TRAI recommends wide ranging reform measures on licensing policyfor access services provision
 TRAI forwarded its recommendations today to the Department of  Telecommunications (DOT), Ministry of Communications andInformation Technology, Government of India on policies that shouldgovern the licensing frame work for access service provision. Therecommendations contain proposals on a wide range of inter connectedissues that formed the basis of the reference from the DOT dated 13

 April, 2007.2. DoT’s reference inter-alia required TRAI to make recommendationson key issues like entry regulation in access service market, review of guidelines on Merger & Acquisitions including the provisions relating tocross holding of a licensee company in the same service area, use of combination of technologies (CDMA, GSM & and/or any other) under thesame license, roll out obligations etc.3. These and other related issues were raised in the consultationpaper no. 7/2007 dated 12

June, 2007 issued by the Authority as partof the consultation process. Written submissions received from stakeholders were put out in TRAI’s web-site. Open House Discussions wereheld in New Delhi with all the stake holders on 18

July, 2007.Separately the Authority afforded further opportunity to the associations

representing industry for making presentations to the Authority.Repeated and multiple submissions made by the stakeholders on severalkey issues have been considered by the Authority. The Authority alsostudied international best practices adopted by various regulators /policy makers in a number of jurisdictions. In-house Research wascarried out to examine the implications of various proposals to test theirvalidity. International practices / best practices guidelines relied uponby the Authority have been cited in the text of recommendations wherever appropriate.4. After carefully evaluating the progress achieved in the growth of telecom services in the country since the liberalization of the sector, andafter taking into account the dynamic changes that are seen in the sectoron account of the fast pace of the technological changes, the Authorityhas underlined the importance of re-orienting the existing frame work of policies to suit the needs of emerging environment. More importantly,the Authority has kept in view the need to achieve the target of 500million subscribers by 2010 and thus narrowing the “Digital Divide”.5. The Authority has approached the issues keeping in view thepower unleashed by the market forces in the past resulting inunprecedented growth of the sector particularly in the wireless space. Inmaking these recommendations, the Authority has been guided by thefollowing principles:-(i) Maximize socio-economic benefits for the country makinguse of the technological developments of the sector.(ii) Remove barriers to competition and efficiency in the market.(iii) Affordability of services to common man and protection of consumer interest.(iv) Enhance efficiency in utilization of scarce resources of radiospectrum.

(v) Predictability, transparency and scientific approach in entryregulation.(vi) Technology-neutrality and level playing field by affordingopportunity for equal competition.6. The recommendations made by the Authority are given below :-
Entry Limit in Access Service Provision:
No cap be placed on the number of access service providers inany service area
.
 
In order to frame a new spectrum allocation criteria, a multi-disciplinary committee may be constituted consisting of representatives from DoT/TEC, TRAI, WPC wing, COAI &AUSPI. The committee may be headed by an eminent scientist/technologist from a national level scientific institute.
Enhance the present subscriber norms as an interim measureso that the task of spectrum allocation is not stalled. Thesuggested revision is given below:-

i am shri prabir kumar biswas vill- chak nutanpally, po- chak-islampur, dist- murshidabad, west bengal, 742304. having a Reliance GSM connection no. 9832708917. on 12.05.2009 sms received on this mobile that "FMIndia pack is activated at Rs.30.....on 13.05.2009 another sms received "thank you . your subscription request for LOVE Pack is in process.on 16.05.2009 another sms received "reliance talk tune packm is activaed at rs. 30 for 30 days.though all the above cases i did not subscribe any of these package.i am a concious customer. please help me and instruct me what to do.i have already lost rs. 90.sir i am eagerly waiting for the reply.

Dear Sir, I Have a Vodafone connection.I Take up mobile phone with a plan in which company is to give 500 minutes(VOdafone to Vodafone) every month.Few days back my mobile stop working because of which I have to submit the same for the service to the Vodafone store. The Month in which i recive my handset back, they stop giving 500 minutes.When I Complain about the problem to the Customer Care of Vodafone ,they said that You removed the chip from the phone and is using in another phone. I take up this plan for 3 years, but the company waive off after 1 year. Please take some neccessary action regarding the same.

Dear sir,i have an airtel postpaid connection. few days back i recieved a sms from one of my friend in which my full information of my postpaid number is shown, when i enquired her that from where she got this information, she repleid that she got it from airtel office of our city where i paid my bill regularly,this whole information is provided by a employe in that aitel office without my knowledge.i found it is illegle,is it?. if yes than how can i file a case against that person, please guide me about the whole procedure. myself gurvinder saini. presently serving in indian air force. thanks&regads Gurvinder saini

Dear Sir, I have airtel pre paid life time connection.My balance is automatically deducted from my account. when I am confirming my balance detail they always give false statement that my some service is activated. they told first deactivated that service then they will refund my balance. But till now no refund i get. I am serving in Indian Air Force.I am facing this problem last two months.So my request is to solve my problem as the earliest.
