35420 & 14-35421). The parties are advised to
incorporate within their respective filings a discussion of the criteria for determining whether a
stay is appropriate, as outlined in Landis v. North American Co., 299 U.S. 248 (1936) (in
addition to any other applicable authority within the Ninth Circuit either party may feel is
relevant regarding the propriety of a stay under the circumstances at play here).
