Our Ref.: 30203.30006Dear Mr. Jacobs:I am intellectual property counsel for ProtectMarriage.com (“ProtectMarriage”). I havereviewed Courage Campaign’s logo that is used throughout the website,www.couragecampaign.com. The logo is not only a trademark and copyright infringement but also,a counterfeit mark of ProtectMarriage. As such, I demand that you immediately cease and desistyour use of ProtectMarriage’s mark.As you are well aware, ProtectMarriage, is a broad-based coalition of California families,community leaders, religious leaders, pro-family organizations and individuals from all walks of life who have joined together to defend and restore the definition of marriage as between a man anda woman. ProtectMarriage has used the following trademark in association with its defense of marriage and Proposition 8 in California.

Conversely, Courage Campaign holds views that are diametrically opposed to those of ProtectMarriage and is using ProtectMarriage’s mark for a website designed to provide commentaryon the trial and the efforts of ProtectMarriage. A copy of one version of Courage Campaign’s logoused throughout the Courage Campaign website is set forth above. In evidence of that, CourageCampaign has altered the logo above, changing the male figure on the left to that of a female,wearing a dress. Such alteration is not readily viewed by the casual observer.
