Strunk files this Affidavit in support of the Notice of Motion to Intervene into ACORN v USA in the EDNY 09-cv-4888 as a Ex-relator Intervener-Defendant United States of America (USA) Citizen and State of New York Citizen with FRCvP Rule 24(a)and 24(b).
That Strunk had filed a letter motion on December 16, 2009 (See Exhibit A) requesting permission to file with Local Rule (LR) 50.3.1(d), to which on December 21, 2009 Defendants’ Local Counsel F. Franklin Amanat of the Department of Justice responded (See Exhibit B) in opposition to granting such request, and then on December 22, 2009 at the hearing before Judge Nina Gershon Affirmant was instructed to submit a motion through the Court Clerk Pro Se Office with particular attention to respond to the DOJ Response; that with LR 50.3.1(d)(2) is to be filed by January 21, 2010.
See Exhibit E regarding the documented relationship between the RCC / Holy See and ACORN as well as the hundreds of social justice organizations created by the RCC and Saul Alinsky Industrial Areas Fund from 1968 forward under the ACORN RICO enterprise.

See the Court Reporter Affidavit explaining the lost Transcript of the OSC hearing on 11/24/09 in the NYS SUP CT Kings Cty 2008 General Election matter in Strunk v Pateson et al. with index no.: 08-29642 to be posted when received as the EXHIBIT D missing herein.
