 Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘America Recruits Act
4
of 2009’’.

SEC. 2. PROGRAM OF LOANS TO ATTRACT JOBS IN INFOR-

MATION TECHNOLOGY AND MANUFAC-
2
TURING SECTORS.

(a) D
EFINITIONS
.—In this section:
4
(1) E
CONOMIC DEVELOPMENT DISTRICT
.—The
5
term ‘‘economic development district’’ has the mean-
6
ing given the term in section 3 of the Public Works
7
and Economic Development Act of 1965 (42 U.S.C.
8
3122).
9
(2) E
LIGIBLE ENTITY
.—The term ‘‘eligible enti-
10
ty’’ means an entity that employs not fewer than 20
11
full-time equivalent employees in eligible jobs.
12
(3) E
LIGIBLE INTERMEDIARY
.—The term ‘‘eli-
13
gible intermediary’’ has the meaning given the term
14
‘‘eligible recipient’’ in section 3 of the Public Works
15
and Economic Development Act of 1965 (42 U.S.C.
16
3122).

(4) E
LIGIBLE JOB
.—The term ‘‘eligible job’’
18
means, with respect to an entity, a job—
19
(A) that is related to information tech-
20
nology or is in the manufacturing sector; and
21
(B) in which the entity employs a full-time
22
equivalent employee.

(5) S
ECRETARY
.—Except as otherwise provided,
24
the term ‘‘Secretary’’ means the Secretary of Com-
25
merce.

(6) T
 ARGETED LABOR SURPLUS AREA 
.—The
1
term ‘‘targeted labor surplus area’’ means an area
2
in the United States that, on the date on which the
3
program is established under subsection (b)—
4
(A) is included in the most recent classi-
5
fication of labor surplus areas by the Secretary 
6
of Labor; and
7
(B) has an unemployment rate equal to or
8
greater than 140 percent of the unemployment
9
rate of the United States.

EQUIRED
.—Not later than 180 days
11
after the date of the enactment of this Act, the Secretary 
12
shall, acting through the Assistant Secretary of Commerce
13
for Economic Development, establish a program to assist
14
eligible entities, when deciding whether to locate eligible
15
 jobs in foreign countries or in the United States, in locat-
16
ing such jobs in economic development districts or tar-
17
geted labor surplus areas.

.—The Secretary shall carry

out the program required by subsection (b) through

the award of grants to eligible intermediaries to pro-
23
 vide loans to eligible entities to assist such eligible
