Rights of third party under RTI Act
( i) written notice to third party must be given [as per Section 11(1)
(iii) these submissions must be kept in view [as per Section 11(1)] or shall
have to be considered [as per Section 7(7)] by Public Information Officer; .
Looking to the provisions of Section 7(7), 11(1), 19(2), 19(3) and 19(4),
It is clear that applicability of the principles of natural justice are
excluded before taking decision under Section 7 and,
therefore, even if it is a time-consuming process as stated in
the aforesaid para, the principles of natural justice ought to be followed
to ensure fairness in the decision by Public Information Officer.
Time schedule
• Thus, Time bound schedule given under
the Act,2005 is not for ousting the hearing
of a third party but is only for the prompt,
quick and early disposal of the application,
preferred by the applicant under Section 6
of the Act,2005, so that information can be
supplied as quickly as possible to the
applicant.
Rights of third party under RTI Act
6. After submission of representation , if the PIO decides to disclose the
requested information, then third party has a right to get speaking
order with details of first appellate authority .
7. Third party has a right to require PIO not to proceed with disclosure as first
appeal is being filed or has been filed. Copy of first appeal should be sent
to PIO simultaneously with first appellate authority.
8. Third party has a right to be given personal hearing by the first appellate
authority before deciding on the appeal.
9. Third party has right to get speaking order of the first appellate authority
[FAA] within 30 days of filing the appeal.
10 Third party has right to require PIO and FAA not to allow disclosure pending
filing of second appeal to CIC/SIC within 90 days of receipt of decision of
FAA or when the decision was due from FAA.

Rights of third party under RTI Act
11. Third party has right to be heard by the CIC/SIC, before deciding
the appeal.
12. Third party has right to move High Court or Supreme Court against the
decision of the CIC/SIC.
13. Third party should get reasonable time for moving Courts after decision
is taken by CIC/SIC and no information should be disclosed during such
reasonable time, as once the information is disclosed,
it cannot be reversed.
