ORDER AND MEMORANDUM: IT IS HEREBY ORDERED that Pltf's application to proceed in forma pauperis 1 be GRANTED; IT IS FURTHER ORDERED that the Pltf shall pay an initial partial filing fee of $0.00; IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint because, in its current form, the complaint is legally frivolous or fails to state a claim upon which relief may be granted or both; IT IS FURTHER ORDERED that, as to Deft St.Charles Cou nty Adult Detention Center, Pltf's complaint be DISMISSED, w/o prejudce, because the complaint against said Deft is legally frivolous or fails to state a claim upon which relief may be granted, or both; IT IS FURTHER ORDERED that Pltf's mot ion for a temporary restraining order 4 be DENIED, w/o prejudice; IT IS FURTHER ORDERED that Pltf's motion for appointment of counsel 5 be DENIED, w/o prejudice; IT IS FURTHER ORDERED that, w/i 30 days of the date of this Order, Pltf shall f ile an amended complaint indicating how each named Deft is personally and directly responsible for the alleged violation of his rights; IT IS FURTHER ORDERED that the Clerk shall forward to Pltf, w/ a copy of this Order, the court-provided form for a prisoner to file "Complaint Under the Civil Rights Act, 42USC Section 1983; IT IS FURTHER ORDERED that, if Pltf fails to file an amended complaint as directed w/i the time period specified, the complaint shall be dismissed w/o prejudice; Response to Court due by 4/24/2006; Signed by Judge Rodney W.
