This Agreement of lease has been executed on this 5th day of February 2010, between thefollowing: -
Mr. GOPAL KRISHNA NYATI son of LATE Shri JAGANNATH JI NYATI, Resident of 38-A, Pocket 6, MIG Flats, Mayur Vihar Ph-III, Delhi-96 hereinafter called the LESSOR.
Mr. JAYESH JOSHI, SECRETARY VAAGDHARA-NGO son of LATE SHRIGHANSHYAM JOSHI , currently resident of 3/153, Khandu Colony, Banswara,Rajasthan INDIA, PIN – 327001 hereinafter called the LESSEE.
The expression and term lessor & lessee wherever they appear in this agreement shall mean &include respectively successors, beneficiaries and legal heirs as the case may be.WHEREAS LESSOR is the sole and absolute owner under law of the residential premises at1-KH-16, Rajasthan Housing Board, Pratap Nagar, Chittorgarh, consisting of residential portion& 4 commercial shops. WHEREAS LESSOR is desirous of letting out residential portion and the LESSEE is desirous of taking on lease residential portion consist of 2 rooms, 1 Kitchen, Dining space & toilet for NGOoffice on the terms and conditions contained hereunder: -
1.In consideration of the rent hereby reserved and covenants and conditions to be performed by the LESSEE. The LESSOR hereby leases out and vests unto the LESSEEand the LESSEE hereby takes on lease from the LESSOR the premises residential portionconsist of 2 rooms, 1 Kitchen, Dining space & toilet for NGO office in the premises of 1-KH-16, Rajasthan Housing Board, Pratap Nagar, Chittorgarh, on the terms and conditionscontained hereunder.2.The lease shall be for a period of one year commencing from 05.02.2010 and shall berenewable on the mutual consent of both the parties. One month’s notice is requiredfrom Lessee’s side for termination / discontinuation of lease agreement.3.Rent @ 10% will be increased every year.4.The LESSEE shall pay to the LESSOR for the Lease of the demised premises a monthlyrent of Rs.3,000 (RUPEES THREE THOUSAND ONLY) by way of cheque directlydeposited in LESSOR’s bank account before 5
of every month.5.The lease of the demises premises shall be restricted for the user of VAAGHARA-NGO.The Lessee shall not use the premises for use by any other person or any other purpose.In the event
does not use the premises, the lease shall standterminated immediately hereinafter.6.The LESSEE shall not give on license, nor sublet, transfer or part with the possession of any person without the prior consent in writing of the LESSOR. The LESSOR shall beentitled to refuse the consent in their absolute discretion without assigning any reason.7.The LESSEE shall pay rent in advance every month on or before 5
day of commencement of the month.8.The LESSEE shall pay the LESSOR Rs. 3,000 (RUPEES THREE THOUSAND FIVEHUNDRED ONLY) as Security Deposit. In the event of default security deposit isadjustable in rent of the said premises.9.The LESSOR has provided separate Meters for recording consumption of electricity atthe demised premises. The LESSEE shall pay such charges as per reading of meters tothe LESSOR. At the time of vacating the house LESSEE shall hand over all electricity bills paid & ensure payment of last meter reading.10.The LESSEE shall maintain the demised premises and keep wooden, electrical, sanitaryfittings and fixtures in good condition subject to normal wear and tear. The LESSOR willundertake all the major repairs. The LESSEE will allow access to the premises at allreasonable times to the LESSOR of his representatives to enable the execution of theserepairs.
