Pursuant to T.B.M.P. §§ 510 and 1213, Applicant CigarsInternational, Inc.  2CUBANA is infringing Specialty’s common law trademark, CREMOSACUBANOS. CI must answer the Complaint by January 25, 2010, andan initial case management conference with the Court is now setfor January 28, 2010, at 9:30 A.M.Prior to the issuance of the Board's decision in an exparte appeal, proceedings with respect to the appeal may besuspended by the Board upon written request by applicant showinggood cause for the requested suspension. One example of asituation in which the Board may suspend proceedings in anappeal, at the request of the applicant, occurs when anapplicant is involved in a civil action that may be dispositiveof the issue(s) involved in the appeal. T.B.M.P. §§ 510.02(a)and 1213; 37 C.F.R. §§ 2.117.Given that the civil action referred to above may directlyaffect CI’s rights in CREMOSA CUBANA, including potentially itsability to register the mark, CI respectfully requests that theBoard suspend the instant proceeding until a final determinationof the civil action is made.Once a final determination of the civil action is made or asettlement in the civil action is reached, Applicant willrequest that this Board proceeding be resumed.
